Chronic wasting disease (CWD) is a transmissible spongiform encephalopathy (TSE) of domestic and wild cervids in North America. To address possible prevention regimens for CWD, we have used a mouse model system and the Rocky Mountain Laboratory (RML) mouse-adapted scrapie prion strain to screen efficacy of potential vaccine candidates. Three peptides derived from the primary amino acid sequence of the prion protein were conjugated to blue carrier protein (BCP) and formulated in an adjuvant containing M. avium subsp. avium. CL57/BL6 mice were vaccinated and boosted with 50 µg of the carrier protein–peptide conjugate formulation; all vaccines produced a humoral …
Factors Influencing Cancer Screening Practices Of Underserved Women, Kelly Ackerson, Kimberlee A. Gretebeck
Factors Influencing Cancer Screening Practices Of Underserved Women, Kelly Ackerson, Kimberlee A. Gretebeck
College of Nursing Faculty Research and Publications
Purpose: This integrated review was conducted to evaluate the factors that inhibit or promote decisions by African American and Hispanic women to obtain cervical cancer screening.
Data sources: Research articles were identified using MEDLINE, PubMed, and Cumulative Index to Nursing and Allied Health literature, published between 1999 and 2005.
Conclusions: Cervical cancer screening practices of African American and Hispanic women were influenced by extrinsic motivators including lack of insurance, no usual source of health care, acculturation, and socioeconomic factors. Intrinsic motivators were related to beliefs and perceptions of vulnerability, such as ignoring cervical cancer screening when no symptoms were present; …

What Is Extreme Cruelty? Judicial Review Of Deportation Cancellation Decisions For Victims Of Domestic Abuse, Anna Byrne
What Is Extreme Cruelty? Judicial Review Of Deportation Cancellation Decisions For Victims Of Domestic Abuse, Anna Byrne
Vanderbilt Law Review
In the 1990s, Congress began to devote increased attention to the problem of domestic violence, a rampant national problem with social and economic costs. At the same time, concerns about immigrants draining the social welfare service system and taking jobs away from U.S. citizens gave rise to an interest in more stringently monitoring and eradicating the illegal alien population in the United States. As part of the 1994 Violence Against Women Act ("VAWA"), Congress passed the battered spouse provision, attempting to reconcile its desires to address domestic violence and tighten immigration laws. Illegal immigrants are subject to removal procedures. However, …
The Origins Of Shared Intuitions Of Justice, Owen D. Jones, Paul H. Robinson, Robert Kurzban
The Origins Of Shared Intuitions Of Justice, Owen D. Jones, Paul H. Robinson, Robert Kurzban
Vanderbilt Law Review
The role of justice in assigning criminal liability and punishment has been a matter of long-standing debate. A standard argument against a desert distributive principle-that is, against distributing punishment according to an offender's blameworthiness- has been that such a concept of "desert" is simply too vague and the subject of too much disagreement to operationalize. There may be some truth to these complaints when applied to a philosophical notion of desert, which has been the traditional basis of the desert school.
But more recently, a utilitarian-based theory of desert has urged reliance on an empirical notion of desert, drawn from …

Rodrigo's Corrido: Race, Postcolonial Theory, And U.S. Civil Rights, Richard Delgado
Vanderbilt Law Review
Richard Delgado enlists his alter ego, Rodrigo, to analyze Latino legal history and civil rights. Encountering "the Professor" after testifying at a hearing on an immigration bill, Rodrigo excitedly tells his old friend and mentor about a new body of writing he has come across. Postcolonial theory, which deals with issues such as cultural survival, resistance, and collaboration, can help move American civil rights scholarship beyond its current impasse. Over dinner, Rodrigo demonstrates how insights from these writers can enrich U.S. civil rights theory and practice. He also posits a new theory of Latinos' sociolegal construction, based on a triple …

Fecal Microbe Distribution And Abundance Used As A Possible Proxy For Nutrient Source Identification In Eutrophic Wilgreen Lake, Madison County, Kentucky, Theresa A. Aguiar, Walter S. Borowski
EKU Faculty and Staff Scholarship
Wilgreen Lake is a eutrophic lake that has been listed on the EPA’s 303d list as nutrient impaired. Potential sources of this impairment are from humans, cattle manure and fertilizers. We suspect that the majority of nutrients originate from human sources. As a possible proxy for nutrient input, we test our hypothesis by examining fecal microbe distribution and abundance in the lake.
We took water samples at 19 sampling locations on 4 occasions. Sampling spanned 26 June to 15 August with the last 3 sampling events occurring at roughly two-week intervals. These samples were then processed using IDEXX methods, which …

