The Unforeseen Ethical Ramifications Of Classroom Participation In Law School Clinics, Laura L. Rovner

The past decade has seen an enormous expansion in both the types of clinical programs offered by law schools and the role of clinical education in the law school curriculum. With this development has come greater involvement on the part of classroom faculty in clinical programs, who are increasingly collaborating with clinic faculty and students in clinic cases in a variety of ways. In this article, Professor Rovner asserts that such collaborations, as desirable as they may be for the practical and pedagogical benefits they offer, also may present significant ethical issues for faculty, students and clients.

Even conservative forecasts of climate change predict dramatic effects to environments, economies, and people around the world. Though the causal link between climate change and human rights is not as readily apparent as with other environmental issues, climate change impacts public health, food security, infrastructures, and natural resources. For the Inuit living in the rapidly melting Arctic, and citizens of small island developing states facing sea level rise, climate change has become a matter of human rights. Lead is a common environmental contaminant. Lead exposure is a preventable
risk that exists in all areas of the United States. In children, lead is associated with
impaired cognitive, motor, behavioral, and physical abilities. In 1991, the Centers
for Disease Control and Prevention defined the blood lead level that should
prompt public health actions as 10 µg/dL. Concurrently, the Centers for Disease
Control and Prevention also recognized that a blood lead level of 10 µg/dL did not
define a threshold for the harmful effects of lead. Research conducted since 1991
has strengthened the evidence that children’s physical and mental development …

With its abundance of natural resources and due to the state's strong environmental policies, Wisconsin has “enjoyed a reputation as a state rich in natural beauty and recreational opportunities.” Yet, despite the state's strong environmental protections, some based upon constitutional principles, this Article addresses whether Wisconsin's environmental constitutional provisions can be improved upon. This Article attempts to evaluate the existing environmental provisions in the Wisconsin Constitution, and considers, looking at a variety of options and sources, whether the state should proceed forward with any changes, minor or major, to environmental law in the Wisconsin Constitution. Community Context And Health Disparities Among Older Adults, Helen M. Zayac

African Americans, Hispanics, and other minorities in the U.S. continue to face conditions of residential and educational segregation, lower socioeconomic status, and higher rates of mortality than whites. Better theory-based research that uses community and individual level factors to explain how health disparities are created and perpetuated is needed. The Community Context and Health Disparities Model, which extends the work of Schulz and Northridge (2004) with elements described by Williams and Collins (2001), is described. This framework identifies the pathways by which characteristics of the physical, built, social, economic, and healthcare environments impact health and are mediated by individual traits. …

John Rawl’s A Theory of Justice, and Justice as Fairness were originally intended to promote a political structure of liberal democracy. Taken together with Habermas’ idea of ’discourse ethics’, this work has constituted a fundamental aspect of the communicative approach in the planning discipline over the past 20 years. While their work is quite theoretical, it need not be detached from the reality of day- to-day practice. We agree with O’Neill that the work toward greater justice and fairness is eminently practical, and so should derive from their work. In particular, we are interested in advancing justice/fairness in the arena …

Enormous quantities of public money are spent on transportation infrastructure (TI). According to the Bureau of Transportation Statistics this infrastructure spend in the U.S. amounted to almost $90 billion in 2001. In most political spheres, when public money is spent, the public demands a measure of accountability. The dimensions of this accountability depend on the character of the political system that funds TI. In most participatory democracies, ultimate accountability is exercised through a balloting system that ensures elected officials represent, to some degree, stakeholder views and preferences. However, despite enormous expenditure of public monies on TI, this type of accountability …

The authors find that there is a gap between expectations and actual results in terms of public involvement processes. They suggest more structured public involvement techniques. A case study of documenting citizen's aesthetic preferences illustrates their suggestions.
