The Effective Viscosity Of Ash-Laden Flows, Kirstin Anne Burns Jan 2007

The Effective Viscosity Of Ash-Laden Flows, Kirstin Anne Burns

Graduate Student Theses, Dissertations, & Professional Papers

Debris flows can drastically alter ecosystems and damage infrastructure, and there is an increased risk of debris flows following a wildfire. In general, runoff and erosion drastically increase following a wildfire as a result of many processes, one of them being debris flows. Large debris flows are common in the months and years after wildfire in mountainous areas throughout the western U.S.A. The progressive bulking of surface runoff may be the dominant triggering mechanism of these debris flows. Vegetative ash on the hillslope becomes entrained in the flow, along with other fine-grained sediment and increases the effective viscosity of the …

A Comparison Of Fish Assemblages Among Five Habitat Types Within A Caribbean Lagoonal System, Ivan Mateo, William J. Tobias Jan 2007

A Comparison Of Fish Assemblages Among Five Habitat Types Within A Caribbean Lagoonal System, Ivan Mateo, William J. Tobias

Gulf and Caribbean Research

Fish assemblages associated with patch reefs, rubble, seagrass, algal plain, and sandy habitats types were studied at St. Croix's Southeastern barrier reef lagoon using underwater visual census techniques. Higher species richness and fish density were observed over patch reefs/rubble habitat followed by seagrass, algal plain, and unvegetated sandy habitat types. Thalassoma bifasciatum, Haemulon flavolineatum, and Acanthuras chirurgus were the most common fishes in highly structured habitat types (patch reef, rubble). Halichoeres bivittatus, Sparisoma radians, newly settled grunts (l.e., Haemulon spp.), and juveniles of Ocyurus chrysurus were mainly associated with vegetated habitat types (seagrass, algal beds), while …

Relative Abundance Of Pelagic Sharks In The Western North Atlantic Ocean, Including The Gulf Of Mexico And Caribbean Sea, Enric Cortes, Craig A. Brown, Lawrence R. Beerkircher Jan 2007

Relative Abundance Of Pelagic Sharks In The Western North Atlantic Ocean, Including The Gulf Of Mexico And Caribbean Sea, Enric Cortes, Craig A. Brown, Lawrence R. Beerkircher

Gulf and Caribbean Research

Little information exists on the status of pelagic shark populations in the Atlantic Ocean, especially in the Gulf of Mexico and Caribbean Sea. We derived indices of relative abundance for pelagic sharks based on mandatory logbooks and observer reports from a scientific observer program of the United States (US) pelagic longline fleet. Time series data from the pelagic longline logbook program (1986-2005) and the pelagic longline observer program (1992-2005) were standardized with Generalized Linear Model (GLM) procedures. Declines in relative abundance for the 6 pelagic shark species or genera examined in the logbook data analysis ranged from 43% for mako …

Large Pelagic Fishes In The Wider Caribbean And Northwest Atlantic Ocean: Movement Patterns Determined From Conventional And Electronic Tagging, Brian E. Luckhurst Jan 2007

Large Pelagic Fishes In The Wider Caribbean And Northwest Atlantic Ocean: Movement Patterns Determined From Conventional And Electronic Tagging, Brian E. Luckhurst

Gulf and Caribbean Research

Conventional tagging data has documented long distance movements (including trans-Atlantic movements) in blue marlin (Makaira nigricans) and yellowfin tuna (Thunnus albacares) within the Atlantic. Swordfish (Xiphius gladius) have also been shown to move substantial distances, although primarily in a north-south direction. There is, however, a paucity of data for wahoo (Acanthocybium solandri). In the past several years, electronic archival (i.e., data recording) tags have significantly advanced our understanding of the behavior and movement patterns of large pelagic fishes. Data from electronic arcltival tags have generally corroborated conventional tagging data with respect to …

Management In The Gulf And Caribbean: Mosaic Or Melting Pot?, Patrick Mcconney, Hazel A. Oxenford, Milton Haughton Jan 2007

Management In The Gulf And Caribbean: Mosaic Or Melting Pot?, Patrick Mcconney, Hazel A. Oxenford, Milton Haughton

Gulf and Caribbean Research

Does ''managing large pelagic fishes" mean the same thing across the diversity of maritime jurisdictions, governance arrangements, economies, languages, cultures, scales of operation and other features of the Gulf and Caribbean region? It would be surprising if it did. Yet international fisheries management urges this mosaic of management to become a melting pot; at least integrated, even if differentiated. This paper examines some themes underlying whether a mosaic or melting pot is the most apt metaphor for where we are, and are headed, in attempts to manage large pelagic fishes in the region. We pay particular attention to the multi-dimensional …

