The Case For Specially Compensating The Victims Of Terrorist Acts: An Assessment, Robert L. Rabin, Stephen D. Sugarman

Hofstra Law Review

In light of the daunting prospect of terrorists striking again on the home front, what special measures, if any, should be taken to assure compensation to those killed or injured by such violence? The starting point for any discussion of the compensation of these victims (and their survivors), we believe, is an appreciation of the baseline arrangements our nation has in place for those killed or seriously injured regardless of cause. One policy option would be to leave victims of terrorism to whatever they might obtain from these baseline tort and social welfare compensation systems in default of special treatment. …

Visual Design, Order Effects, And Respondent Characteristics In A Self-Administered Survey, Michael J. Stern, Don A. Dillman, Jolene D. Smyth

Department of Sociology: Faculty Publications

Recent survey design research has shown that small changes in the structure and visual layout of questions can affect respondents’ answers. While the findings have provided strong evidence of such effects, they are limited by the homogeneity of their samples, in that many of these studies have used random samples of college students. In this paper, we examine the effects of seven experimental alterations in question format and visual design using data from a general population survey that allows us to examine the effects of demographic differences among respondents. Results from a 2005 random sample mail survey of 1,315 households …

Victimization And Posttraumatic Stress Disorder Among Runaway And Homeless Adolescents, Les B. Whitbeck, Dan R. Hoyt, Kurt Johnson, Xiaojin Chen

Department of Sociology: Faculty Publications

This article presents lifetime and 12-month prevalence rates and comorbidity for posttraumatic stress disorder (PTSD) among a sample of 428 homeless and runaway adolescents. Data are from baseline interviews of a longitudinal diagnostic study of 428 (187 males; 241 females) homeless and runaway adolescents aged 16-19 years (mean age = 17.4 years, SD = 1.05). The data were collected by full-time street interviewers on the streets and in shelters in eight Midwestern cities of various populations. About onethird (35.5%) of the runaways met lifetime criteria for PTSD and 16.1% met 12-month criteria for the disorder. More than 90% of the …

Department of Nutrition and Health Sciences: Faculty Publications

The objective of this research was to assess the impact of a nutrition education intervention on intake of total ω-3 fatty acids (n-3 FA) in heart patients. The intervention design was a randomized trial comparing 2 interventions: decisional balance (DB) and no decisional balance (NDB). The outcome measures were total dietary n-3 FA intake and food sources. Intakes were measured using an n-3 FA food frequency questionnaire at baseline, at 1 month (midpoint), and at 2 months (end). Participants were a convenience sample of 36 adults (15 males, 21 females) recruited from a local heart clinic. Data were processed using …

Aromatic Compounds In Three Varieties Of Turnip Greens Harvested At Three Maturity Levels, Georgia Jones, Ola Goode Sanders, Casey Grimm Jan 2007

Aromatic Compounds In Three Varieties Of Turnip Greens Harvested At Three Maturity Levels, Georgia Jones, Ola Goode Sanders, Casey Grimm

Department of Nutrition and Health Sciences: Faculty Publications

Turnip greens (Brassica rapa) are commonly consumed in the southern U.S.A. Typically, they have a bitter taste, which increases with maturity, probably because of increased levels of glucosinolates. While glucosinolate degradation products have been isolated from various members of the Brassica family, the effect of variety and maturity on these products has not been determined. This study focused on the glucosinolate degradation products of three varieties of turnip greens: Purple Top, Seven Top and Tokyo Cross, harvested 45, 60 and 75 days after planting. Four volatile components (benzene acetonitrile, benzene propane nitrile, 1H-indole-3-acetonitrile and benzene ethyl isothiocyanate) were isolated, identified …

The Use Of Rodenticides For Conservation Efforts, Gary W. Witmer, John D. Eisemann, Gregg Howald

United States Department of Agriculture Wildlife Services: Staff Publications

Non-native rats (Rattus spp.) and mice have been introduced to more than 80% of the island groups around the world. They have caused ecosystem-wide impacts, including the extirpation and extinction of many native and endemic species which evolved in a mammalian predator-free environment. Fortunately, practitioners have developed techniques to eradicate introduced rodents, allowing ecosystems to recover. Rodenticides have proven an effective tool in eradications, having been used in over 300 successful eradications worldwide. Careful planning, adequate resources, and a sustained effort by competent field staff are needed to help ensure a successful eradication program. Island eradications are logistically complex …

Development Of A Decision Support System For Selection Of Trenchless Technologies To Minimize Impact Of Utility Construction On Roadways, Dulcy M. Abraham, Hyeon-Shik Baik, Sanjiv B. Gokhale Jan 2007

