Nutrient Concentrations At Baseflow Conditions In The Upper White River Basin, Southwest Missouri And Northwest Arkansas, Gopala G. Borchelt
Nutrient Concentrations At Baseflow Conditions In The Upper White River Basin, Southwest Missouri And Northwest Arkansas, Gopala G. Borchelt
Graduate Theses/Dissertations
The Upper White River Basin (UWRB) is becoming increasingly vulnerable to water quality degradation from urban/population growth and increased agricultural production. This study examines the relationships among nutrient levels, water chemistry and watershed characteristics of 19 watersheds in the UWRB. Water samples were collected during baseflow conditions each month for one year at USGS continuous-flow gage stations. Watershed characteristics evaluated were land use, geology, drainage area, flow discharge, and wastewater treatment plant discharge (WTP). Measured chemical water quality indicators include total nitrogen (TN), total phosphorus (TP), specific conductivity, turbidity, pH and dissolved oxygen. Rapidly expanding urban areas are associated with …
Price Discrimination In The Textbook Market: An Analysis Of The Post-Quality King Proposals To Prevent And Disincentivize Reimportation And Arbitrage, Christine Ongchin
Price Discrimination In The Textbook Market: An Analysis Of The Post-Quality King Proposals To Prevent And Disincentivize Reimportation And Arbitrage, Christine Ongchin
Cardozo Journal of International and Comparative Law
The note examines how the rise of the internet and legal developments, particularly the Supreme Court's decision in Quality King Distributors v. Lanza, have disrupted traditional price discrimination practices in the textbook industry. Historically, publishers engaged in third-degree price discrimination, charging higher prices in the U.S. market due to geographic isolation and limited arbitrage opportunities. However, the internet has facilitated reimportation and arbitrage, undermining this practice. The first sale doctrine under 17 U.S.C. § 109(a) further complicates efforts to prevent resale of cheaper, internationally purchased textbooks in the U.S. market. Publishers must now consider alternative strategies, such as contractual …

H.L.A. Hart is probably the most important legal theorist in the modern English-speaking world. The intriguing subtitle of Nicola Lacey's intimate biography, "The Nightmare and the Noble Dream, " echoes the name of Hart's 1997 Georgia Law Review paper, in which he identifies two warring, equally inadequate, visions of law in American jurisprudence: the "nightmare" of complete indeterminacy and unbridled judicial discretion and the "noble dream " of a closed, deterministic legal system of judicial restraint. Lacey implies that Hart's life itself was both a nightmare and a noble dream. This book review expands on Lacey's work and suggests how …

Representation And The Spatial Bias Of Direct Democracy, Daniel A. Smith
Representation And The Spatial Bias Of Direct Democracy, Daniel A. Smith
University of Colorado Law Review
Daniel Smith analyzes whether direct democracy favors urban and suburban voters' interests at the expense of rural voters' interests. After reviewing existing academic literature on the (sub)urban rural divide in direct democracy contests, the author performs an empirical analysis of county-level voting data on numerous recent Colorado ballot initiatives. The author concludes that there is a significant regional bias concerning popular votes on ballot initiatives, and that rural communities of interest will likely continue to be tyrannized by (sub)urban majorities in statewide ballot contests
Climate Change And The Poorest Nations: Further Reflections On Global Inequality, Ruth Gordon
Climate Change And The Poorest Nations: Further Reflections On Global Inequality, Ruth Gordon
University of Colorado Law Review
This article considers climate change from the perspective of the Third World and more particularly from the vantage point of the poorest nations in the international system. It concludes that those nations that are the most geographically and economically vulnerable will also have the least impact on mechanisms to halt the progress of this impending disaster. Hence, climate change is examined as yet another chapter in Third World powerlessness. Despite the fact that low-income nations participate in international deliberations, they do so from an exceedingly weak position that puts them in the untenable position of being on the receiving end …

Building Blocks For The Development Of A Chronic Care Lung Cancer Model, Leeanne Berlinsky
Building Blocks For The Development Of A Chronic Care Lung Cancer Model, Leeanne Berlinsky
MUSC Theses and Dissertations
Lung cancer, is the leading cause of cancer death in the United States for both men and women, and as such, represents a tremendous burden on the healthcare system. Survival rates have remained relatively unchanged over the past forty years, yet we seem to be on the verge of a paradigm shift as a result of advances in early screening, diagnosis and better treatment modalities. Lung cancer is different from all other cancers in that 90% of lung cancer cases can be attributed to the conscious behavioral risk factor of smoking, either currently or previously engaged in by the patient. …

