Toward A Third-Wave Feminist Legal Theory: Young Women, Pornography And The Praxis Of Pleasure, Bridget J. Crawford Jan 2007

Toward A Third-Wave Feminist Legal Theory: Young Women, Pornography And The Praxis Of Pleasure, Bridget J. Crawford

Elisabeth Haub School of Law Faculty Publications

This article critically examines a growing body of non-legal writing by women who have proclaimed a third-wave of feminism and suggests the ways that legal theory might be enriched by this work. Scholars typically label the nineteenth-century woman suffrage movement as the first wave of feminism, and view the legal and social activism of the 1970s as the second wave of feminism. The third wave of feminism, with its intellectual origins in the response to the Clarence Thomas Senate confirmation hearings, is a reaction to the popular stereotype that feminists are humorless man-haters. Third-wave feminists proclaim their difference from second-wave …

The Role Of The Fda In Innovation Policy, Rebecca S. Eisenberg Jan 2007

The Role Of The Fda In Innovation Policy, Rebecca S. Eisenberg

Michigan Telecommunications & Technology Law Review

This Article reexamines the role of FDA regulation in motivating investment in biopharmaceutical innovation. I begin by challenging the standard story that it is the patent system that makes drug development profitable, and drug regulation that makes it costly, by showing how patents add to costs and how drug regulation works in tandem with patents to protect profits. I then compare FDA-administered exclusive rights to patents as a means of fortifying drug development incentives, suggesting ways that FDA-administered rights might be preferable both from the perspective of policy makers and from the perspective of firms. In the remainder of the …

Patents And Diversity In Innovation, Brian Kahin Jan 2007

Patents And Diversity In Innovation, Brian Kahin

Michigan Telecommunications & Technology Law Review

Over the past quarter-century, the patent system has expanded in scope and significance, claiming a central position in a U.S. economy increasingly based on knowledge and intangible assets. This historic expansion has come at the cost of controversy and, within the past five years, growing public scrutiny from outside the system--from the press, business, Congress, and finally the Supreme Court. However, proposed reforms are marked by deepening divisions between sectors of the economy. The information technology (IT) and services industries favor strong reforms while pharmaceutical and biotech industries, as well as the patent bar, favor modest, incremental reforms. This yawning …

Restoring The Genetic Commons: A Common Sense Approach To Biotechnology Patents In The Wake Of Ksr V. Teleflex , Anna Bartow Laakmann

Michigan Telecommunications & Technology Law Review

In this Article, I argue that a new approach to biotechnology patenting is necessary to fully realize the tremendous potential of recent advances in our understanding of the human genome. Part I places the gene patenting debate in context by highlighting the key landmarks that have shaped the biotechnology industry and outlining the products and stakeholders that comprise the industry. Part II describes the current state of the law on biotechnology patents, summarizing the Federal Circuit's application of the various doctrines that collectively define the patent landscape's parameters. In this Part, I explain how the Federal Circuit's jurisprudence is tied …

Copyright And Youtube: Pirate's Playground Or Fair Use Forum?, Kurt Hunt Jan 2007

Copyright And Youtube: Pirate's Playground Or Fair Use Forum?, Kurt Hunt

Michigan Telecommunications & Technology Law Review

The entertainment industry has a history of framing new technology as piracy that threatens its very existence, regardless of the potential benefits of the technology or the legal limits of copyright rights. In the case of YouTube, copyright owners' attempts to retain content control negatively impact the public's ability to discuss culture in an online world. This implicates the basic policy behind fair use: to prevent copyright law from "stifl[ing] the very creativity which that law is designed to foster." The internet has become a powerful medium for expression. It is a vital tool in today's world for sharing original …

The Use Of Drug Testing To Police Sex And Gender In The Olympic Games, Haley K. Olsen-Acre Jan 2007

The Use Of Drug Testing To Police Sex And Gender In The Olympic Games, Haley K. Olsen-Acre

Michigan Journal of Gender & Law

Part I of this Article discusses the history and development of sex testing and drug testing and argues that the two are both historically and ideologically linked. Part II examines the current Code in detail and argues that the Code's focus on hormone-based controls acts to police sex and gender in Olympic athletes, thereby extending historical sex testing practices to a new era. This Article ultimately concludes that without recognizing and addressing the need for further research into the role of "sex" hormones in the body and the interplay of social context and biological circumstances, the IOC cannot maintain an …