Religious Diversity And Cooperation On Campus, Eboo Patel
Religious Diversity And Cooperation On Campus, Eboo Patel
Faculty Articles, Papers, and Other Scholarship
This article addresses the issue of religious diversity and cooperation on college campuses. Nowhere is America’s religious diversity more apparent than on college campuses. College campuses have done much to engage issues of race, gender, and other important markers of identity. Religion has typically been left out of this conversation. It is a critical time for higher education to engage religious diversity seriously. The American campus is a unique space which encourages both identity commitment and pluralist community; it values both individual freedom and contribution to the common good. Successfully promoting pluralism and inter-religious engagement on college campuses could impact …

This year’s APA Convention in San Francisco was something of a homecoming for the division, for it was in that same city, some 18 years ago, that group psychology and group psychotherapy first took the stage as a newly founded division within APA. Only a few months earlier this fledgling coalition of dedicated supporters of group approaches had successfully petitioned APA for official divisional recognition. As that petition explained, it was time for psychologists to focus on groups and group-based approaches to adjustment, arguing that there “are two basic psychological approaches to human life and to mental health; one through …
The Origins Of Shared Intuitions Of Justice, Owen D. Jones, Paul H. Robinson, Robert Kurzban
The Origins Of Shared Intuitions Of Justice, Owen D. Jones, Paul H. Robinson, Robert Kurzban
Vanderbilt Law School Faculty Publications
Contrary to the common wisdom among criminal law scholars, empirical evidence reveals that people's intuitions of justice are often specific, nuanced, and widely shared. Indeed, with regard to the core harms and evils to which criminal law addresses itself-physical aggression, takings without consent, and deception in transactions-the shared intuitions are stunningly consistent across cultures as well as demographics. It is puzzling that judgments of moral blameworthiness, which seem so complex and subjective, reflect such a remarkable consensus. What could explain this striking result?
The authors theorize that one explanation may be an evolved predisposition toward these shared intuitions of justice, …
Do Citizens Care About Federalism? An Experimental Test, Robert A. Mikos, Cindy D. Kam
Do Citizens Care About Federalism? An Experimental Test, Robert A. Mikos, Cindy D. Kam
Vanderbilt Law School Faculty Publications
The ongoing debate over the political safeguards of federalism has essentially ignored the role that citizens might play in restraining federal power. Scholars have assumed that citizens care only about policy outcomes and will invariably support congressional legislation that satisfies their substantive policy preferences, no matter the cost to state powers. Scholars thus typically turn to institutions-the courts or institutional features of the political process-to cabin congressional authority. We argue that ignoring citizens is a mistake. We propose a new theory of the political safeguards of federalism in which citizens help to safeguard state authority. We also test our theory …
The Populist Safeguards Of Federalism, Robert A. Mikos
The Populist Safeguards Of Federalism, Robert A. Mikos
Vanderbilt Law School Faculty Publications
Extant legal scholarship often portrays citizens as the catalysts of federalization. Scholars say that citizens pressure Congress to impose their morals on people living in other states, to trump home-state laws with which they disagree, or to shift the costs of regulatory programs onto out-of-state taxpayers, all to the demise of states' rights. Since Congress (usually) gives citizens what they want, scholars insist the courts must step in to protect states from federal encroachments. By contrast, this Article proposes a new theory of the populist safeguards of federalism. It develops two distinct but mutually reinforcing reasons why populist demands on …

Sustainable Goods Movement: Environmental Implications Of Trucks, Trains, Ships, And Planes, James J. Corbett, James J. Winebrake
Articles
Consumers today have a hard time avoiding products manufactured and transported overseas, as economic globalization moves more goods from factories to major markets throughout the world. For example, in 2005, imports and exports represented approximately 25% of the U.S. economy, up from 15% in 1990.1 Increased goods movements to and from international markets generate increased domestic freight transport, as products are shipped to and from a nation’s ports within a domestic freight transportation infrastructure that includes trucks, trains, ships, and planes. Freight’s increasing economic role implies a proportional increase in energy use and emissions from freight transport modes, contributing significantly …
The Ecological Significance Of The Herbaceous Layer In Temperate Forest Ecosystems, Frank S. Gilliam
The Ecological Significance Of The Herbaceous Layer In Temperate Forest Ecosystems, Frank S. Gilliam
Biological Sciences Faculty Research
Despite a growing awareness that the herbaceous layer serves a special role in maintaining the structure and function of forests, this stratum remainsan underappreciated aspect of forest ecosystems. In this article I review and synthesize information concerning the herb layer’s structure, composition, and dynamics to emphasize its role as an integral component of forest ecosystems. Because species diversity is highest in the herb layeramong all forest strata, forest biodiversity is largely a function of the herb-layer community. Competitive interactions within the herb layer candetermine the initial success of plants occupying higher strata, including the regeneration of dominant overstory tree species. Furthermore, …
