Synthetic Biology: The Intellectual Property Puzzle, Arti K. Rai, Sapna Kumar

Synthetic biology, which operates at the intersection of biotechnology and information technology, has the potential to raise, in a particularly acute manner, the intellectual property problems that exist in both fields. A preliminary patent landscape reveals problematic foundational patents that could, if licensed and enforced inappropriately, impede the potential of the technology. The landscape also reveals a proliferation of patents on basic synthetic biology "parts" that could create transaction cost heavy patent thickets. Both foundational patents and patent thickets are likely to be particularly problematic to the extent they read on standards that synthetic biologists would like to establish. Synthetic …

Testing The Testimonial Concept And Exceptions To Confrontation: “A Little Child Shall Lead Them”, Robert P. Mosteller

In Crawford v. Washington (2004), the Supreme Court radically transformed the analysis of the Confrontation Clause for hearsay, but left many specific questions unanswered. Two years later in Davis v. Washington (2006), it revisited the subject and answered a few of the unresolved issues, but again left much in doubt, apparently reorienting the focus of the testimonial definition from that of the party making the statement to that of the person receiving it. One of the areas where the new doctrine has greatest potential importance is in cases involving children, particularly cases involving physical and sexual abuse. The importance derives …

Compelled Cooperation And The New Corporate Criminal Procedure, Lisa Kern Griffin

In response to the broad scope of the Enron-era frauds, the federal government has adopted novel strategies to investigate and prosecute corporate crimes. This Article examines the use of stringent cooperation requirements and deferred prosecution agreements, pursuant to which corporate internal investigations have become extensions of government enforcement efforts. At the same time, liability has shifted markedly to the employee level: Over one thousand individuals have been indicted and convicted since the July 2002 creation of the Corporate Fraud Task Force, while few corporations have been charged. Attitudes Of Nurses Toward Research, Nancee Hofmeister

The purpose of this study was to examine the attitudes of nurses toward research. Donabedian’s framework of structure, process and outcome is the conceptual model. A convenience sample (n=119) of registered nurses at a Midwest hospital answered Boothe’s Attitudes on Nursing Research Scale. The scale contains 84-items answered on a 5-point Likert scale. The scores were analyzed using descriptive statistics, t-tests, and ANOVA. Comparisons were made of the top and bottom quartile of item scores. The results indicate items that reflect structure and process are a subscale of the interest and environment scale. The most positive attitudes of the nurses …

Personal injury litigation, or tort law, traditionally, has been viewed as antithetical to the goals of public health. The focus on individual compensation for injuries resulting from accidents, products, and international wrongdoing arguably does not serve the "greater good" or communitarian objectives of public health. This paper examines a recent twist in EU data protection law. In the 1990s, the European Union was still primarily a market-creating organization and data protection in the European Union was aimed at rights abuses by market actors. Since the terrorist attacks of New York, Madrid, and London, however, cooperation on fighting crime has accelerated. Now, the challenge for the European Union is to protect privacy in its emerging system of criminal justice. This article describes principles of effective academic writing - offered not as edicts, but as guidelines - for legal scholars in particular. The overall focus is style, but the discussion begins with observations of format. These are followed by a few stylistic principles that govern clear and effective writing. None of these principles is a revelation to the student of method or to the accomplished writer. Should equality be viewed from a lifetime or "sublifetime" perspective? In measuring the inequality of income, for example, should we measure the inequality of lifetime income or of annual income? In characterizing a tax as "progressive" or "regressive," should we look to whether the annual tax burden increases with annual income, or instead to whether the lifetime tax burden increases with lifetime income? Should the overriding aim of anti-poverty programs be to reduce chronic poverty: being badly off for many years, because of low human capital or other long-run factors? The purpose of this study was to improve existing nutrition communication materials in an attempt to better educate parents of children in the WIC program about the influence that they have on their child’s health and weight. Data analysis: qualitative analysis of subjective comments given during the focus group. WIC clients favored positive messages and suggestions on how to decrease a child’s risk for becoming overweight, over messages that addressed the fact that if a parent was overweight then their child was at risk for becoming overweight. Role Of 2-5a-Dependent Rnase-L In Senescence And Longevity, J. B. Andersen, X. L. Li, C. S. Judge, Aimin Zhou, B. K. Jha, S. Shelby, L. Zhou, Robert H. Silverman, B. A. Hassel

Senescence is a permanent growth arrest that restricts the lifespan of primary cells in culture, and represents an in vitro model for aging. Senescence functions as a tumor suppressor mechanism that can be induced independent of replicative crisis by diverse stress stimuli. RNase-L mediates antiproliferative activities and functions as a tumor suppressor in prostate cancer, therefore, we examined a role for RNase-L in cellular senescence and aging. Ectopic expression of RNase-L induced a senescent morphology, a decrease in DNA synthesis, an increase in senescence-associated -galactosidase activity, and accelerated replicative senescence. Currently, the majority of soybean, corn, and cotton crops grown in the U.S. is RoundupReady® (RR) varieties. RR crops are resistant to the active ingredient, glyphosate [N-phosphonomethylglycine], in the herbicide Roundup®. RR crops have been genetically modified by the addition of an enzyme found in Agrobacterium sp. strain CP4 EPSPS that produces an essential protein, involved with aromatic amino-acid production, that is resistant to glyphosate. Glyphosate translocates via phloem from plant leaf tissues to other areas including the root system, and is thus able to affect the rhizosphere microbial community, including mycorrhizae, which are not resistant to glyphosate.