Resembling Nothing: Image And Being In Plato, Yancy Hughes Dominick Jan 2007

Resembling Nothing: Image And Being In Plato, Yancy Hughes Dominick

The Society for Ancient Greek Philosophy Newsletter

A crucial application of Plato’s views on the use of images in philosophy occurs through the use of the image relationship as an image for the relation of forms and particulars. The relation of a picture to the object it depicts, or that between a reflection and what it reflects, can be seen as analogous to the relation of a particular to the form in which it participates. Although the attack on the image model as analogous to the relation of forms and particulars in the Parmenides threatens to undermine any reliance on that model, this essay will present a …

The Status Of Childhood Lead Poisoning And Prevention In Nevada, Usa, Anne Rothweiler, Elena E. Cabb, Shawn Gerstenberger Jan 2007

The Status Of Childhood Lead Poisoning And Prevention In Nevada, Usa, Anne Rothweiler, Elena E. Cabb, Shawn Gerstenberger

Environmental & Global Health Faculty Research

One of the first steps in addressing the problem of childhood lead poisoning is to identify the possible sources of exposure in specific communities and target high-risk populations with appropriate interventions. Due to several factors, such as lack of funding and lack of blood lead reporting, little information exists regarding the occurrence of childhood lead poisoning and the prevalence of potential exposure sources in the state of Nevada. Following the recent establishment of a Nevada-based Lead Poisoning Program, we compiled the most current information available on Nevadans, and use this knowledge to suggest future research objectives and outreach activities for …

Standing Closest To The Flame: Community Wildfire Planning And The Healthy Forest Act, William E. Fleeger Jan 2007

Standing Closest To The Flame: Community Wildfire Planning And The Healthy Forest Act, William E. Fleeger

Doctoral Dissertations

Recently, national fire policy has been redirected from a primary focus on suppression towards a more integrated and comprehensive approach developed at the community level. As part of this policy shift, Congress passed the Healthy Forest Restoration Act (P.L. 108-148) in 2003 encouraging communities to develop community wildfire protection plans (CWPPs) to guide fuel reduction and wildfire mitigation efforts on both federal and nonfederal lands. This research examines U.S. Forest Service (USFS) and community collaboration in the development of CWPPs through a case study analysis of four communities in two western states. The social and decision-making processes used in the …

Resolving The 150 Year Debate Over The Ecological History Of The Common Periwinkle Snail, Littorina Littorea, In Northeast North America, April M H Blakeslee Jan 2007

Resolving The 150 Year Debate Over The Ecological History Of The Common Periwinkle Snail, Littorina Littorea, In Northeast North America, April M H Blakeslee

Doctoral Dissertations

Littorina littorea (common periwinkle snail) is highly abundant in both Europe and North America. A known native of Europe, its presence in North America has been the subject of a one-hundred year debate. Prior published work attempting to resolve its cryptogenic (=uncertain origin) status with historical, archaeological, ecological and/or genetic data were not successful. I therefore included novel parasite and molecular evidence to definitively resolve L. littorea's North American cryptogenic status.

First, I explored trematode species richness patterns in European versus North American L. littorea and two co-occurring native congeners, L. saxatilis and L. obtusata. Through extensive field and literature …

Interactions Between Two Invasive Crab Predators, Carcinus Maenas And Hemigrapsus Sanguineus, And Consequences For The Native Community, Blaine David Griffen Jan 2007

Interactions Between Two Invasive Crab Predators, Carcinus Maenas And Hemigrapsus Sanguineus, And Consequences For The Native Community, Blaine David Griffen

Doctoral Dissertations

With continued globalization, species are being transported and introduced into novel habitats at an accelerating rate. As invasive species become more common, interactions between invasive species will also increase and may alter the way that these species impact invaded communities. The European green crab Carcinus maenas is an aggressive predator that was introduced to the east coast of North America in the mid 1800s and often has detrimental impacts on prey communities. A newer invasive predator, the Asian shore crab Hemigrapsus sanguineus, was first discovered on the Atlantic coast in the 1980s, and now inhabits many of the same regions …

Structural And Functional Pulmonary Imaging Using Hyperpolzarized Xenon-129, Iga Muradyan Jan 2007

Structural And Functional Pulmonary Imaging Using Hyperpolzarized Xenon-129, Iga Muradyan

Doctoral Dissertations

We describe applications of hyperpolarized 129 Xe to pulmonary imaging. Unique characteristics of this gas such as its polarizability and diffusibility in tissue allow probing important properties of the lungs. Three methods that study structure and function of the lungs, Chemical Shift Saturation Recovery (CSSR), Xenon polarization Transfer Contrast (XTC) and Dixon, and their application to human studies for the first time are the focus of this work.

