What is the relationship between access to information and access to justice? Private parties obviously have many publicly available points of access to the information they seek in order to file a lawsuit. Lawyers can talk to their clients and other willing witnesses. Documents can be gathered. Specific statutes may sometimes permit information to be obtained before a formal lawsuit is brought. The Choice To Limit Choice: Using Psychiatric Advance Directives To Manage The Effects Of Mental Illness And Support Self-Responsibility, Breanne M. Sheetz

Psychiatric advance directives are a valuable tool for individuals with mental illnesses. Ulysses directives, in particular, allow individuals to bind themselves to treatment in advance of needing it for the purpose of overcoming illness-induced refusals. This Note evaluates the effectiveness of state advance directive statutes in three areas that are especially important for Ulysses directives: defining competency to execute, activate, and revoke directives; waiving the constitutional right to refuse treatment; and encouraging provider compliance. This Note ultimately advocates for other states to adopt provisions similar to a Washington State statute. The Washington statute authorizes Ulysses directives by allowing advance consent …

The Moral Hazard Problem With Privatization Of Public Enforcement: The Case Of Pharmaceutical Fraud, Dayna Bowen Matthew

This Article takes a law and economics approach to exploring some of the costs that arise when governments rely on private enforcement to accomplish the goals of public law. The analysis focuses on qui tam enforcement under the Civil False Claims Act, because a remarkable body of empirical data demonstrates the expansive role private qui tam relators are playing in enforcing Medicare and Medicaid fraud and abuse laws. The Article further focuses on the application of these laws to the pharmaceutical industry. This focus is enlightening because the Government, as well as private enforcers, have recently targeted this industry so …

OBJECTIVES: Proper valve selection is critical to ensure appropriate valve replacement for patients, because implantation of a small valve might place the patient at risk for persistent gradients. Labeled valve size is not the same as millimeter measure of prosthetic valve diameters or the annulus into which it will fit. Studies that use the labeled valve size in lieu of actual measured diameter in millimeters to compare different valves might be misleading. Using human cadaver hearts, we sized the aortic annulus with 8 commonly used prosthetic aortic valve sizers and compared the valves using geometric orifice area. This novel method …

Recent accumulated evidences suggest that prolactin is an important immunomodulator and may have a role in the pathogenesis of systemic lupus erythematosus (SLE). The aim of this study was to assess the frequency of hyperprolactinemia in women with SLE and to evaluate its correlation with disease flares. Serum prolactin levels were measured in 62 women with SLE and 50 age- and sex-matched healthy controls. In patients and control groups prolactin levels were determined by immunoradiometric assay (IRMA). The prolactin level was found to be higher than normal rang in (40.3%) of SLE patients in active stage versus only (8.06%) of …

Mentoring And Retention Of First And Second Year Teachers In North Dakota Public Schools, David C. Bartz

The purpose of this study was to investigate the impact of three types of mentoring experiences on the retention of first and second year public school teachers in North Dakota. Another purpose of the study was to investigate whether differences existed among first and second year public school teachers with regard to demographic variables that included ethnicity, gender, years of experience, school district size, and three different types of mentoring experiences: formal, informal, or no mentorship. The study surveyed 159 first and second year teachers in North Dakota with regard to their perceptions about the mentoring process they experienced.

5 Women's Status And Children's Food Security In Pakistan, Basudeb Guha‐Khasnobis, Gautam Hazarika

This chapter examines the role of women's intra-household status relative to men's in children's food security in Pakistan. Data from the 1991 Pakistan Integrated Household Survey (PIHS) yield a measure of evidence of a positive relation between women's intra-household status and children's food security.

Are Judges Overpaid?: A Skeptical Response To The Judicial Salary Debate, Eric A. Posner, G. Mitu Gulati, Stephen J. Choi

Nearly everyone thinks that judges are underpaid, but theory and evidence provide little support for this view. Theory suggests that increasing judicial salaries will improve judicial performance only if judges can be sanctioned for performing inadequately or if the appointments process reliably screens out low-ability candidates. However, federal judges and many state judges cannot be sanctioned, and the reliability of screening processes is open to question. An empirical study of the high court judges of the 50 states provides little evidence that raising salaries would improve judicial performance. The case for a pay raise has not been made.

Population ageing is a social phenomenon not only in developed countries but also in developing countries. The rapidity of population ageing in Korea during the past decade epitomizes how rapidly developing countries are ageing compared to developed countries. Rapid population ageing may be recognized as a universal phenomenon, equivalent to globalization (UN, 2002), which continues to influence almost all aspects of social systems and lives of people.
The relatively gradual population ageing rate in developed countries allowed resources to be accumulated to finance various reforms and the creation of social systems, which includes social welfare for the elderly. But developing …

Competition for job openings is becoming increasingly difficult for college graduates. According to the Bureau of Labor Statistics (2007), "Photographers can expect keen competition for job openings. The number of individuals interested in positions is much greater than the number of openings" (~27). As a result of this increasing competition, this study is intended to develop a model curriculum for a four-year baccalaureate degree program in photography with a business emphasis. More specifically, this study is aimed at developing curriculum that will enable students to more readily transition from academic theory into business and industrial practice.

The purpose of this research was to perform a role delineation study to validate and prioritize the competency areas included in the body of knowledge developed by SME/AME/Shingo for their three levels of certification examinations in lean manufacturing. A modified Delphi technique was used to gather data and describe what experts in the field consider important for candidates to know and become certified in the discipline of lean manufacturing. Seventy-six Delphi panel experts were selected to serve on the Delphi panel, based on their experience, expertise, and commitment. All orchids have a relationship with mycorrhizae during germination. Nutrient availability in soils often determines whether these relationships are maintained into adulthood. The aim of this study was to investigate the frequency of mycorrhizae infection in epiphytic and terrestrial Oerstedella exasperata. Since orchids that are rooted in the ground may have greater access to, or more consistent supplies of, nutrients I predicted that mycorrhizae would be found less often in terrestrial individuals. Furthermore, since plant fitness may be affected by the presence or absence of mycorrhizae or the availability of nutrients, fitness of epiphytic and terrestrial plants, with and without …

"Agu chupa! Agu chupa!" As we drove through the lush rolling hills of northwestern Rwanda, a crowd of young children appeared from the tea fields and repeatedly shouted these words to us. The taxi driver explained that the children wanted our "water bottes." Aware that visitors often drink bottled water, the children run alongside taxis with the hopes of obtaining the plastic bottles. Although Rwandan children typically carry their drinking water in tightly-woven baskets, the modern plastic bottles have become popular and prized possessions.

Farmers in California and Missouri have one thing in common- opposition to the production of genetically modified (GM) "pharma" crops.' A pharmaceutical crop, or "pharma" crop, is a plant that has been genetically altered so that it produces proteins which are used as drugs. Pharmaceutical companies can then harvest the crop and isolate the proteins, which may be used to make human or veterinary drugs. Farmers' fears include a variety of health and environmental hazards; in particular, they fear contamination of their regular crops and the associated market loss. "Silly rabbit, Trix are for kids." Since the 1970s, kids have gotten to know the silly rabbit created to promote sugary, fruit-flavored cereal in television ads. Today, "i'm lovin' it" is the McDonald's slogan, but to millions of children the more recognizable symbol is Ronald McDonald. Ronald McDonald is so recognizable that one study pegged recognition of Ronald among American children at 96% and another at 80% by children in nine other countries.
