Contractors in bridge rehabilitation have been experiencing risks and difficulties associated with their line of work: safety and inspection issues, environmental concerns, business interruption, emergency situations, and rising labor costs. Safespan™ Multi-Span Bridge Platform System was developed by James Frangos and Lambros Apostolopoulos in 1995 to alleviate the obstacles found in bridge rehabilitation. The system designs are flexible. It uses various methods to connect the platform to the structure, depending on the bridge's configuration, that allow contractors to adjust the platform's height for a desired working clearance.

At present, there are approximately 300,000 asphalt paving workers who are routinely exposed to asphalt fume. Presently, limited data exists concerning the level of exposure and subsequent health effects for paving workers. The engineering control method developed for highway class pavers includes ventilation systems, baffles, and enclosures to capture the generated contaminant within the paver's auger area and to exhaust it before it enters the workers' working environment.

Excavating with a backhoe or similar equipment has the potential risk of hitting an underground utility which could cause serious injuries and expensive damages. An electronic device that provides a real-time warning of the utility lines immediately ahead of the digging tool and provides an easily interpreted, real-time computer readout of the depth, location, and size buried metallic objects. Developed by Dr. Leonhard E. Bernold, it consists of an active metal detector search coil; a signal processing (control) unit; and a PC computer equipped with an analog-to-digital converter interface.

Two overall goals of this paper are a) to provide a linguistic basis for promoting first language maintenance of Vietnamese in a larger United States context and b) to stimulate future research in language acquisition of Vietnamese-English speakers. This paper is divided into three sections. Section 1 discusses previous studies on first language (L1) maintenance among Vietnamese Americans. Section 2 presents a cross-linguistic comparison of Vietnamese and English across speech-sound, word, and grammatical language levels. A cross-linguistic analysis may help educators better understand speaking patterns of Vietnamese American students. The process of consolidating science and technology branch libraries in academic institutions is not new, but with ease of access to electronic resources, and with shrinking budgets and interdisciplinary research the norm, the idea of consolidation has become more attractive in the past decade. This article reports on the results of a 2005 survey of Association of Research Libraries (ARL) institutions and the status of their chemistry-related library resources and facilities. Background: Previous data in both rat and mouse genetic models suggest that there is a genetic relationship between acute alcohol withdrawal responses and innate alcohol drinking behavior. The purpose of the present study was to examine whether acute alcohol withdrawal responses, as measured by acoustic startle and prepulse inhibition (PPI) of acoustic startle, may be genetically related to innate differences in alcohol preference in two mouse lines selectively bred for high (HAP1 and HAP2) or low (LAP1 and LAP2) alcohol preference. Part II of this Comment summarizes the background of the HIPAA statute as an attempted solution to the privacy problem described above, including its legislative history and HHS promulgation of administrative rules. Next, Part III addresses the agency-imposed limitations on the scope of the statute. The Secretary's decision to rely solely on an administrative complaint process, combined with the government's narrow interpretation of the statute granting third parties immunity from penalties, has undermined enforcement of the privacy provision. Accordingly, Part IV discusses previous attempts to circumvent the administrative limitations by creating a private right of action and the reasons these …

Part II of the Article outlines the procedures required by the APA for agency adjudications. Part III discusses the three primary approaches that courts have followed to determine what triggers formal adjudicatory procedures and introduces the Chevron doctrine. Part IV examines how courts review agency interpretations of statutory provisions under Chevron and its progeny and explores two issues on the fringes of Chevron's domain-interpretations of agency jurisdiction and judicial review provisions-and the concerns that they raise. Next, using lessons from these analogous issues, Part V analyzes similar concerns about congressional intent, institutional competency, agency self-interest, and fairness in the …