CSSR measures the global fractional gas transport, F(t) in the lungs. Using this method the dynamics of gas exchange were studied. A model describing this process was derived and used to interpret …

Encoding And Decoding Mutual Grooming: Communication With A Specialized Form Of Touch, Holly Nelson Jan 2007

Encoding And Decoding Mutual Grooming: Communication With A Specialized Form Of Touch, Holly Nelson

Doctoral Dissertations

Although primatology research indicates that social grooming has broad social significance for primates, it has not been previously considered as a nonverbal communication channel among humans. Therefore, this research aimed to provide information about its social significance among humans in two ways. Participants completed a questionnaire in which they indicated the incidence of grooming others in several relationship contexts. Second, a different sample participated in an experiment in which they read one of several vignettes and gave their impressions. Impressions were targeted to presumed communicative functions of grooming: courtship/flirtation and attachment/pairbonding. Two variables were manipulated: type of action performed (grooming, …

Revisiting The "Current -Traditional Era": Innovations In Writing Instruction At The University Of New Hampshire, 1940--1949, Katherine E. Tirabassi Jan 2007

Revisiting The "Current -Traditional Era": Innovations In Writing Instruction At The University Of New Hampshire, 1940--1949, Katherine E. Tirabassi

Doctoral Dissertations

Composition histories mainly focus on a study of "official" texts such as composition textbooks and administrative records to elucidate pedagogical and curricular practices in writing instruction. Yet in recent years, more studies have focused on archival research, on what John Brereton calls the "everyday fabric" of writing instruction. My dissertation project explores the "everyday fabric" of writing instruction during the 1940s at the University of New Hampshire (UNH), looking at archival records, 1940s disciplinary debates and pedagogical practices within and beyond the formal curriculum on the national and local levels, and interviews I conducted with UNH alumni about their curricular …

Role Of The Biofilm In Metals Accumulation By Fucoid Algae And Their Surrounding Rock Surfaces, Joan Lydia Beskenis Jan 2007

Role Of The Biofilm In Metals Accumulation By Fucoid Algae And Their Surrounding Rock Surfaces, Joan Lydia Beskenis

Doctoral Dissertations

Both inanimate and animate intertidal surfaces including Fucus and Ascophyllum develop a biofilm that can bind metals contributed by non-point and point sources of pollution. The biofilm also functions as a habitat for the many organisms, i.e. bacteria, diatoms and other algal cells that are part of the biofilm and contribute to the polysaccharide matrix. Examinations of the biofilm were quantified by polysaccharide analysis using a spectrophotometer. Biofilm samples were recovered from both intertidal rock surfaces and the surface of the surrounding fucoid algae to determine if they bind Cu and Zn. Locations in Kittery, Maine differed by the amount …

Material Culture And Domestic Texts: Textiles In The Texts Of Warner, Adams, Wilson, Sadlier, Stoddard, And Phelps, Laura Smith Jan 2007

Material Culture And Domestic Texts: Textiles In The Texts Of Warner, Adams, Wilson, Sadlier, Stoddard, And Phelps, Laura Smith

Doctoral Dissertations

In "Material Culture and Domestic Texts: Textiles in the Texts of Warner, Adams, Wilson, Sadlier, Stoddard, and Phelps," I draw from recently revised notions of the discourse of domesticity to argue that the imagery of textile production, consumption, and containment enables authors to configure experimental domestic forms. Mid-nineteenth-century authors used textiles---including their inherent "textility" and feminine associations---to play out new domestic configurations in response to exigencies of economy, race, intemperance, competitive desire, and labor. Their literature demystifies textiles' ability to invest social hierarchies of race, class, gender, and religion; it also enacts material changes of women's domestic spaces and roles …

