This paper addresses the issues states face in creating healthcare initiatives for their citizens. The preemption provisions of ERISA have presented a formidable obstacle to the implementation of these laws. The paper offers some alternatives and proposals which could possibly minimize the effect of preemption.

Challenging Nonprofit Legal Services: Four Cases From New Orleans, 1970 - 2004, Louis Crust

During the past century, lawyers in New Orleans created a number of organizations to provide legal services for the poor, as lawyers did throughout the country. Most of those organizations provided routine service directly to individual clients and received quiet acceptance within the city and the state. However, more aggressive lawyers in other legal services offices engaged in law reform or challenged politically powerful interests. These offices found themselves embroiled in controversy and facing impediments that were placed in the way of their work. Legal Education And Early Career Mentoring: Mid-Career Attorneys’ Pro Bono Commitment, Elizabeth A. Hoffmann

Department of Sociology Faculty Publications

Much extant research suggests that students who enter law school highly enthusiastic about public interest law and pro bono work often take mainstream jobs with minimal participation in pro bono activities. Frequently, these studies place some of the blame on law schools. This study, however, suggests that law schools, as well as mentors in first post-graduation jobs, might positively affect attorneys' level of commitment to pro bono work. This longitudinal study is unique in that it includes measures of students' attitudes during law school and in mid-career. Reparations: A Remedies Law Perspective, Darren L. Hutchinson

Scholarly Articles in Law Reviews & Journals

This article provides a general overview of reparations discourse in the United States and offers suggestions concerning how advocates of reparations might frame their claims. The author discusses how remedies law might be a useful means of redress for litigants and examines some of the political and legal barriers to reparations in the United States. The barriers include the failure of opponents to treat remedies for gross human rights or civil rights deprivations as a public good, rather than as a series of private transactions that benefit or burden individuals.
