Connecting With One Another: A Step By Step Approach To Guest And New Member Assimilation, Kevin Ray Milburn Nov 2007

Connecting With One Another: A Step By Step Approach To Guest And New Member Assimilation, Kevin Ray Milburn

Doctoral Dissertations and Projects

This project was born out of frustrating experiences at assimilating new members into church life, and disheartening statistics proving this is a common problem in Kentucky Southern Baptist churches. After reviewing literature pertaining to the topic, it became apparent there was a need for a simple, workable program for churches to use in assimilation. This project highlights the CONNECT strategy, a small group Sunday School program, which this author created to put into place at a model church. After gathering statistics from this model church since the program’s inception, it is evident that this CONNECT strategy does work for assimilation.

The Role Of Preaching In Revitalizing Declining Churches, Jammie D. Vance Nov 2007

The Role Of Preaching In Revitalizing Declining Churches, Jammie D. Vance

Doctoral Dissertations and Projects

A review of current literature demonstrates that very little material is available to assist Pastors in declining churches, develop a preaching plan to effect turn around in their church. The purpose of this project is to explore various styles of preaching and decide what style is biblical and most effective in reviving a declining church. This project also explores the causes and needs of the declining church so as to determine what subjects need to be addressed by the pastor of the declining church.

The European Union: Measuring Counterterrorism Cooperation, David T. Armitage Jr. Nov 2007

The European Union: Measuring Counterterrorism Cooperation, David T. Armitage Jr.

Strategic Forums

The United States and European Union (EU) are natural partners in the global war on terror, but cooperation, although absolutely necessary, is inherently difficult. Primary responsibility for most European counterterrorism policies remains with the separate governments of the 27 EU countries, which has presented coordination problems both within the EU and between the United States and European Union. Asymmetries in capacities and perceived vulnerabilities affect how different member states address counterterrorism. Institutional dynamics—not only among the various EU institutions but also between the EU and the North Atlantic Treaty Organization (NATO)—influence the degree of cooperation as well.

Private Use As Fair Use: Is It Fair?, Frances Grodzinsky, Maria C. Bottis Nov 2007

Private Use As Fair Use: Is It Fair?, Frances Grodzinsky, Maria C. Bottis

School of Computer Science & Engineering Faculty Publications

The age of digital technology has introduced new complications into the issues of fair and private use of copyrighted material. In fact, the question of private use of another's work has been transformed from a side issue in intellectual property jurisprudence into the very center of intellectual property discussions about rights and privileges in a networked world. This paper will explore the nuanced difference between fair and private use as articulated in the US and the European Copyright Laws. Part One will explain the legal use and meaning of fair use and its justifications. We maintain that it is almost …

A New Phenomenon In Impulsive-Flare-Associated Energetic Particles, Eileen E. Chollet, Joe Giacalone, Joseph E. Mazur, M Al Dayeh

Aerospace, Physics, and Space Science Faculty Publications

We present ACE/ULEIS and Wind/STEP observations of a new and unusual feature of energetic ions between 0.02 and 3 MeV nucleon ˉ¹ associated with impulsive solar flares. In addition to the usual velocity dispersion associated with the transit in the heliospheric magnetic field of energetic particles from a small localized source on the Sun, these events also show intermittent behavior that may be related to the magnetic flux tube structure of the solar wind. These are anomalous bursts of low-energy particles, which we call "tassels." Tassels are enhancements of ions extending to much lower energies than those associated with the …

Seismicity In The Vicinity Of Yucca Mountain, Nevada, For The Period October 1, 2004 To September 30, 2006, Ken Smith, John G. Anderson, Amy J. Smiecinski

Publications (YM)

This report describes earthquake activity within approximately 65 km of Yucca Mountain site during the October 1, 2004 to September 30, 2006 time period (FY05-06). The FY05-06 earthquake activity will be compared with the historical and more recent period of seismic activity in the Yucca Mountain region. The relationship between the distribution of seismicity and active faults, historical patterns of activity, and rates of earthquakes (number of events and their magnitudes) are important components in the assessment of the seismic hazard for the Yucca Mountain site. Since October 1992 the University of Nevada has compiled a catalog of earthquakes in …

Are There Rearrangement Hotspots In The Human Genome?, Max A. Alekseyev, Pavel A. Pevzner Nov 2007

Are There Rearrangement Hotspots In The Human Genome?, Max A. Alekseyev, Pavel A. Pevzner

Faculty Publications

In a landmark paper, Nadeau and Taylor [18] formulated the random breakage model (RBM) of chromosome evolution that postulates that there are no rearrangement hotspots in the human genome. In the next two decades, numerous studies with progressively increasing levels of resolution made RBM the de facto theory of chromosome evolution. Despite the fact that RBM had prophetic prediction power, it was recently refuted by Pevzner and Tesler [4], who introduced the fragile breakage model (FBM), postulating that the human genome is a mosaic of solid regions (with low propensity for rearrangements) and fragile regions (rearrangement hotspots). However, the rebuttal …

The Human Right To Privacy, James Griffin Nov 2007

The Human Right To Privacy, James Griffin

To say much of interest about a particular human right, we have to know its content. So we have to know how to decide its content. That is where I shall start.