Glycoprotein Hormone Receptors In Sea Lamprey (Petromyzon Marinus): Identification, Characterization And Implications For The Evolution Of The Vertebrate Hypothalamic-Pituitary-Gonadal/Thyroid Axes, Mihael Freamat Jan 2007

Glycoprotein Hormone Receptors In Sea Lamprey (Petromyzon Marinus): Identification, Characterization And Implications For The Evolution Of The Vertebrate Hypothalamic-Pituitary-Gonadal/Thyroid Axes, Mihael Freamat

Doctoral Dissertations

The vertebrate hypothalamic-pituitary-gonadal (HPG) and hypothalamic-pituitary-thyroid (HPT) endocrine axes involve specific interaction between pituitary glycoprotein hormones GpH (lutropin LH, follitropin FSH, thyrotropin TSH) and glycoprotein hormone receptors GpH-R (LH-R, FSH-R and TSH-R respectively).

GpHs and GpH-Rs originate in a common ancestral ligand/receptor pair. Their duplications were followed by divergent evolution resulting in the emergence of a novel, pituitary/peripheral gland control level. It is estimated that this occurred more than 500 million years ago (mya), before or concomitant with the divergence of the jawed vertebrates (Gnathostomes) lineage from their jawless (Agnathan) ancestors. This coincides with the estimated time of divergence of …

More Than Simply "Hanging Out": The Nature Of Participant Observation And Research Relationships, Julie Frances Simpson Jan 2007

More Than Simply "Hanging Out": The Nature Of Participant Observation And Research Relationships, Julie Frances Simpson

Doctoral Dissertations

Participant observation is a research activity used in qualitative inquiry, particularly ethnography, where the aim is to understand the meanings and experiences of social actors. Researchers employing this activity take part in people's lives as a way of learning about them and their culture, and to gain understanding of social life processes. Often these activities in the field are referred to as "hanging out": that is, interacting with participants in an uncontrived fashion as they go about their daily lives.

Participation observation is multifaceted: participant observation is conducted within the framework of scientists' own and others' life worlds; participant observers …

Development And Application Of Methods For Analysis Of Fungal Glycosphingolipid Structure And Functional Interactions, Emma Adhiambo Arigi Jan 2007

Development And Application Of Methods For Analysis Of Fungal Glycosphingolipid Structure And Functional Interactions, Emma Adhiambo Arigi

Doctoral Dissertations

Fungal lectins from the mushrooms Polyporus squamosus and Coprinus cinereus have an affinity for beta-galactosides, with extended binding sites for the non-reducing terminal trisaccharide sequence NeuAcalpha2→6Galbeta1→4Glc/GlcNAc, and substituted beta-galactosides resembling mammalian blood group determinants, respectively. In considering the possibility that glycosylinositol phosphorylceramides (GIPCs) could be endogenous ligands of such fungal lectins, structural characterization of glycosphingolipids (GSLs) from the fruiting bodies of these mushrooms was performed. The extraction, isolation and purification of the lipids, and their subsequent characterization by nuclear magnetic resonance (NMR), mass spectrometry (MS) and gas chromatography-mass spectrometry (GC-MS) was performed. One monohexosylceramide (CMH) and three major GIPCs were …

Probing Regioselectivity In The Diels -Alder Cycloadditions Between *[60]Fullerene And Aryl Substituted Acenes, James Eric Rainbolt Jan 2007

Probing Regioselectivity In The Diels -Alder Cycloadditions Between *[60]Fullerene And Aryl Substituted Acenes, James Eric Rainbolt

Doctoral Dissertations

The formation and reactivity of previously unknown 4,7-diphenylisobenzofuran, 5, is reported. The Diels-Alder reaction between 5 and p-benzoquinone in boiling glacial acetic acid yields an unprecedented exo,exo anti dual cycloaddition product, 16b, in excellent yield and with 100% diastereoselectivity. Differences between the reactivity of 5 and the more common 1,3-diphenylisobenzofuran are highlighted. Reactive 5 is utilized to form the anthracene 11, tetracene 15, and pentacene 22. The latter two compounds are reacted with [60]fullerene to explore the potential role of CH/pi interactions in the cycloaddition of [60]fullerene across phenyl substituted acenes. [60]Fullerene shows an unusual propensity for cycloaddition across the …
