Kentucky Transportation Center Faculty and Researcher Publications
The authors find that there is a gap between expectations and actual results in terms of public involvement processes. They suggest more structured public involvement techniques. A case study of documenting citizen's aesthetic preferences illustrates their suggestions.
Efforts Toward National Educational Reform: An Essentialist Political Agenda, Thomas A. Kessinger
Efforts Toward National Educational Reform: An Essentialist Political Agenda, Thomas A. Kessinger
Mid-Western Educational Researcher
The purpose of this manuscript is to summarize the major provisions of four salient national government initiatives and relate each one to an “essentialist” political agenda that is based on the essentialist philosophy or theory of education. The National Assessment of Educational Progress, A Nation at Risk, America 2000/Goals 2000, and No Child Left Behind Act of 2001 are reviewed to denote a trend that projects the national government as a dominant player in public educational reform. Evidence is offered, by way of primary source documents, to establish a link between the four aforementioned actions and the essentialist way of …

Intellectual Relations Between Historical Geography And Latin Americanist Geography, Andrew Sluyter, Kent Mathewson
Faculty Publications
Content analysis of Geography in America (Gaile and Willmott 2003), which collects forty-seven chapters written by representatives of each of the specialty groups of the Association of American Geographers (AAG), reveals much about the recent intellectual structure of the discipline (Sluyter et al. 2006). One striking feature of that structure is the lack of intellectual connectivity, measured in practitioners named and publications cited, between the chapters of the Latin Americanist Specialty Group (LASG) and the Historical Geography Specialty Group (HGSG). Detailed comparison of the HGSG chapter and the Historical and Cultural Perspectives section of the LASG chapter addresses the character …
Separate And Unequal: Federal Tough-On-Guns Program Targets Minority Communities For Selective Enforcement, Bonita R. Gardner
Separate And Unequal: Federal Tough-On-Guns Program Targets Minority Communities For Selective Enforcement, Bonita R. Gardner
Michigan Journal of Race and Law
This Article examines the Project Safe Neighborhoods program and considers whether its disproportionate application in urban, majority- African American cities (large and small) violates the guarantee of equal protection under the law. This Article will start with a description of the program and how it operates-the limited application to street-level criminal activity in predominately African American communities. Based on preliminary data showing that Project Safe Neighborhoods disproportionately impacts African Americans, the Article turns to an analysis of the applicable law. Most courts have analyzed Project Safe Neighborhoods' race-based challenges under selective prosecution case law, which requires a showing by the …
(Still) Constitutional School De-Segregation Strategies: Teaching Racial Literacy To Secondary School Students And Preferencing Racially-Literate Applicants To Higher Education, Michael J. Kaufman
(Still) Constitutional School De-Segregation Strategies: Teaching Racial Literacy To Secondary School Students And Preferencing Racially-Literate Applicants To Higher Education, Michael J. Kaufman
Michigan Journal of Race and Law
In Parents Involved in Community Schools v. Seattle School Dist. No. 1, the Supreme Court declared that it will continue to scrutinize race-conscious educational decisions to insure that they are narrowly-tailored to serve a compelling governmental interest. This Article develops a strategy for enhancing racial diversity at all levels of American public education that can survive that rigorous constitutional scrutiny. The Article shows that school districts may prove that assigning a meaningful number of racially diverse students to their secondary schools is narrowly-tailored to achieve their compelling educational interest in teaching racial literacy. The constitutionality of this race-conscious educational …