Toward Informational Privacy Rights, Adam D. Moore Nov 2007

Toward Informational Privacy Rights, Adam D. Moore

San Diego Law Review

In this paper I will offer several arguments in support of the view that individuals have moral claims to control personal information. Coupled with rights to control access to one's body, capacities, and powers, or physical privacy rights, we will have taken important steps toward a general right to privacy. In Part I, a definition of privacy is offered along with an account of the value of privacy. Simply put, privacy - defined as control over access to locations and information - is necessary for human well-being. In Part II, an attempt to move beyond claims of value to claims …

How To Understand Legislatures: A Comment On Boudreau, Lupia, Mccubbins, And Rodriguez, Larry Alexander Nov 2007

How To Understand Legislatures: A Comment On Boudreau, Lupia, Mccubbins, And Rodriguez, Larry Alexander

San Diego Law Review

Much has been written about legal interpretation, and I have serious disagreements with most of it. So it is quite refreshing to read an article on the topic that, from my perspective, gets the topic right from start to finish. As an added bonus, two of the authors are my former colleagues. My enthusiasm for the approach taken by Boudreau, Lupia, McCubbins, and Rodriguez (hereinafter BLMR) has not proven fatal to my task of commenting on the article. I am not reduced to saying "Right on" and then signing off. There are issues to be flagged. Nonetheless, so much of …

Statutory Interpretation As A Parasitic Endeavor, Stephen F. Ross Nov 2007

Statutory Interpretation As A Parasitic Endeavor, Stephen F. Ross

San Diego Law Review

The principal theme of this essay is that statutory interpretation is a project that requires advocates and judges to utilize the insights of three discrete disciplines apart from law: communications and linguistics to understand the way that legislative drafters use words to communicate to others, either in text or in extratextual legislative material; political science to describe the way that legislators behave in enacting statutes; and political theory to provide a normative guide for courts interpreting statutes in a constitutional democracy. Judges, lawyers, and academics would find the process of interpretation more coherent if they transparently acknowledged when and how …

Does Warrantless Wiretapping Violate Moral Rights?, Evan Tsen Lee Nov 2007

Does Warrantless Wiretapping Violate Moral Rights?, Evan Tsen Lee

San Diego Law Review

The controversy over the Bush Administration's warrantless wiretapping program will not disappear any time soon. Legislators, policymakers, and academics should be thinking about whether and under what circumstances such surveillance should be illegal. A major factor in that decision is the moral status of such wiretapping. This essay, written for a symposium on moral rights to informational privacy, argues that two key determinants in the morality of warrantless wiretapping are (1) whether the subjects of the surveillance are known terrorists; and (2) whether the wiretapping is part of a pre-emptive surveillance program, or instead whether government operatives actually know of …

"I'Ve Got Nothing To Hide" And Other Misunderstandings Of Privacy, Daniel J. Solove Nov 2007

"I'Ve Got Nothing To Hide" And Other Misunderstandings Of Privacy, Daniel J. Solove

San Diego Law Review

In this short Article, written for a symposium in the San Diego Law Review, Professor Daniel Solove examines the nothing to hide argument. When asked about government surveillance and data mining, many people respond by declaring: "I've got nothing to hide." According to the nothing to hide argument, there is no threat to privacy unless the government uncovers unlawful activity, in which case a person has no legitimate justification to claim that it remain private. The nothing to hide argument and its variants are quite prevalent, and thus are worth addressing. In this essay, Solove critiques the nothing to hide …

What Statutes Mean: Interpretive Lessons From Positive Theories Of Communication And Legislation, Cheryl Boudreau, Arthur Lupia, Mathew D. Mccubbins, Daniel B. Rodrigues Nov 2007

What Statutes Mean: Interpretive Lessons From Positive Theories Of Communication And Legislation, Cheryl Boudreau, Arthur Lupia, Mathew D. Mccubbins, Daniel B. Rodrigues

San Diego Law Review

How should judges interpret statutes? For some scholars and judges, interpreting statutes requires little more than a close examination of statutory language, with perhaps a dictionary and a few interpretive canons nearby. For others, statutory interpretation must be based upon an assessment of a statute's underlying purpose, an evaluation of society's current norms and values, or a normative objective, such as the "law's integrity." With such differences squarely framed in the literature, it is reasonable to ask whether anything of value can be added. We contend that there is.

Intentionalism's Revival, James J. Brudney Nov 2007

Intentionalism's Revival, James J. Brudney

San Diego Law Review

The Article situates BLMRod's article in the context of recent efforts by a number of scholars to reclaim foundational legitimacy for intentionalism as an approach to construing statutes. The essay first applauds BLMRod's use of insights from communication theory to conceptualize statutes as compressed substantive or procedural commands that cannot be adequately understood without an appreciation for the compression process that generated them. The essay explores certain implications of this thematic focus. It discusses how the authors' approach may help clarify the status of legislative history as evidence of ascribed or imputed intent. It also suggests how that approach may …