Development Of A Decision Support System For Selection Of Trenchless Technologies To Minimize Impact Of Utility Construction On Roadways, Dulcy M. Abraham, Hyeon-Shik Baik, Sanjiv B. Gokhale

JTRP Technical Reports

The need to replace deteriorating underground utility infrastructure and to expand utility services, increases the need for utility conduits to intersect roadways. Open-trench method is currently the most widely used method for installation of underground pipelines and conduits of all sizes. However, open-cut construction has several shortcomings, chief amongst which are: health and safety concerns of workers, surface disturbance, disruption to vehicular/pedestrian traffic and reduction of pavement life. Today, other cost-effective alternatives exist to traditional open-trench construction. These methods are categorized as "Trenchless Technologies" as they require minimum trenching (excavation). While the benefits of trenchless technology are quite apparent when …

The Flood: Political Economy And Disaster, Mari J. Matsuda Jan 2007

The Flood: Political Economy And Disaster, Mari J. Matsuda

Georgetown Law Faculty Publications and Other Works

As summer faded to fall in 2005, a hurricane hit New Orleans, a city so unique in its history that it has more history than many American cities. It was nonetheless an American city in these telling parameters: a city of luxury alongside squalor, two-thirds Black, one-fourth poor, with the gap between its rich and poor growing at a gallop as the waters of lake and river lapped gently along aging, grass-covered levees.

Freeze the frame before the waters rise, and what do you see? A devastated public school system, where Black children are labeled “failing,” along with their schools. …

National Security And Environmental Laws: A Clear And Present Danger?, Hope M. Babcock

Georgetown Law Faculty Publications and Other Works

Without question, life in the United States has changed significantly since September 11, 2001. The attacks launched from within the United States in broad daylight against non-military targets and innocent civilians, followed by the intentional dispersal of the biological agent anthrax, ushered in an era of uncertainty and fear in this country unlike any in recent memory. The visible manifestations of this fear are still with us--concrete barriers and the closing of public spaces around public buildings, heightened security at airports and train stations subjecting people to invasive searches of their persons and belongings, the sudden, seemingly random appearance of …

Grotius, Ocean Fish Ranching, And The Public Trust Doctrine: Ride 'Em Charlie Tuna, Hope M. Babcock

Georgetown Law Faculty Publications and Other Works

Seventy percent of the world's fish populations are in serious decline; some have been fished to near extinction. While domestic and international efforts are underway to curb the rate at which the remaining fish are being depleted, the demand for fish appears to be outstripping these initiatives--before they can take hold, the fish may be gone. In response to this increasingly dire situation, many countries, including the United States, have turned to fish farming in hope of taking pressure off of certain wild stocks of fish while still meeting consumer demands for them. More recently, non-U.S. fish farmers have moved …

Idiopathic Granulomatous Mastitis Masquerading As Carcinoma Of The Breast: A Case Report And Review Of The Literature., Richard Tuli, Brian J O'Hara, Janet Hines, Anne L Rosenberg

Department of Surgery Faculty Papers

BACKGROUND: Idiopathic granulomatous mastitis is an uncommon, benign entity with a diagnosis of exclusion. The typical clinical presentation of idiopathic granulomatous mastitis often mimics infection or malignancy. As a result, histopathological confirmation of idiopathic granulomatous mastitis combined with exclusion of infection, malignancy and other causes of granulomatous disease is absolutely necessary. CASE PRESENTATION: We present a case of a young woman with idiopathic granulomatous mastitis, initially mistaken for mastitis as well as breast carcinoma, and successfully treated with a course of corticosteroids. CONCLUSION: There is no clear clinical consensus regarding the ideal therapeutic management of idiopathic granulomatous mastitis. Treatment options …

Functional Neuroimaging Information: A Case For Neuro Exceptionalism, Stacey A. Tovino Jan 2007

Functional Neuroimaging Information: A Case For Neuro Exceptionalism, Stacey A. Tovino

Faculty Articles

Functional magnetic resonance imaging (fMRI) has built on a number of technologies, including electroencephalography, magnetoencephalography, positron emission tomography, and single-photon emission computed tomography, to become one of the decade's most powerful tools for mapping sensory, motor, and cognitive function. Scientists also are using fMRI to study the neural correlates of a range of conditions, characteristics, and social behaviors, including schizophrenia, addiction, racial evaluation, deception, cooperation, and sexual preferences. Now poised to move outside the research context, functional neuroimaging raises a number of confidentiality, privacy, and identity issues. In this Article, I examine whether special, or heightened, confidentiality, privacy, and informed …

Indot Guidance Document For In-Situ Soil Flushing, Linda S. Lee, Xihong Zhai, Jaesun Lee

