Popular consensus suggests that the Employee Retirement Income Security Act (“ERISA”) is a mess, and one of historic proportions. ERISA’s comprehensive reach to protect employer-provided benefits has in practice produced unintended, if not contradictory, results. Congress passed ERISA over thirty years ago to protect the rights of employees who benefit from employer pension and welfare benefit plans. It did so with a series of regulations that promote uniformity in litigation across the various states through “strong preemption language.” The goal of uniformity arguably benefits workers by imposing regular standards of conduct which lend predictability to the scope of litigation, or …

Ribosome Recycling: An Essential Process Of Protein Synthesis, Michael C. Kiel, Hideko Kaji, Akira Kaji

A preponderance of textbooks outlines cellular protein synthesis (translation) in three basic steps: initiation, elongation, and termination. However, researchers in the field of translation accept that a vital fourth step exists; this fourth step is called ribosome recycling. Ribosome recycling occurs after the nascent polypeptide has been released during the termination step. Despite the release of the polypeptide, ribosomes remain bound to the mRNA and tRNA. It is only during the fourth step of translation that ribosomes are ultimately released from the mRNA, split into subunits, and are free to bind new mRNA, thus the term "ribosome recycling." Inhibition Of Antiassociation Activity Of Translation Initiation Factor 3 By Paromomycin, Go Hirokawa, Hideko Kaji, Akira Kaji

The effect of paromomycin on the interaction of ribosomal subunits was studied. Paromomycin inhibited the antiassociation activity of initiation factor 3 (IF3). Furthermore, ribosomal subunits were associated to form 70S ribosomes by paromomycin even in the presence of 1 mM Mg(2+). Paromomycin did not inhibit the binding of IF3 to the 30S ribosomal subunits. On the other hand, IF3 bound to the 30S subunits was expelled by paromomycin-induced subunit association (70S formation). These results indicate that the stabilization of 70S ribosomes by paromomycin may in part be responsible for its inhibitory effects on translocation and ribosome recycling.

In 1890, much of Detroit's street railway system used outmoded technology, had severe labor and public relations problems, and faced uncertainty over the remaining length of the 30-year franchise granted by the city in 1863, but extended in 1879, perhaps illegally. An apparent solution came in 1891, when William W. Cook-later to earn a fortune that he would give to the University of Michigan Law School-and other "Eastern capitalists" purchased Detroit's street rail system. They were unable to solve the existing problems, and the new outside ownership itself added difficulties. Cook's group sold out in 1894, and over the next …

Workplace harassment in its many forms presents an increasingly serious challenge for employers, in terms of legal liability and its potential negative effect on employee behavior. This article reviews workplace harassment with attention to the affirmative defense that the Supreme Court has authorized and the factors the courts have considered in deciding whether the defense has been established. That analysis in turn is applied to a discussion of specific actions organizations might take to prevent harassment and create a more positive and effective organizational environment.

Liability Insurance And Punitive Damages: Does Texas Public Policy Detest This Union Comment., Anthony H. Castillo

There is a nationwide debate on whether punitive damages should be insurable. Insuring punitive damages causes courts concern regarding whether a wrongdoer escapes punishment by having the insurer pay for damages attributable to the wrongdoer’s egregious conduct. The United States Court of Appeals for the Fifth Circuit noted Texas’ public policy does not justify interference with private insurance contracts. The Court determined Texas allows liability insurance contracts to cover punitive damages and declared the inquiry ended. But, in the years since this determination, many Texas appellate courts have contracted the Fifth Circuit’s holding. The shifting discussion among Texas appellate courts …

The purpose of my research is to examine the philosophic influences on three literary works: F. Scott Fitzgerald's The Great Gatsby, Ernest Hemingway's Death in the Afternoon, and Norman Mailer's An American Dream. Through an investigation of biographical, historical, cultural, and textual evidence, I will argue for the influence of several European philosophers---Friedrich Nietzsche, Søren Kierkegaard, and Martin Heidegger---on these authors and on the structures and messages of their works. I will discuss how the specific works I have selected not only reveal each author's apt understanding of the existential-philosophical crises facing the individual in the twentieth century, but also …

Sarcomas are rare mesenchymally-derived tumors with limited treatment options. Tyrosine kinases may serve as potential targets for sarcoma therapy because many are mutated or overexpressed in sarcomas and cell lines. One potential molecular target for sarcoma treatment is the Src tyrosine kinase. Three independently synthesized Src kinase inhibitors were evaluated in human sarcoma cell lines. Of the three, dasatinib, provided promising results as a potential sarcoma therapy. Until this study, dasatinib activity had not been characterized in sarcoma cells. Based on our previous findings of Src activation in human sarcomas, we evaluated the effects of dasatinib in twelve sarcoma cell …

Scissors Paper Rock is based on the true story of Amy Biel, a young and idealistic American woman who went to South Africa to support the political effort against Apartheid. She worked there as a volunteer organizer during a time of great political turmoil, and was days away from returning home to the United States, when she was violently killed in a riot. While Amy's death was not an accident--four men were found guilty for taking her life--it is certainly possible to think of her death as a tragedy. Cell fusion is an important technique that is used in the field of medicine and biomedical research. For instance, fusion can be used to create hybridomas and novel types of secretory hybrid cells. It may also be used to engineer cultured insulin-secreting pancreatic B-cell lines for the treatment of diabetes. Historically, the applications listed above have been accomplished by a number of methodologies including dielectrophoresis, centrifugation, polyethylene glycol (PEG) and viral fusion proteins. During adolescent brain maturation, there are likely sensitive periods where environmental conditions, including drug exposure, may influence development by modifying neuronal connections. Altering neuronal function may produce different phenotypes than expected under normal conditions that may influence subsequent responding to drugs of abuse after the brain is fully mature. Experiment one investigated the relationship between novelty preference and cocaine place preference in adolescent and adult rats. High responding adolescent rats displaying greater free choice novelty exploration (but not forced novelty locomotion) expressed decreased cocaine place conditioning compared to low responding rats. A collective case study is the study of more than one case (Stake, 1995). One therapist supervisor and three therapist supervisees from a child and adolescent residential foster care facility were observed during their individual clinical supervision and interviewed post-supervision. Currently, the literature on clinical supervision seldom addresses the supervision of working professional counselors; particularly those who are child and adolescent counselors (CACs).

