Preserving The Seeds Of Gender Fluidity: Tribal Courts And The Berdache Tradition, Andrew Gilden Jan 2007

Preserving The Seeds Of Gender Fluidity: Tribal Courts And The Berdache Tradition, Andrew Gilden

Michigan Journal of Gender & Law

This Article outlines the particular cultural characteristics giving rise to traditional berdachism, the means by which American policies fostered their decline, and the Navajo tribal courts' re-infusion of these characteristics into contemporary jurisprudence. By tracking the interplay between the traditional values of child autonomy, gender equality, and tribal collectivism, the rise, fall and potential reemergence of the berdache tradition can be analyzed as resulting from shifts in its determinative cultural elements.

The Relationship Between Stroop Task Performance And Delusion-Proneness In Non-Psychiatric Adults, Diana Orem Jan 2007

The Relationship Between Stroop Task Performance And Delusion-Proneness In Non-Psychiatric Adults, Diana Orem

Electronic Theses and Dissertations

Delusions are symptomatic of a number of psychiatric disorders; however, nonpsychiatric adults have also been shown to vary on a propensity toward delusional thought, or "delusion-proneness." The current study examined whether there is a relationship between an individual's degree of delusion proneness (on a continuum) and performance on the Stroop task, a cognitive task thought to measure conflict response monitoring. It was theorized that reduced conflict response monitoring ability may relate to (and perhaps cause) increased delusional propensity. A total of 35 nonpsychiatric college students completed a measure of delusion-proneness (Peter's et al. Delusion Inventory-21 item version; PDI-21), and a …

Orthodox reflection on modern legalism began in Russia, not because the Russians were better prepared to think about law than the other Orthodox peoples, but because Russia was the first Orthodox country to attempt to remake itself into a state and society of the modern type.

A Maid In Servitude: Filipino Domestic Workers In The Middle East, Kathleen Nadeau Jan 2007

A Maid In Servitude: Filipino Domestic Workers In The Middle East, Kathleen Nadeau

Anthropology Faculty Publications

This paper presents Filipino economic history as a way to provide a brief background to the events that precipitated one Filipino woman’s migration to the Middle East. Her story is not rare but shares in common patterns with the stories of many other female contract workers, especially domestic workers. It chronicles government policies and business practices that profit from their remittances. It is being retold here so that the invisible world of female contract workers and, more often than not, the poor conditions under which they live and labour, might be better understood.

The Public Funding Of Health Care: A Brief Historical Overview Of Principles, Practices, And Motives, Paul Carrick Jan 2007

The Public Funding Of Health Care: A Brief Historical Overview Of Principles, Practices, And Motives, Paul Carrick

Philosophy Faculty Publications

Nationally sponsored programs designed to fund health care for the general public are largely a twentieth century phenomenon. Yet a long glance backward at the medical and public health history of Western civilization, extending from the ancient Greeks to the twentieth century, reveals earlier periods when governments, religious institutions, and other groups provided some measure of medical relief for the sick, the poor, and the homeless. In this essay, I will provide not an exhaustive but rather an illustrative account of this oft forgotten fact. My objectives are threefold.

First, to remind us that the active concern of society for …

The Impact Of Popular Culture On American Perceptions Of The Courts, David Ray Papke Jan 2007

The Impact Of Popular Culture On American Perceptions Of The Courts, David Ray Papke

Faculty Publications

After a brief introduction defining popular culture as the commodities and experiences produced by the culture industry for mass audiences, this essay explores the impact of court-related popular culture on what Americans think of and expect from their courts. The Perry Mason effect from an earlier era and the CSI effect from the present are noted, as is scholarly work by Michael Asimow, Philip T. Dunwoody, Kimberlianne Podlas, Victoria S. Salzmann, and others. The essay concludes with suggestions for what might be done in the courthouse, the community, and the family room to control the impact of court-related popular culture …

Fish Traps On Ancient Shores, Eric Stephen White Jan 2007

Fish Traps On Ancient Shores, Eric Stephen White

UNLV Retrospective Theses & Dissertations

Archaeological investigations associated with the Lake Cahuilla fish traps have been restricted due to the lack of excavation and experimentation. This thesis addresses a new line of researches, which incorporates not only experimentation and excavation, but also the combination of fish trap design and fish behavior, to more fully explain the working mechanics of ancient fish traps. Not only are these issues examined, but other natural phenomenon, that affect the archaeological record, and its understanding are examined. This thesis relies heavily on biology for its conclusions.

