Emergency Federalism: Calling On The States In Perilous Times, Adam M. Giuliano

University of Michigan Journal of Law Reform

The attacks of September 11 prompted a historic debate concerning terrorism and domestic emergency response. This ongoing dialogue has driven policy decisions touching upon both liberty and security concerns. Yet despite the enormous effort that has gone into the national response, the role of the sovereign states, and with it federalism, has received comparatively little attention. This Article explores the relevance of federalism within the context of the "War on Terror" and in the aftermath of Hurricane Katrina. Acknowledging that theories of federalism developed elsewhere are insufficient, he outlines a doctrine of 'emergency federalism.' The author argues that the Framers …

Against Expediency: The Ethics Of Education, Gerard Mannion

Journal of Catholic Education

This article suggests that church-linked universities and colleges can and should show that there is an alternative to the expediency and pseudo-utilitarian thinking which currently dominates higher education. Such institutions can and should serve as beacons of a virtuous approach to education which can show others a more positive way forward. Theology and ethics”both disciplines mutually informing the other”hold the key to fostering and promoting a true culture of ministry both in the day-to-day existence of universities and colleges and in nurturing young minds to take that culture of ministry out into the wider community.

Transportation Management Associations: A Reappraisal, Erik Ferguson

Journal of Public Transportation

This article reviews the results of eight national transportation management association (TMA) surveys conducted between 1989 and 2003 using meta-analytical techniques. TMAs became popular as vehicles for dealing with traffic congestion and related problems in the late 1980s. Median TMA annual budgets bottomed out in 1991, but have since rebounded to a new high in 2003. TMAs today are more diverse in terms of organizational structure, offer a wider variety of products and services, and …