Hildegard Von Bingen: German High School Teaching Unit, Gretchen Toth-Fejel
Senior Honors Theses and Projects
This honors thesis is a four week German-language teaching unit based on learning about the medieval mystic and scholar Hildegard von Bingen. The unit was created in order to: 1) teach language-learning in an interesting and student-directed way, 2) encourage critical thinking in a foreign language context, 3) demonstrate a valid connection between language and culture and, finally, 4) to show women’s contributions as useful to society. The format for this unit is based on the model created by educational professional Dr. Madeline Hunter at the University of California at Berkley. After completing this unit a successful student should: 1) …
Dialectics Of Diaspora Space: A Study Of Contemporary, Diasporic, South Asian Fiction, Christopher A. Zajchowski
Dialectics Of Diaspora Space: A Study Of Contemporary, Diasporic, South Asian Fiction, Christopher A. Zajchowski
Honors Theses
In light of these continuing debates concerning immigration, national identity and belonging, re-examinations of immigrant and ethnic communities, often referred to as ‘diaspora,’ have become increasingly popular and prudent. Khachig Tololian, editor of Diaspora magazine, calls diaspora “exemplary communities of the transnational moment.”5 In an increasingly globalized world, where labor, capital, and resources are passed fluidly from continent to continent, diaspora are created by relocation or displacement of immigrant workers and their descendents.6 For these unskilled, immigrant laborers, middle class immigrants, and the children of both groups, adaptation to the culture, society, and life in a new ‘host’ country can …
Short History Of Waterville, Maine, Stephen Plocher
Short History Of Waterville, Maine, Stephen Plocher
Honors Theses
If we were to simplify the story of Waterville to the lightest exploration possible, a good strategy might be to look at the city’s names. True, a good number of important events might be overlooked, but examining the names and name changes in the city’s history offers a unique view into the essence of its identity. Waterville has a rich history when it comes to names. The city itself went through a number of them in its early days, and these changes reflect the city’s continual reinvention of itself. The first people we know about who lived here, the Canibas …
Presenting Problems And Treatment Outcome Of College Counseling Center Clients: The Role Of Gender And Academic Major, Erik Lennart Timothy Fister
Presenting Problems And Treatment Outcome Of College Counseling Center Clients: The Role Of Gender And Academic Major, Erik Lennart Timothy Fister
Masters Theses
The current study examined whether gender and/or academic specialization had any relationship to students presenting issues, symptom severity, and treatment outcome at a university counseling center. The participants were 484 clients and the data were collected at an East Coast university counseling center. Clients were included for the analyses if they were a new intake, clearly fit into one of six categories for academic major, and attended more than one session. Each client filled out both the Personal Information Form (PIF) and Behavioral Health Questionnaire (BHQ) at intake, and was administered the BHQ prior to each subsequent session. Based on …
An Unrecognized State In Foreign And International Courts: The Case Of The Republic Of China On Taiwan, Pasha L. Hsieh
An Unrecognized State In Foreign And International Courts: The Case Of The Republic Of China On Taiwan, Pasha L. Hsieh
Michigan Journal of International Law
This Article provides a comparative analysis of the status of the Republic of China on Taiwan in foreign and international settings. Most existing literature written from the traditional public international law perspective focuses on Taiwan's separate statehood from China. This Article addresses an important pragmatic issue that international courts and courts in foreign countries frequently face: whether Taiwan is a "foreign State" for particular salutatory purposes in judicial proceedings. Part I of this Article provides an overview of China-Taiwan relations and the status of Taiwan under international law. I argue that the ROC on Taiwan has been a sovereign State …

The Legal Problems Of Everyday Life: The Nature, Extent And Consequences Of Justiciable Problems Experienced By Canadians, Ab Currie
Canadian Forum on Civil Justice
The purpose of this project is to inform policy makers about the incidence of civil justice problems and the extent of unmet need for assistance that justiciable problems in civil matters might represent. The study assumes a broad view of civil justice problems and unmet need. The broad view looks at the problem of civil justice and access to justice in terms of the prevalence of civil justice problems in the population. This involves identifying, by means of a sample survey, civil justice problems people have experienced that meet some reasonable threshold of seriousness. The broad view contrasts with the …

Toward A Pluralistic Theory On An Efficacious Patent Institution, 6 J. Marshall Rev. Intell. Prop. L. 220 (2007), Nari Lee
UIC Review of Intellectual Property Law
Time and time again, scholars have attempted to assess the efficacy of the intellectual property institution; these attempts have created a vast amount of literature. As impressive as the volume of work is that has been generated on this issue, so is the absence of a generally applicable theory of intellectual property, which either claims or disclaims the efficacy of the intellectual property institution. This article questions the existence of a general definition of efficiency that is applicable to the assessment of the patent institution. While it is true that the efficiency as applied to specific cases may be definable …

Indigenous Scientific Literacies In Nalo Hopkinson’S Ceremonial Worlds, Grace L. Dillon
Indigenous Nations Studies Faculty Publications and Presentations
Increasingly our critical tradition is recognizing the prevalence of issues of indigeneity in sf. Whether this emerging emphasis reflects keener powers of observation on the part of readers or shifting preferences on the part of writers, it is clear that, as the idealism of a Golden Age melts into the dross of colonial aftermath, sf is beginning to reflect the West's rising awareness that manifest destinies, whatever fashion they wear, wield a violent science in pursuing control and care little for the cultures they displace and erase. Nor is it surprising that a genre noted for its pioneering exploration of …

Privatizing Public Forums To Eliminate Dissent, Kevin F. O'Neill
Privatizing Public Forums To Eliminate Dissent, Kevin F. O'Neill
Law Faculty Articles and Essays
As the 2008 presidential campaign gets underway, the candidates may be tempted to suppress dissent at public forum rallies by using a tactic that Ronald Reagan pioneered and George W. Bush perfected. Under this tactic, the candidate's advance team “privatizes” a public square or public park by securing a municipal permit for the rally date that authorizes the expulsion of any citizen who manifests support for a rival candidate. At a 2004 Bush re-election rally, citizens who held signs opposing the President or opposing the war in Iraq were systematically expelled from a public park by Secret Service agents, who …

Impacts Of Davisco's Lake Norden Cheese Plant, Linnea C. Swanson
The Journal of Undergraduate Research
This paper addresses the regional impact of the Davisco Foods International cheese plant in Lake Norden, South Dakota. Since opening in November 2003, the $40 million plant has exerted a growing influence on dairying throughout eastern South Dakota and adjacent areas, as well as influencing the community of Lake Norden, the cultural landscape, the economy, and the environment in various ways. Each topic is investigated from a geographic perspective based primarily on field research. As the plant continues to expand, its impact on the covered topics deepens, both negatively and positively.
