The Criminalization Of Treating End Of Life Patients With Risky Pain Medication And The Role Of The Extreme Emergency Situation, Gina Castellano

This Note examines the legality of physicians treating patients near the end of life with risky pain medication, specifically during an extreme emergency situation. The issues discussed include whether such treatment should be criminalized and, if criminalized, what standard should be used to determine culpability. This Note proposes that physicians should not be shielded from the criminal justice system, but that the standard of double effect intent should be expressly adopted in the adjudication of such cases.

Corporate Salvation Or Damnation? Proposed New Federal Legislation On Selective Waiver, Liesa L. Richter

Recently, critics have attacked federal law enforcement policies that encourage corporate targets to disclose sensitive information protected by the corporate attorney-client privilege and work-product doctrine, arguing that the policies are coercive, fundamentally unfair, and destined to chill the free flow of information to corporate counsel. The most readily apparent collateral consequence of these policies, however, has been corporations' loss of privilege protection in subsequent litigation. Good corporate citizens that have chosen to cooperate with the government in this manner have been punished with broad findings of waiver and the dissemination of protected information to companies' civil adversaries. Discovery, The Student Journal of Dale Bumpers College of Agricultural, Food and Life Sciences
It is no secret that people possess radically differing opinions and philosophical beliefs regarding domesticated animals. These contradictory perceptions are especially evident when examining people’s thoughts regarding the mental capabilities of animals and issues related to animal welfare. To determine whether or not gender and social environments play a role in these various perceptions, a survey was formulated and randomly distributed to 1000 undergraduate students across the University of Arkansas campus. Upon examination of the survey results, some very intriguing correlations became apparent. Of particular interest were the differences between the perceptions of males and females regarding domesticated animals. Women …

Excerpt: "George Fox University is owned by Northwest Yearly Meeting, which appoints all its trustees. Four-sevenths of these must be Friends, and this relationship keeps the institution close to its parent religious body. This being the case, a high degree of interaction exists between Northwest Yearly Meeting and the university, and this relationship is felt to be mutually beneficial. While the number of Friends students in the traditional undergraduate program has remained between 74 and 145 over the past three decades or more (making up between 4 and 15 percent of the traditional undergraduate population), aspects of Quaker identity are …

"While Benezet's antislavery influence touched many individuals, both inside and beyond Quaker circles, the power and efficacy of his influence can be seen most succinctly in the lives of three British antislavery activists, Granville Sharp, John Wesley and Thomas Clarkson. These three comprise a powerful and multifaceted voice from the latter part of the eighteenth century into the 1830s. Sharp represents a voice that reached the law courts and changed the legal position in England. Wesley became a prophetic voice to the mushrooming evangelical movement in England and America. Sports in Japan have long been embedded in community life, the educational system, the mass media, the corporate structures, and the nationalist sentiments of modern Japan. Neonatal Respiratory Distress Syndrome As A Function Of Gestational Age And The Lecithin/Sphingomyelin Ratio, Caryn M. St. Clair

This study was designed to derive predictive logistic regression equations to allow the risk of neonatal respiratory distress syndrome (RDS) to be defined as a function of both the lecithin/sphingomyelin (L/S) ratio and gestational age. We hypothesize that the optimal cutoff value will vary significantly depending on gestational age, and that our data will support the need to account for gestational age when interpreting test results. Data was collected via a retrospective chart review. Women who underwent amniocentesis for the purpose of assessing fetal lung maturity at Yale-New Haven Hospital from 1998 to 2004 were identified and included if delivery …

Under the umbrella of the burgeoning neurotransdisciplines, scholars are using the principles and research methodologies of their primary and secondary fields to examine developments in neuroimaging, neuromodulation, and psychopharmacology. The path for advanced scholarship at the intersection of law and neuroscience may clear if work across the disciplines is collected and reviewed and outstanding and debated issues are identified and clarified. In this article, I organize, examine and refine a narrow class of burgeoning neurotransdiscipline scholarship; that is, scholarship at the interface of law and functional magnetic resonance imaging.

The field of neuroethics has been described as an amalgamation of two branches of inquiry: “the neuroscience of ethics” and “the ethics of neuroscience.” The neuroscience of ethics may be described as “a scientific approach to understanding ethical behavior.” The law and ethics of neuroscience is concerned with the legal and ethical principles that should guide brain research and the treatment of neurological disease, as well as the effects that advances in neuroscience have on our social, moral, and philosophical views. This Article is a contribution to the law and ethics of neuroscience.

Imaging Body Structure And Mapping Brain Function: A Historical Approach, Stacey A. Tovino

Now in its second decade, functional magnetic resonance imaging (fMRI) localizes changes in blood oxygenation that occur in the brain when an individual performs a mental task. Physicians and scientists use fMRI not only to map sensory, motor, and cognitive functions, but also to study the neural correlates of a range of sensitive and potentially stigmatizing conditions, behaviors, and characteristics. Poised to move outside the traditional clinical and research contexts, fMRI raises a number of ethical, legal, and social issues that are being explored within a burgeoning neuroethics literature.