This study replicated the study by Mary E. Neal, Job Satisfaction of Florida's High School Assistant Principals as a Factor in the Maintenance of an Administrative Workforce (2002) and extended the research by examining the job satisfaction of high school assistant principals in seven Florida county school districts. The present study utilized quantitative and qualitative data. Respondents (n = 128) were surveyed using the Minnesota Satisfaction Questionnaire (MSQ short form), Individual Demographic Questionnaire, and Telephone Interview Questionnaire. One assistant principal from each of seven counties volunteered to complete the Telephone Interview Questionnaire. The 128 respondents represented 60% of 214 assistant …

Similar to a product supply chain, an information supply chain is a dynamic environment where networks of information-sharing agents gather data from many sources and utilize the same data for different tasks. Unfortunately, raw data arriving from a variety of sources are often plagued by errors (Ballou et al. 1998), which can lead to poor decision making. This dissertation explores four narrative texts written about AIDS/HIV and evaluates each one by applying Kenneth Burke's redemption drama, consisting of guilt, purification, and redemption. The methodology is a close textual analysis using rhetorical analysis as a way to highlight the use of the redemption drama in language. The first chapter explores the history of AIDS/HIV and makes the argument for using Burke's rhetorical approach. The second chapter briefly highlights the plot of the four narratives and provides background information and context for each book. Harmful algal blooms (HABs) of the brevetoxin-producing dinoflagellate Karenia brevis occur periodically along the central west coast of Florida. Mass mortalities of marine birds have long been associated with these blooms, yet there is little data documenting the accumulation of brevetoxins in the tissues of birds and their prey items. An intense HAB event impacted the region from Tampa Bay to Charlotte Harbor during most of 2005. More than one hundred marine birds, representing twenty three species, were collected during this bloom. All birds sampled were found dead or had died within 24 hours of admittance to local wildlife rehabilitation …

The declaration of the International Year of Disabled Persons in 1981 and the international activism of persons with disabilities resulted in the globalization of disability, which involved a new framework for the treatment of PWDs. Although disability activism was being played out globally, it has been about PWDs gaining equality and full participation in their local societies. Therefore, at the heart of an international movement was the strategic organization of PWDs, most of who live in the developing world. Bullying is a complex behavior that can cause academic and social problems for students and can contribute to a negative school climate. Students who feel isolated or do not feel connected to their school may experience similar risks to those who are victimized by peers. Recent school violence incidents have led to an increase in bullying behavior research. When a patient is exposed surgical stress, the endocrine system secretes hormones in response to that stress. These hormones further activate the immune system to release cytokines and other acute phase reactions. These processes are supposed to protect the body by upregulating the innate immune system and producing an inflammatory response that acts to protect and heal. However, uncontrolled surgical stress may cause a weaker immune response that may lead to delayed wound healing. For over half of a century, social and behavioral scientists have been investigating the construct of psychopathy. Even so, psychopathy is still a highly misunderstood personality construct. Even though it has been estimated that psychopaths make up only about 1% of the general population, they are believed to consist of 15-25% of the prison population (Hare, 1996). Graduate Students/Mothers Negotiating Academia And Family Life: Discourses, Experiences, And Alternatives, Shirlan A. Williams

This study examines the experiences and perceptions of graduate students who are mothers. Based on discourse analysis, one-on-one interviews, and focus groups, this study argues that institutional discourses and practices place graduate students who are mothers in untenable and irreconcilable positions between "mom" and "student," between "family" and "the academy," between "self" and "success." These irreconcilable differences are created in discourse, enacted in institutional policies, and lived by the participants. The study offers action-based alternatives to the status quo policies of the university based on the self-described needs of these women. It reveals that support from all fronts--the home, the …

A significant proportion of college and university faculty are over 55, a growth expected to continue in future years. Vaccination is the only tool to protect against pneumococcal infection; however, vaccination rates remain far below the Healthy People 2010 objective of 90% coverage. The number one reason for such low rates is attributed to controversy over the protective efficacy of the vaccine in preventing nonbacteremic pneumonia (eg, community-acquired pneumonia [CAP]). Despite considerable debate surrounding an age associated cognitive decline in non-demented elders, recent studies indicate that changes attributable to normal aging affect cognitive processes and fluid abilities. Additionally, studies indicate that factors such as physical illness, depression, neurological damage, medication side effects, drug interactions, and the effects of surgery and anesthesia may also cause varying degrees of cognitive impairment. Individuals may develop symptoms in response to inhaled odors, chemicals, and irritants. This may affect their quality of life. Little is known about the prevalence and severity of symptoms that result from exposure to odors, chemicals and irritants. This study demonstrates the development of a new respiratory questionnaire to detect the prevalence and severity of symptoms experienced upon exposure to chemicals, odors, and irritants, and relates these symptoms to quality of life.