High Seas Fisheries: Troubled Waters, Tangled Governance And Recovery Prospects, David Vanderzwaag, Boris Worm Jan 2007

High Seas Fisheries: Troubled Waters, Tangled Governance And Recovery Prospects, David Vanderzwaag, Boris Worm

Articles, Book Chapters, & Popular Press

Global fisheries are in a perceived state of crisis. Despite growing technological effort and an unprecedented global expansion of fisheries, total landings (85-100 million MT per year) have stagnated and probably entered a period of slow decline. This trend may destabilize ocean ecosystems and undermine world seafood supplies, which provide the major source of protein for 2.3bn people, and international cooperation to address this issue has been slow. This is particularly true for highseas fisheries that occur in international waters encompassing some 61% of the world's ocean. These have been plagued by a fragmented and weak legal framework, poor enforcement …

A Scent-Station Survey Of Medium-Size Mammals On The Callaway Preserve, Harris County, Georgia, Anna-Maria Giacobello Jan 2007

A Scent-Station Survey Of Medium-Size Mammals On The Callaway Preserve, Harris County, Georgia, Anna-Maria Giacobello

Theses and Dissertations

The objective of this project was to determine the relative abundance of medium- sized mammals on the Callaway Preserve in Harris County, Georgia, using the scent- station technique, to determine species preference in regard to habitat, to compare relative abundance of species in regard to habitat, and to compare habitats in terms of the species present. Thirty-six scent-stations were established on the property and monitored to observe the presence of coyotes, raccoons, armadillos, foxes, opossums, and skunks. Of the total number of visits to the scent-stations, 36.36 % were coyotes, 18.18% were foxes 22.73% were armadillos, and 22.73% were raccoons. …

Multiple Mixed-Type Attractors In A Competition Model, J. M. Cushing, Shandelle M. Henson, Chantel C. Blackburn Jan 2007

Multiple Mixed-Type Attractors In A Competition Model, J. M. Cushing, Shandelle M. Henson, Chantel C. Blackburn

Faculty Publications

We show that a discrete-time, two-species competition model with Ricker (exponential) nonlinearities can exhibit multiple mixed-type attractors. By this is meant dynamic scenarios in which there are simultaneously present both coexistence attractors (in which both species are present) and exclusion attractors (in which one species is absent). Recent studies have investigated the inclusion of life-cycle stages in competition models as a casual mechanism for the existence of these kinds of multiple attractors. In this paper we investigate the role of nonlinearities in competition models without life-cycle stages. © 2007 Taylor & Francis Group, LLC.

Counting Outsiders: A Critical Exploration Of Outsider Course Enrollment In Canadian Legal Education, Kim Brooks, Natasha Bahkt, Gillian Calder, Jennifer Koshan, Sonia Lawrence, Carissima Mathen, Debra L. Parkes

Articles, Book Chapters, & Popular Press

In response to anecdotal concerns that student enrollment in "outsider" courses, and in particular feminist courses, is on the decline in Canadian law schools, the authors explore patterns of course enrollment at seven Canadian law schools. Articulating a definition of "outsider" that describes those who are members of groups historically lacking power in society, or traditionally outside the realms of fashioning, teaching, and adjudicating the law, the authors document the results of quantitative and qualitative surveys conducted at their respective schools to argue that outsider pedagogy remains a critical component of legal education. The article situates the numerical survey results …

Invasive Seaweed: Global And Regional Law And Policy Responses, Meinhard Doelle, Moira Mcconnell, David Vanderzwaag Jan 2007

Invasive Seaweed: Global And Regional Law And Policy Responses, Meinhard Doelle, Moira Mcconnell, David Vanderzwaag

Articles, Book Chapters, & Popular Press

We consider law and policy responses to invasive seaweeds at global and regional levels. Key global regimes considered include the 1982 United Nations Convention on the Law of the Sea, the Convention on Biological Diversity, the Ramsar Convention and the Bonn Convention on Migratory Species. Contributions from the Food and Agriculture Organization and the International Maritime Organization are also considered in the global context. At a regional level, examples of efforts in North America and Europe are offered to illustrate challenges and opportunities for regional responses to invasive seaweeds. We conclude with law and policy recommendations, most notably the need …

Consumers And Citizens In The Global Agrifood System: The Cases Of New Zealand And South Africa In The Global Red Meat Chain, Keiko Tanaka, Elizabeth Ransom Jan 2007