Part II of this Comment will begin by examining the history of racially restrictive covenants, specifically the nature of covenants and the role of the federal government in both spreading and hindering the usage of such covenants. Part III will discuss the legal underpinnings of what makes such covenants unenforceable in Washington, and the best processes an attorney can use to remove them. Part IV will discuss a recent case that has significantly altered the collateral consequences of attempting to destroy racially restrictive covenants upon other associated covenants. This paper considers how the multiple realities of dispute resolution in any environment affect the work of conflict resolution practitioners. Conflict resolution practitioners are almost always invited in by representatives of the formal legal system, and their work generally focuses on managing - and perhaps reforming - this system. In practice, they cannot ignore the existence of parallel informal systems of conflict resolution that may undermine or distract from the formal state system. These may include structured alternatives to law, such as religious tribunals or community mediation programs. There may be other, more informal but equally significant family or community-based …

This essay will describe efforts to apply the principles and processes of restorative justice to the criminal justice system in prison as a workplace. The initiative began as a pilot project in one facility when prison staff recognized that they could not effectively work with inmates in a restorative way until they changed their relationships with one another. Based on the positive experience of the pilot project the Minnesota Department of Corrections (MNDOC) has now expanded the availability of restorative processes for staff conflict and unhealthy workplace units to all prison facilities. This essay surveys the question of victim need from a different vantage point. It takes as its starting point the voices of actual victims as recorded by researchers in the field. It reports on three studies and the linkage they uncover between victim distress and attitudes toward justice and reconciliation. What they reveal belies a simple notion of victim need and suggests that restorativists should move warily as they seek to reshape the criminal justice system into more harmony-producing forms. Victim-offender encounters, truth-telling, and moves toward apology and reconciliation are appealing in the abstract; but data suggests that victims whose …

For almost three days in late December 2005, millions of New York City commuters braved frigid temperatures as they trekked to work. Armed with their iPods and winter coats appropriate for an arctic expedition, the public walked, rode their bikes, and scooted on Segways to get where they needed to go. Some New Yorkers even did the unthinkable-they shared cabs and cars with complete strangers. Chronic tuberculosis represents a major health problem for one-third of the world’s population today. A key question relevant to chronic tuberculosis is the physiological status of Mycobacterium tuberculosis during this important stage of infection. To examine the molecular bases of chronic tuberculosis and the role of host immunity in mycobacterial growth, we determined the mycobacterial transcriptional profiles during chronic and reactivation phases of murine tuberculosis using in vivo microarray analysis (IVMA). Following 28 days of aerosol infection, mycobacterial counts remained stable, although the bacilli were metabolically active with a 50% active transcriptome. A polyphasic characterization of atypical isolates of Yersinia ruckeri (causative agent of enteric redmouth disease in trout) obtained from hatchery-reared brown trout Salmo trutta in South Carolina was performed. The Y. ruckeri isolates were biochemically and genetically distinct from reference cultures, including the type strain, but were unequivocally ascribed to the species Y. ruckeri, based on API 20E, VITEK, fatty acid methyl ester profiles, and 16S rRNA gene sequencing analysis. These isolates were nonmotile and unable to hydrolyze Tween 20/80 and were therefore classified as Y. ruckeri biotype 2. Interest in manure management and its effects on nitrogen (N) mineralization has increased in recent years. The focus of this research was to investigate the N-mineralization rates of different soil types in Coastal Plain soils and compare them to a soil from Illinois. Soils with and without dairy composted manure addition were subjected to different wetting/drying cycles [constant moisture at 60% waterfilled pore space (WFPS) and cycling moisture from 60 to 30% WFPS] under laboratory conditions at three different temperatures (11 °C, 18 °C, and 25 °C). A new garbage processing technology has been developed that sterilizes and separates inorganic and organic components of municipal solid waste. The non-composted byproduct of this process, Fluff ®, has the potential to be utilized as a soil amendment to improve soil conditions in highly degraded soils. A study was initiated to evaluate Fluff as a soil amendment for establishing native grasses on disturbed US Army training lands. Adrenomedullin (AM) has been characterized as an endogenous tissue survival factor and modulator of many inflammatory processes. Because of the increased susceptibility of the mammary gland to infection during the time surrounding parturition in the cow, we investigated how milk and tissue content of AM and its binding protein (AM-BP) might be affected by the stage of lactation and the udder health status. Milk and mammary biopsy samples were obtained from Holstein cows 21 days prior to and at various times after calving to represent the dry period and early and midstages of lactation.