Geochemical Evolution Of Basaltic Tuyas In Iceland During The Last Deglaciation, Kerri C. Schorzman
Geochemical Evolution Of Basaltic Tuyas In Iceland During The Last Deglaciation, Kerri C. Schorzman
Master's Theses and Capstones
Tuyas are subglacial volcanoes that preserve a unique history of the interplay between glaciation and hot spot volcanism in Iceland during the last deglaciation. Geochemical signatures in eruptive units of tuyas provide insight into the influence of deglaciation on mantle processes. We measured major and trace element concentrations and helium isotopes in samples from eruptive units of thirteen tuyas in Iceland, which have recently been determined from cosmogenic 3He surface exposure dating to have formed during the last deglaciation. All tuyas display temporal variations in geochemistry between eruptive units. Geochemical analyses of eruptive units reveal that individual tuyas are subject …
Consequences Of Fine-Scale Heterogeneity On Predictions Of The Carbon Cycle Using Lidar Data And A Height-Structured Ecosystem Model, R Quinn Thomas
Consequences Of Fine-Scale Heterogeneity On Predictions Of The Carbon Cycle Using Lidar Data And A Height-Structured Ecosystem Model, R Quinn Thomas
Master's Theses and Capstones
To more accurately predict carbon stocks and fluxes in forests, it is important to measure fine-scale heterogeneity in ecosystem structure across the landscape, and incorporate the underlying mechanisms responsible for the observed heterogeneity in ecosystem models. This study used large-footprint lidar and a height-structured ecosystem model to estimate carbon stocks and fluxes at Hubbard Brook Experimental Forest (HBEF). At HBEF elevation gradients yield a decline in aboveground carbon stock, due to changes in net growth rates and disturbance at higher elevations. Lidar and a height structured ecosystem model can accurately quantified aboveground carbon stocks. Estimates of aboveground carbon fluxes depended …
Independent Or Undeclared? The Role Of The Undeclared Voter In The New Hampshire Presidential Primary, Jennifer E S Gupta
Independent Or Undeclared? The Role Of The Undeclared Voter In The New Hampshire Presidential Primary, Jennifer E S Gupta
Master's Theses and Capstones
This thesis examines whether New Hampshire's undeclared voters vote in a similar manner to registered partisans or whether New Hampshire's voting laws allow undeclared voters to act more independently. Two main hypotheses focus on how New Hampshire's undeclared voters act and whether they are more volatile than partisans. Data from pre-primary tracking polls and Election Day exit polls were used to assess actions and volatility. Two variable cross-tabulation was the primary means of data analysis.
The author concludes that New Hampshire's undeclared voters are more independent but as involved and interested in politics as their partisan counterparts. Additionally, while undeclared …

No Mud Pies: Risk Avoidance As Risk Regulation, Catherine O’Neill
No Mud Pies: Risk Avoidance As Risk Regulation, Catherine O’Neill
Faculty Articles
Regulation in the environmental context has, until recently, been guided by risk reduction - strategies that require risk-producers to prevent, limit, or clean up contaminants. However, it has increasingly come to rely on "risk avoidance" - strategies that call upon risk-bearers to alter their practices and ways of living so as to avoid exposure to contaminants left unabated. For example, women and children might be asked to eliminate fish from their diets to avoid the risks of methylmercury contamination; asthmatics might be advised to refrain from going outside on "ozone alert" days to avoid the risks of ground-level ozone pollution; …
Satellite Microwave Remote Sensing Of Boreal-Arctic Land Surface State And Meteorology From Amsr-E, Lucas Alan Jones
Satellite Microwave Remote Sensing Of Boreal-Arctic Land Surface State And Meteorology From Amsr-E, Lucas Alan Jones
Graduate Student Theses, Dissertations, & Professional Papers
High latitude regions are undergoing significant climate-related change and represent an integral component of the Earth’s climate system. Near-surface vapor pressure deficit, soil temperature, and soil moisture are essential state variables for monitoring high latitude climate and estimating the response of terrestrial ecosystems to climate change. Methods are developed and evaluated to retrieve surface soil temperature, daily maximum/minimum air temperature, and land surface wetness information from the EOS Advanced Microwave Scanning Radiometer (AMSR-E) on the Aqua satellite for eight Boreal forest and Arctic tundra biophysical monitoring sites across Alaska and northern Canada. Daily vapor pressure deficit is determined by employing …