JTRP Technical Reports

Many of the Indiana Department of Transportation (INDOT) sites are contaminated with aromatic hydrocarbons and chlorinated solvents; these contaminants often occur in the form of light non-aqueous phase liquids (LNAPLs) or dense non-aqueous phase liquids (DNAPLs). Considerable effort has recently been focused on developing in-situ technologies for removing or destroying NAPL source zones, and several potentially viable methods have emerged including cosolvent-enhanced source zone removal. Most recently, site-specific remedial designs involving a combination of in-situ methods (often referred to as a treatment train) have been proposed for which data are still sparse. The primary goal of the laboratory experiments is …

Tracking Of Carbon Monoxide Poisoning Using Michigan Emergency Department And Hospital Records, Noreen Hughes, Kenneth D. Rosenman, Joseph Gardiner, Corinne Miller, Mary Jo Reilly

Michigan Journal of Public Health

Objectives: Among all deaths due to poisonings, carbon monoxide (CO) is the leading cause. Development of a surveillance system to track CO poisoning is a recommended public health activity. Initial steps to develop such a system are discussed. Methods: Michigan hospitals provided face sheets and discharge summaries of hospitalized and emergency department visits for CO poisonings. Reports were divided into three categories; intentional poisoning, non-work-related poisoning, and work related poisoning. The characteristics of the three groups, including demographics, sources of exposure, carboxyhemoglobin levels, and time of year were described. Results: There were 847 cases of CO poisoning reported. Another 312 …

It Depends On What The Meaning Of "False" Is: Falsity And Misleadingness In Commercial Speech Doctrine, Rebecca Tushnet Jan 2007

It Depends On What The Meaning Of "False" Is: Falsity And Misleadingness In Commercial Speech Doctrine, Rebecca Tushnet

Georgetown Law Faculty Publications and Other Works

While scholarship regarding the Supreme Court's noncommercial speech doctrine has often focused on the level of protection for truthful, non-misleading commercial speech, scholars have paid little attention to the exclusion of false or misleading commercial speech from all First Amendment protection. Examining the underpinnings of the false and misleading speech exclusion illuminates the practical difficulties that abolishing the commercial speech doctrine would pose. Through a series of fact patterns in trademark and false advertising cases, this piece demonstrates that defining what is false or misleading is often debatable. If commercial speech were given First Amendment protection, consumer protection and First …

Using Gis In Conjunction With Binary Logistic Regression: Mapping The Adequacy Of Prenatal Care Access In Grand Rapids, Michigan, Stephen Borders, Gustavo Rotondaro, Ryan Bosscher Jan 2007

Using Gis In Conjunction With Binary Logistic Regression: Mapping The Adequacy Of Prenatal Care Access In Grand Rapids, Michigan, Stephen Borders, Gustavo Rotondaro, Ryan Bosscher

Michigan Journal of Public Health

Background: Early prenatal care is often a prerequisite to a healthy baby. The relationship between adequate prenatal care and improved birthing outcomes is well known. Yet access to adequate prenatal care is complicated by a number of socioeconomic factors related to the mother. These factors include education, ethnicity, insurance type, and the age of the mother. When examining a number of these access measures related to prenatal care access and birthing outcomes, Michigan ranks poorly when compared to other states. In Grand Rapids, Michigan, some of these problems are particularly acute. Grand Rapids exceeds the statewide rates in infant mortality, …

A Theory And Definition Of Public Health Law, Lawrence O. Gostin

Georgetown Law Faculty Publications and Other Works

I offer a brief excerpt from my book, Public Health Law: Power, Duty, Restraint. My definition of public health law follows, and the remainder of this excerpt offers a justification as well as an expansion of the ideas presented: Public health law is the study of the legal powers and duties of the state, in collaboration with its partners (e.g., health care, business, the community, the media, and academe), to assure the conditions for people to be healthy (to identify, prevent, and ameliorate risks to health in the population) and the limitations on the power of the state to constrain …

The "Tobacco Wars" - Global Litigation Strategies, Lawrence O. Gostin

Georgetown Law Faculty Publications and Other Works

The Framework Convention on Tobacco Control (FCTC) identifies civil and criminal litigation as a public health strategy and promotes international cooperation (reporting, technical assistance, and information exchange). Holding the tobacco industry accountable through civil and criminal liability serves a number of public health objectives: punishes companies for hiding known health risks, manipulating nicotine content, and misleading the public; deters and preve nts future harmful behavior; compensates individuals and stake-holders for health care and other costs associated with smoking and exposure to environmental tobacco smoke (ETS); raises prices, resulting in lower tobacco consumption; increases disclosure of health risks, through labeling and …
