The European Community (“EC”) is 50 years old this year, albeit having undergone a change of name and, just to confuse everyone, the articles of the Treaty establishing the European Community (“EC Treaty”) underwent a change in numbering. The persistent question this book raises is who should decide whether and how to mitigate the damages caused by natural disasters. Our understandable preoccupation with response, recovery, and rebuilding makes it hard to focus on this question as a central, even relevant, one. But it persists, nonetheless. The high-profile “blame game” played following Hurricane Katrina’s devastation of the Gulf Coast is emblematic. This Article proposes a three-part approach to improve the food supply. Specifically, it explores government taxing and spending, two traditional public health tools, and suggests that both of these governmental powers can be used to make healthier foods more readily reasonable prices, while increasing the cost of less healthy alternatives. Finally, it proposes that we promote a true “food democracy” through the creation of an education and awareness campaign. This campaign would not only better educate Americans about proper nutrition but would also focus on how we can change our entire relationship with food. It would encourage consumption of locally …

With its abundance of natural resources and due to the state's strong environmental policies, Wisconsin has “enjoyed a reputation as a state rich in natural beauty and recreational opportunities.” Yet, despite the state's strong environmental protections, some based upon constitutional principles, this Article addresses whether Wisconsin's environmental constitutional provisions can be improved upon. This Article attempts to evaluate the existing environmental provisions in the Wisconsin Constitution, and considers, looking at a variety of options and sources, whether the state should proceed forward with any changes, minor or major, to environmental law in the Wisconsin Constitution. Rapeseed (Brassica napus) is a bright yellow flowering member of the family Brassicaceae (mustard or cabbage family). Industrial rapeseed is high in erucic acid or H.E.A.R, with greater than 45 per cent erucic acid, which is mildly toxic to animals especially poultry. Erucic acid at levels beyond 0.605 per cent in diet is known to cause growth depression, reduction in feed intake and efficiency in growing chicks. Natural rapeseed meal also contains glucosinolates (the 'hot' in mustard seeds, when this compound is broken down with water it reacts and provides the heat felt on the tongue, characteristic in all Brassicaceae …

Review Of The 2006 Trademark Decisions Of The Federal Circuit, Christine Haight Farley, Geri L. Haight

The United States Court of Appeals for the Federal Circuit delivered only seven precedential trademark opinions in 2006. The Court addressed a range of substantive issues including trade dress configuration, reverse passing off, and genericism. Notably, two of the seven precedential decisions involved plant names protected by the Plant Variety Protection Act. The Court decided only one case in 2006 where the primary issue was procedural, rather than substantive. In that case, the Court sided with the Trademark Trial and Appeal Board and affirmed its decision on the applicability of the res judicata doctrine. In 2006, as in previous years, …

Color, Cooking Loss And Textural Properties Of Patties As Affected By Catfish Belly Flap Mince Size And Cooking Method, Jin M. Kim, Bartholomew W. Green

Patties were prepared with different sizes of channel catfish belly flap mince. Belly flap meat was minced using four different sizes of openings of plate, mixed with salt, formed, and cooked by two methods, in water and oven. Results indicated no differences (P>0.05) in Kramer shear break force in the patties cooked by different methods for same size of mince. As size of meat particles for patties decreased, increased were hardness and gumminess, and color difference from fillet, but decreased were Kramer shear break force as well as percent cooking loss (p< 0.05). Patties cooked in an oven showed greater color difference from fillet, percent cooking loss, hardness, and gumminess than those cooked in water for the same size of meat particles (p < 0.05).

The Influence Of Oscillating Dietary Protein Concentrations On Finishing Cattle. Ii. Nutrient Retention And Ammonia Emissions, S. L. Archibeque, H. C. Freetly, N. A. Cole, Calvin Ferrell

We hypothesized that oscillation of the dietary CP concentrations would improve efficiency of N use and reduce N loss to the environment. Charolais-cross steers (n = 8; 315 ± 21 kg of BW) were used in a replicated 4 × 4 Latin square design. The steers were allowed ad libitum access to the following diets: 1) 9.1% CP (low), 2) 11.8% CP (medium), 3) 13.9% CP (high), or 4) low and high oscillated on a 48-h interval on each diet (oscillating). Dry matter intake did not differ among treatments (P = 0.46), but N intake differed (P < 0.01) from 94 (low) to 131 (medium), 142 (high), and 133 g/d (oscillating), as designed. Dry matter digestibility increased (P < 0.01) from 71.8% (low) to 75.8% (medium), 77.7% (high), and 77.5% (oscillating). Nitrogen digestibility increased (P < 0.01) from 62.2% (low) to 67.2% (medium) to 70.1% (high) and 70.9% (oscillating). Nitrogen retention was greater (P < 0.01) in steers fed oscillating (55.0 g/d) than in the steers fed low (34.8 g/ d) or high (40.2 g/d), but N retention of steers fed medium (49.8 g/d) differed (P = 0.02) only from that of steers fed low. Urinary urea N did not differ between steers fed medium (19.5 g/d) or oscillating (21.3 g/d) but was lowest (P < 0.01) for those fed low (8.2 g/d) and greatest for those fed high (39.2 g/d). Current soil conservation programs are built upon an established research legacy. Hugh H. Bennett, chief of the USDA Soil Conservation Service from 1935 to 1951, was instrumental in the establishment of a network of 35 soil conservation experiment stations (SCES). Research projects were initiated at the SCES in the 1930s to investigate the principal factors causing erosion and to identify the most effective and practical methods of controlling soil loss from agricultural areas. Information obtained from the SCES, and selected other locations, was assembled at the National Runoff and Soil Loss Data Center (NRSLDC) established on the campus of Purdue …

When these items do not fit a user's conceptual model confusion and inefficiency occur.
