What's In A Name Or, Better Yet, What's It Worth?: Cities, Sports Teams And The Right Of Publicity, Mitchell J. Nathanson Oct 2007

What's In A Name Or, Better Yet, What's It Worth?: Cities, Sports Teams And The Right Of Publicity, Mitchell J. Nathanson

Working Paper Series

This article examines the harm that accompanies real and threatened in-market relocations of professional sports teams and proposes a federal statutory remedy that will protect the interest of city residents given the reality that city governments have demonstrated their inability to adequately protect their electorate through contract law alone. Although, as this article discusses, there have been myriad bills proposed by Congress in response to several high profile out-of-market sports franchise relocations (mostly those involving NFL teams and mostly during the 1990’s), in-market relocations have historically occurred much more frequently, inflicting similar harms to the spurned city residents. Moreover, as …

Prediction Of Traditional Chinese Medicine Diagnosis From Psychosocial Questionnaires, Scott David Mist Oct 2007

Prediction Of Traditional Chinese Medicine Diagnosis From Psychosocial Questionnaires, Scott David Mist

Dissertations and Theses

Astonishingly, most Traditional Chinese Medicine (CM) research in the West proceeds without CM diagnoses, perhaps because CM diagnosis is time consuming or not considered relevant. One way to improve the feasibility of incorporating CM diagnosis would be to prescreen participants using questionnaires. This would allow cost savings in recruitment, and balancing of treatments by CM diagnosis. Consequently, the hypothesis of this research was that pre-treatment questionnaires can predict CM diagnosis.

Baseline questionnaires from 195 participants with temporomandibular joint disorder (TMD) were examined to test the hypothesis. Two methods, logistic regression (LR) and reconstructability analysis (RA), were used in conjunction to …

A Study Of The Relationship Between Semiotic Content In Commercial Email Subject Lines And The Decision By The Recipient To Open The Message, Stephen J. Johnson Oct 2007

A Study Of The Relationship Between Semiotic Content In Commercial Email Subject Lines And The Decision By The Recipient To Open The Message, Stephen J. Johnson

Masters Theses

The writings of Saussure, Peirce, Barthes, Eco and others express theories that symbols, signs, and signals are integral elements in the assignation of meaning within general human communication. Email marketing specialists such as Stephanie Miller, Andy Goldman, and Jeannieay Mullen opine that it is the email recipient’s inferences regarding the words in the address or subject lines that are the primary determinants in the decision whether or not to first open and subsequently respond to a commercial email. It would then seem that email marketers would be well served by understanding what forms these inferences in the minds of the …

Synthesis Of Tetragonal Phase Stabilized Nano And Submicron Sized Nanoparticles., Sudipta Seal, Satyajit Shukla

UCF Patents

Novel, monodispersed, spherical ZrO.sub.2 particles in the size range of approximately 10 to approximately 600 nm exhibiting metastable tetragonal crystal structure at room temperature and novel methods of preparation. The ZrO.sub.2 particles are approximately 100% in the tetragonal phase at room temperature and can be pure and free of foreign oxides. The novel method can include mixing zirconium-alkoxide and an alcohol, forming preparation one, followed by separately dissolving completely de-ionized water and a polymeric steric stabilizer in an alcohol forming preparation two. Next the preparations can be mixed with vigorous stirring while subjecting the materials to hydrolysis and condensation reactions …

Justice Gets A New Lease On Life, Donald E. Wilkes Jr. Oct 2007

Justice Gets A New Lease On Life, Donald E. Wilkes Jr.

Popular Media

The Georgia Supreme Court’s Oct. 26 decision not only corrected a grave miscarriage of justice and liberated an American citizen imprisoned in violation of his constitutional rights, but also advanced the rights of all Georgians. The decision gives teeth to the important constitutional ban on imposing cruel sentences. Wonderfully, it indirectly delivers stern rebukes to an overzealous district attorney and a clueless attorney general. Finally, it demonstrates that Georgia courts are taking very seriously their obligation to be the ultimate guardians of our liberties, no matter what the station of the citizen whose rights are denied.

Organizational Model Of The Southern Asia Cluster Family Businesses, Vipin Gupta, Nancy M. Levenburg, Lynda L. Moore, Jaideep Motwani, Thomas V. Schwarz

The South East Asian Journal of Management

Recently, there has been an increased interest in the family business organization. Traditionally, the ideal typical organizational model was one where the management, governance, and ownership entities are kept separate. This principal agent model has been a subject of public debate in the wake of several corporate scandals. In the family business organization, significant management, governance and ownership is often with the members of a family & its trusted partners. It is common in the US to regulate the management, governance, and ownership roles of the family members by using competitive criteria for the involvement of different members. In Southern …

Cell Death In Health And Disease, Richard A. Lockshin, Zahra Zakeri Oct 2007

Cell Death In Health And Disease, Richard A. Lockshin, Zahra Zakeri

Publications and Research

Cell death is clearly an important factor in development, homeostasis, pathology and in aging, but medical efforts based on controlling cell death have not become major aspects of medicine. There are several reasons why hopes have been slow to be fulfilled, and they present indications for new directions in research. Most effort has focused on the machinery of cell death, or the proximate effectors of apoptosis and their closely associated and interacting proteins. But cells have many options other than apoptosis. These include autophagy, necrosis, atrophy and stepwise or other alternate means of self-disassembly. The response of a cell to …

Entrepreneurs Vs. Business Plans: A Study Of Practicality And Usefulness, Sam Pd Anantadjaya Oct 2007

Entrepreneurs Vs. Business Plans: A Study Of Practicality And Usefulness, Sam Pd Anantadjaya

The South East Asian Journal of Management

In higher education, the topic on business plan is relatively studied in great details to note the importance on formulating business plans. Business plans are regarded as the reference point for business people; managers and members of the board of directors, to really realize the business activities. At least, the topic on business plan, which are discussed and studied in universities, ought to have its own value in the real business operations. Many entrepreneurs, however, face difficulties in formulating structural business plans. Many entrepreneurs may not actually formulate business plans as they are regarded important in many classrooms’ teaching, to …

Science In The Jury Box: Jurors' Views And Understanding Of Mitochondrial Dna Evidence, Valerie P. Hans, David H. Kaye, B. Michael Dann, Erin J. Farley, Stephanie Albertson Oct 2007

Science In The Jury Box: Jurors' Views And Understanding Of Mitochondrial Dna Evidence, Valerie P. Hans, David H. Kaye, B. Michael Dann, Erin J. Farley, Stephanie Albertson

Cornell Law Faculty Publications

This article describes parts of an unusually realistic experiment on the comprehension of expert testimony on mitochondrial DNA (mtDNA) sequencing in a criminal trial for robbery. Specifically, we examine how jurors who responded to summonses for jury duty evaluated portions of videotaped testimony involving probabilities and statistics. Although some jurors showed susceptibility to classic fallacies in interpreting conditional probabilities, the jurors as a whole were not overwhelmed by a 99.98% exclusion probability that the prosecution presented. Cognitive errors favoring the defense were more prevalent than ones favoring the prosecution. These findings lend scant support to the legal argument that mtDNA …
