Poetic (In)Justice? Rap Music Lyrics As Art, Life, And Criminal Evidence, Andrea L. Dennis Jan 2007

Poetic (In)Justice? Rap Music Lyrics As Art, Life, And Criminal Evidence, Andrea L. Dennis

Scholarly Works

Courts routinely admit defendant-authored rap music lyrics as substantive evidence in the adjudication of criminal cases. In doing so, courts fail to recognize that rap music lyrics are art. Rather, judges view the interpretation of rap music lyrics as a subject of common knowledge, interpret the defendant's lyrics literally, and characterize lyrics as autobiographical depictions of actual events. In making admissibility decisions, courts must give consideration to the social constraints and artistic conventions impacting the composition and interpretation of rap music lyrics. More particularly, they must understand the commercialized nature of the rap music industry, artist claims of authenticity, and …

William Tyndale As An Evangelical Theologian, Donald Dean Smeeton Ph.D. Jan 2007

William Tyndale As An Evangelical Theologian, Donald Dean Smeeton Ph.D.

The Christian Librarian

William Tyndale is rightly remembered as a sixteenth century Bible translator, but he was also a significant contributor to the formation of the English language and, more importantly, he was a theologian. This article highlights Tyndale’s contribution in each of these three areas and shows that his theology is compatible with ACL’s Statement of Faith. His theology motivated and guided his work as a translator and as a polemical and exegetical theologian.

Response Validity In Forensic Neuropsychology: Exploratory Factor Analytic Evidence Of Distinct Cognitive And Psychological Constructs, Nathaniel W. Nelson, Jerry J. Sweet, David Tr Berry, Fred B. Bryant, Robert P. Granacher Jan 2007

Response Validity In Forensic Neuropsychology: Exploratory Factor Analytic Evidence Of Distinct Cognitive And Psychological Constructs, Nathaniel W. Nelson, Jerry J. Sweet, David Tr Berry, Fred B. Bryant, Robert P. Granacher

Psychology: Faculty Publications and Other Works

Forensic neuropsychology studies usually address either cognitive effort or psychological response validity. Whether these are distinct constructs is unclear. In 122 participants evaluated in a compensation-seeking context, the present Exploratory Factor Analysis examined whether forced-choice cognitive effort measures (Victoria Symptom Validity Test, Test of Memory Malingering, Letter Memory Test) and Minnesota Multiphasic Personality Inventory, Second Edition (MMPI-2) validity scales (L, F, K, FBS, Fp, RBS, Md, Dsr2, S) load on independent factors. Regardless of factor rotation strategy (orthogonal or oblique), four response validity factors emerged by means of both Principal Components Analysis (82.7% total variance) and Principal-Axis Factor Analysis (74.1% …

Site Directed Mutagenesis Of Lozenge: A Yeast Two-Hybrid Analysis Of Transcription Factor Protein Interaction, Lailla Boumaza Jan 2007

Site Directed Mutagenesis Of Lozenge: A Yeast Two-Hybrid Analysis Of Transcription Factor Protein Interaction, Lailla Boumaza

Electronic Theses and Dissertations

Lozenge is a transcription factor. It is a member of the Runx1 homology group that includes Runt, Acute Myeloid Leukemia1, and Core Binding Factor alpha1. Expressed in the fruit fly Drosophila, Lozenge contributes to the determination of neuronal and non-neuronal cells by regulating the expression of many fate-determining transcription factors. In addition to Lozenge expression in wide varieties of tissues, it also participates in the pattern formation and specification of the photoreceptors R1/R6 and R7 and cones and pigment cells of the fly eye. A growing number of fate determining transcription factors are influenced by Lozenge during eye development. For …

Assessing The Legality Of Counterterrorism Measures Without Characterizing Them As Law Enforcement Or Military Action, Gregory E. Maggs Jan 2007

Assessing The Legality Of Counterterrorism Measures Without Characterizing Them As Law Enforcement Or Military Action, Gregory E. Maggs

