The Declaration on the Rights of Indigenous Peoples was adopted by the General Assembly on 13 September 2007, after more than twenty years of negotiations between states, indigenous representatives, lawyers, and academics. Although the resulting document is controversial and complex in its treatment of several important issues, its ambiguous characterization of the collective legal right of indigenous peoples to self-determination has been chosen as the focus of this work because it is the primary right from which all other rights, and problems, are derived. Approximately 218 million children are child laborers worldwide. These children work as agricultural workers, prostitutes, handicraft producers, and in virtually in every other form of employment imaginable. But although the problem of child labour has been one of recent international focus, there are still 126 million children involved in some form of hazardous work each year.

The existence of such statistics can be attributed in part to the complex and multi-faceted nature of child labour. Similarly, the reasons for child labour can range from economic and political instability, migration, lack of work, and/or poor school systems. Therefore, the reduction of …

This Comment will analyze the persisting area of divide that is responsible for delaying the Texas Legislature's implementation of Atkins. First, it will look at how the differing procedural approaches represent the larger political issues in the pro- and anti-death penalty debate surrounding the Texas Legislature's original pre-Atkins attempts to implement a ban on the execution of mentally retarded offenders. Additionally, it will provide a high-level overview of bills introduced since Atkins was decided, focusing on the most contentious issues that persisted from those attempts. The Narrow Passage To Medicare Reimbursement: Where Commercialization Barriers Meet Patients’ Rights, Jack Price

Using the field of neuroprosthetics as a paradigm, this Comment explores the connection between technology manufacturers and patients, as well as the common links between the two groups' facially differing motivations. Part II offers a basic introduction to the neuroprosthetic industry and to Medicare's current regulatory environment. Part III frames the reimbursement problem as it exists in current policy. Part IV explains why Medicare beneficiaries themselves do not have a legally functional remedy, and Part V offers some potential solutions that may have a better chance of meeting patient, industry, and legislative goals.

Maternal Disturbance In Activated Sphingolipid Metabolism Causes Pregnancy Loss In Mice, Kiyomi Mizugishi, Cuiling Li, Ana Olivera, Jacek Bielawski, Alicja Bielawska, Chu-Xia Deng, Richard L. Proia

Uterine decidualization, a process that occurs in response to embryo implantation, is critical for embryonic survival and thus is a key event for successful pregnancy. Here we show that the sphingolipid metabolic pathway is highly activated in the deciduum during pregnancy and disturbance of the pathway by disruption of sphingosine kinase (Sphk) genes causes defective decidualization with severely compromised uterine blood vessels, leading to early pregnancy loss. Sphk-deficient female mice (Sphk1–/–Sphk2+/–) exhibited both an enormous accumulation of dihydrosphingosine and sphingosine and a reduction in phosphatidylethanolamine levels in pregnant uteri. Although Lebanese emigrants have always been part of Lebanon’s life, Lebanon has not actually had a specific diaspora policy. This discussion paper will not deal with the migration process, or the motives for migration. It will focus, instead, on some selected aspects of the Lebanese diaspora and homeland relations. It will draw attention to some of the important networks connecting the Lebanese diaspora with Lebanon and will review courses of action undertaken by the Lebanese government to strengthen ties with its diaspora.

The American Bar Association's (ABA) long-standing compromise' with the American Institute of Certified Public Accountants (AICPA) regarding the role of lawyers in audits of public companies needs an overhaul. The current process is dysfunctional: accountants attempt to opine on a company's disclosures about litigation and to assess loss exposure without any foundation in the legal issues involved. During this process, those accountants turn to their clients' attorneys for help. But lawyers, concerned about preserving confidentiality and privilege, routinely respond to the accountants' requests with verbiage honed to say nothing at all. Do Judges Systematically Favor The Interests Of The Legal Profession?, Benjamin H. Barton

This Article answers this question with the following jurisprudential hypothesis. Many legal outcomes can be explained, and future cases predicted, by asking a very simple question: is there a plausible result in this case that will significantly affect the interests of the legal profession (positively or negatively)? If so, the case will be decided in the way that offers the best result for the legal profession.

The article presents theoretical support from the new institutionalism, cognitive psychology and economic theory. The Article then gathers and analyzes supporting cases from areas as diverse as constitutional law, torts, professional responsibility, employment law, …

This document was developed to promote protection of Alaska’ wildlife from nonnative rodents, especially rats. If constitutes a statewide invasive rodent management plan, which is part of a multi-agency effort to minimize the impact of invasive species in Alaska. A literature search and interviews were conducted, and reviews were obtained from experts in Alaska and elsewhere. The plan summarizes resisting information relevant to Alaska and recommends a collaborative structure for undertaking strategic actions, the Alaska Rodent Action Team. It also identifies dozens of strategic actions that are needed to prevent and eradicate invasive rodents. These fall into six categories: legal …

If the origin of a claim that generated legal fees is personal, the fees are not deductible. Possible favorable treatment for legal fees includes either above-the-line deductions or adjustments to basis or selling price in a property transaction. Some taxpayers have claimed described legal fees in such a way that they directly reduce the related income.