Consumers And Citizens In The Global Agrifood System: The Cases Of New Zealand And South Africa In The Global Red Meat Chain, Keiko Tanaka, Elizabeth Ransom

Sociology and Anthropology Faculty Publications

This chapter aims to show that the process of changing rules within the capitalist market system, specifically meat safety governance reform in New Zealand and South Africa, raises profound obstacles for human agency, yet opens new spaces for conceptualizing who participates in promoting change. Agency and structure are complex concepts with dueling tensions that alter the form and substance (as Wright and Middendorf argue in their Introduction to this volume) of individual and collective action in the red meat commodity chains of these two countries. We show that, far from being monolithic, the ways in which capitalism and a changing …

Is A Gift Forever?, William I. Miller Jan 2007

Is A Gift Forever?, William I. Miller

Articles

What are the rules regarding gifts you receive? Can you give them away? If so, must you conceal that you have done so from the original giver? Or is there a statute of limitations, after which any right the original giver has to feel wronged or to burden you with guilt for undervaluing it by giving it away rightly expires? Even an heirloom might exhaust its sacredness. Sometimes the sacred has a half-life, as might be the case, for instance, with your grandmother’s dining set. Can the giver ask for his gifts back if you try to give them away? …

Congressional Power To Extend Preclearance: A Response To Professor Karlan, Ellen D. Katz Jan 2007

Congressional Power To Extend Preclearance: A Response To Professor Karlan, Ellen D. Katz

Articles

Is the core provision of the Voting Rights Act unconstitutional? Many people now think that the Act's preclearance requirement is invalid, but Professor Karlan is not among them. In part, that is because she is not convinced the problems that originally motivated Congress to impose preclearance have been fully remedied. Professor Karlan points out the many ways section 5 of the Voting Rights Act (VRA) shapes behavior in the jurisdictions subject to the statute--not just by blocking discriminatory electoral changes, but also by influencing less transparent conduct by various political actors operating in these regions. Do not be so sure, …

The Road Goes On Forever And The Party Never Ends': A Response To Judge Tacoma's Prescription For A Return To Foster Care 'Limbo' And 'Drift', Frank E. Vandervort

Articles

This article responds to Judge Tacoma’s suggested changes in Michigan law. It begins with a very brief history of child welfare legislation at the federal and state levels. Next, it points out a number of errors in Judge Tacoma’s understanding of the current state of Michigan’s child welfare law.2 It is necessary to point out these errors because it seems that his misstatements of the law form the foundation for his recommended reforms. Then it will respond point-by-point to many of Judge Tacoma’s recommendations. Finally, I will off er several suggestions for addressing the problem of legal orphans that do …

Payton, Practical Wisdom, And The Pragmatist Judge: Is Payton's Goal To Prevent Unreasonable Entries Or To Effectuate Home Arrests?, Christos Papapetrou

Fordham Urban Law Journal

This Comment analyzes the conflicting "objective" and "subjective" tests that courts use to determine if a law enforcement officer's entry into a suspect's home is valid following the Supreme Court's holding in Payton v. New York that an arrest warrant implicitly carries with it a right to enter a suspect's home when there is "reason to believe" it is the suspect's residence and that the suspect is inside. The Comment questions how courts should interpret the "reason to believe" standard and analyzes an approach put forth by Professor Matthew A. Edwards in his article, Posner's Pragmatism and Payton Home Arrests. …

A Home Of Its Own: The Role Of Poverty Law In Furthering Law Schools' Mission, Marie A. Fallinger Jan 2007

A Home Of Its Own: The Role Of Poverty Law In Furthering Law Schools' Mission, Marie A. Fallinger

Fordham Urban Law Journal

This essay argues that poverty law can and should be a part of the law school curriculum. If the law school believes it mission to be creating "1) lawyers as public citizens and leaders; 2) lawyers as skilled technicians of the law; 3) lawyers as skilled counselors; 4) lawyers as advocates on behalf of a cause in legal institutions; and 5) lawyers as transformational partners with the poor" then poverty law instruction is vital.

Poverty, Inequality, And Class In The Structural Constitutional Law Course, Stephen Loffredo Jan 2007

Poverty, Inequality, And Class In The Structural Constitutional Law Course, Stephen Loffredo

Fordham Urban Law Journal

This Article argues that poverty and income inequality issues should be taught in a constitutional law course. Furthermore, it argues that these issues should not only be considered when discussing due process, equal protection, the First Amendment, but in also within the context of structural constitutional law, i.e. separation of powers and federalism.