Development Of The Rocky Mountain Foreland Basin: Combined Structural, Mineralogical, And Geochemical Analysis Of Basin Evolution, Rocky Mountain Thrust Front, Northwest Montana, Emily Geraghty Ward
Graduate Student Theses, Dissertations, & Professional Papers
The sub-Middle Jurassic unconformity exhumed at Swift Reservoir, in the Rocky Mountain thrust belt of Montana, exposes structures that call for a re-evaluation of the deformation history at this locale. The unconformity separates Late Mississippian Madison Group carbonate (~340 Ma) from the transgressive basal sandstone of the Middle Jurassic (Bajocian-Bathonian) Sawtooth Formation (~170 Ma). Fieldwork established that northwest-trending, karst-widened fractures (grikes) are filled with cherty, phosphatic sandstone and conglomerate of the Sawtooth Formation and penetrate the Madison Group for 4 meters below the unconformity. Clam borings, filled with Sawtooth sandstone, pierce the unconformity surface, some of the fracture walls, and …

Newman, Chad, M.A. December 2007 Geography Small-Hydroelectricity and Landscape Change in the Bitterroot Mountains: Public Perceptions and Attitudes Chairperson: Dr. David D. Shively The development and use of renewable energy resources within America has made significant progress over the last two decades. Many state governments have adopted legislation requiring the development of their local renewable resources for generating electricity. In 2005, Montana’s State Legislature passed Senate Bill 415, The Montana Renewable Power Production and Rural Economic Development Act. This piece of legislation mandates the development and use of renewable energy resources by energy producers and requires that fifteen percent of …

Small Robe Band Of Blackfeet: Ethnogenesis By Social And Religious Transformation, Linda Matt Juneau
Graduate Student Theses, Dissertations, & Professional Papers
One of the most significant challenges facing Native Americans and their indigenous identity is a greater understanding of the historical complexity of relationships that interconnected ethnically diverse populations across geographic landscapes. This thesis examines the range of Blackfoot political, social, economic structures, spiritual beliefs, and practices that were in place at the time of Euro-American contact. I use historically documented evidence of transformations that took place from the beginning of the fur trade era through the reservation era. Through the theoretical lens of ethnogenesis I use a case study of the Small Robe (Inuck’siks) band of the South Piegan of …

Integrated Modeling Of Long-Term Vegetation And Hydrologic Dynamics In Rocky Mountain Watersheds, Robert Steven Ahl
Integrated Modeling Of Long-Term Vegetation And Hydrologic Dynamics In Rocky Mountain Watersheds, Robert Steven Ahl
Graduate Student Theses, Dissertations, & Professional Papers
Changes in forest structure resulting from natural disturbances, or managed treatments, can have negative and long lasting impacts on water resources. To facilitate integrated management of forest and water resources, a System for Long-Term Integrated Management Modeling (SLIMM) was developed.
By combining two spatially explicit, continuous time models, vegetation patterns can be simulated forward in time based on management criteria. Output from the SIMPPLLE vegetation simulator are converted into landcover maps at every time-step and used to predict hydrologic watershed responses to time-series landcover change with the SWAT model. Long-term watershed responses to vegetation management scenarios can therefore be evaluated …

Refocusing Light: Alex Sheshunoff Management Services, L.P. V. Johnson Moves Back To The Basics Of Covenants Not To Compete., Michael D. Paul, Ian C. Crawford
St. Mary's Law Journal
The law regarding covenants not to compete is a product of the tension between competing rights, including the right of companies to protect trade secrets, market share, and corporate goodwill. Companies use non-compete covenants to deter competition from former employees and discourage employees from job hopping. A covenant not to compete is generally defined as a contractual provision in which one party agrees to refrain from conducting business similar to that of the other party. Courts generally enforce covenants concerning activities after the termination of employment if such covenants are “reasonable in scope, time, and territory.” The promise cannot be …