GW Law Faculty Publications & Other Works

In this article, I develop three theses. First, I claim that disagreements about the legality of counterterrorism measures commonly stem from disagreements about whether to characterize the measures as law enforcement efforts or as military actions. Observers who see the measures as methods of controlling crime assess their lawfulness differently from those who see them as a form of warfare against terrorists because criminal law enforcement rules differ substantially from the laws of war. With many specific examples, I show that disputes about legality based on disagreements over characterization have arisen in at least eight different subject areas, ranging from …

Smoke And Mirrors: A Cultural-Psychological Analysis Of Tobacco Use, Michael Melczak Jan 2007

Smoke And Mirrors: A Cultural-Psychological Analysis Of Tobacco Use, Michael Melczak

Electronic Theses and Dissertations

This theoretical dissertation explores tobacco use from the perspectives of social constructivism and phenomenological depth psychology. In Part I, tobacco use is described as a cultural artifact, and transformations in tobacco use are traced through three different cultural contexts or "worlds": the indigenous or aboriginal worldview, the European and American worldview of the 17th through mid-19th centuries, and the modern American worldview (or "modernity"). In each of these worldviews, the cultural context informed and influenced (or reflected and reproduced) understandings of tobacco use. One notices the transformation of tobacco use, for example, from a god to a commodity and from …

It should surprise no one that TABOR has generated by far the most decisions.

Cigarette Smoking As A Public Health Hazard: Crafting Common Law And Legislative Strategies For Abatemen, George P. Smith Ii Jan 2007

Cigarette Smoking As A Public Health Hazard: Crafting Common Law And Legislative Strategies For Abatemen, George P. Smith Ii

Scholarly Articles

The debate over when, and to what extent, the government may regulate public smoking, is a contentious one of great moment. The point at which the line will be drawn with regard to an individual's right to smoke in public is narrowing. This right may stop at public restaurants and the workplace; or it may reach as far as public stadia, outdoor gathering spots and public streets. In 2006, one report showed 461 municipalities in thirty-three states and the District of Columbia, had adopted one-hundred percent smoke-free coverage in restaurants, bars or workplaces; and 135 municipalities had one-hundred percent coverage …

Violations Of Human Rights In The Russian Military, Cathy Smith Jan 2007

Violations Of Human Rights In The Russian Military, Cathy Smith

Human Rights & Human Welfare

In 2005, an estimated 450 deaths were caused by injuries due to internal military violence. The degradation inflicted on Russian soldiers within their regime necessitates reformation by the government and implementation of resolutions. Since the collapse of the Soviet Union, the Russian military has been experiencing heightened levels of personnel decline despite the compulsory draft. The prestige that the Soviet Army of the 1950s received through the late 1980s is dwindling rapidly. Despite the military code of conduct, today’s army is afflicted with perpetual violations of human rights. For the future of the Russian military, extensive action must include systemic …

The Roma: During And After Communism, Florinda Lucero, Jill Collum Jan 2007

The Roma: During And After Communism, Florinda Lucero, Jill Collum

Human Rights & Human Welfare

The Roma are an interconnected ethnic and cultural group that migrated out of India more than ten centuries ago. In the Czech Republic, they may have been present since the 15th century. Although relations within Czech lands began honorably, they quickly disintegrated into enmity and within a century Czechs could kill the Roma with impunity. Legislation restricting Roma movement came about in 1927 with Law 117: the “Law on Wandering Gypsies,” which stated that the Roma were now required to seek permission to stay overnight in any given location. In the run-up to World War II, parallel restrictions to those …

Totalitarianism: The Case Of Turkmenistan, Hayden Gore Jan 2007

Totalitarianism: The Case Of Turkmenistan, Hayden Gore

Human Rights & Human Welfare

With the disintegration of the Soviet Union in 1991, Saparmurat Niyazov, the former First Secretary of the Communist Party of Turkmenistan and self-styled “Turkmenbashi” (Father of All Turkmen), became the country’s first president, quickly fashioning Turkmenistan into one of the most repressive regimes in the world. Declared president-for-life after a dubious parliamentary election in which he selected all of the candidates, Niyazov has created a Stalinistic personality cult to glorify his image and to solidify his control over the state. His “reforms” have outlawed political dissent, marginalized ethnic and religious minorities, gutted the public health system, and enforced a campaign …