“Tu Voz Amorosa I Triste”: La Política Del Lenguaje En La Poesía De José Fornaris, Jorge Camacho Jan 2007

“Tu Voz Amorosa I Triste”: La Política Del Lenguaje En La Poesía De José Fornaris, Jorge Camacho

The Danger Of Future Dangerousness In Death Penalty Use, Brian Sites Jan 2007

The Danger Of Future Dangerousness In Death Penalty Use, Brian Sites

Faculty Scholarship

In spite of thousands of years of science, humankind is distinctly unable to predict the future. And yet, the judicial system is called upon to do just so daily. In bail considerations, judges predict flight risk. In parole hearings, officials contemplate the likelihood of reoffense. And in three states, a defendant convicted of a capital crime will live or die based on what a judge and jury thinks he will do in an unknown future. It has been observed that “what separates the executioner from the murderer is the legal process by which the state ascertains and condemns those guilty …

Social Networks And Cross-Cultural Interaction: A New Interpretation Of The Female Terracotta Figurines Of Hellenistic Babylon, Stephanie Langin-Hooper Jan 2007

Social Networks And Cross-Cultural Interaction: A New Interpretation Of The Female Terracotta Figurines Of Hellenistic Babylon, Stephanie Langin-Hooper

Art History Research

In the study of the Hellenistic period in Babylon, cross-cultural interactions between Greeks and native Babylonians have been primarily interpreted using colonialist theories of Hellenisation, domination, and cultural isolation. This paper finds, however, that such theories cannot adequately explain the types of cross-cultural combinations seen in the archaeological record of female Hellenistic Babylonian terracotta figurines. The forms and functions of these terracotta figurines were substantially altered and combined throughout the Hellenistic period, resulting in Greek- Babylonian multicultural figurines as well as figurines that exhibited new features used exclusively in Hellenistic Babylonia. In order to facilitate a greater understanding of the …

What Are Aboriginal Rights?, Brian Slattery Jan 2007

What Are Aboriginal Rights?, Brian Slattery

Comparative Research in Law & Political Economy

Aboriginal rights in Canada are often viewed as specific rights - rights that are grounded in the specific practices and customs of particular aboriginal peoples and that differ from people to people. This article argues that these specific rights are in fact concrete instantiations of a panoply of generic aboriginal rights that are presumptively held by all aboriginal groups under Canadian common law. They include the right to conclude treaties, the right to customary law, the right to honourable treatment by the Crown, the right to an ancestral territory, the right of cultural integrity, and the right of self-government. These …

The Destruction Of Skeletal Elements By Carnivores: The Growth Of A General Model For Skeletal Element Destruction And Survival In Zooarchaeological Assemblages, Naomi Cleghorn, Curtis W. Marean

Sociology & Anthropology Faculty Publications - Archive

In the 1960s, Brain published on a series of taphonomic studies in which he observed the destruction of goat bones by pastoralists and domestic dogs. Those studies were notable and novel for a variety of reasons: 1) the attempt to control for complex parameters through the use of what we now recognize as experimental and naturalistic actualism, 2) documentation of the destructive impact on skeletal element abundance by secondary carnivore consumers, and 3) the attempt to understand the mechanical aspects of this process, and thus establish the foundation for justifiable uniformitarianism. This work set the stage for a proliferation of …

New Ways Of Thinking About Cultural Property: A Critical Appraisal Of The Antiquities Trade Debates, Alexander A. Bauer Jan 2007

New Ways Of Thinking About Cultural Property: A Critical Appraisal Of The Antiquities Trade Debates, Alexander A. Bauer

Fordham International Law Journal

In debates over the trade in archaeological objects or antiquities, on one end are those who believe that everyone has a shared interest in and claim to the common heritage of humanity, and thus support a vibrant and legal trade in cultural materials. On the other end are those who believe that cultural objects have special significance for specific groups and thus support the efforts of such groups to regulate their trade and seek their repatriation. The aim of this Essay is to critically examine the components of each group's arguments--their goals, assumptions, and inconsistencies--and try, where possible, to identify …

Three Modes Of Legal Problem Solving–And What To Do About Them In Legal Education, Thomas D. Barton Jan 2007

Three Modes Of Legal Problem Solving–And What To Do About Them In Legal Education, Thomas D. Barton

Faculty Scholarship

Legal problems are addressed in at least three basic ways, or modes, each of which is associated with a particular "tense": (1) through judgment, an authoritative decision pronounced by an empowered third party concerning the legal significance of past behaviors; (2) through consent, a "present tense" resolution in which the parties to a legal concern resolve it privately by negotiated or mediated agreement; and (3) through prevention, a future-oriented process that designs contracts, legal arrangements, compliance regimes, education and training programs, organizational structures, or even physical environments so as to keep legal risks from erupting into injuries or legal liability. …
