Proximate Cause In Constitutional Torts: Holding Interrogators Liable For Fifth Amendment Violations At Trial, Joel Flaxman
Proximate Cause In Constitutional Torts: Holding Interrogators Liable For Fifth Amendment Violations At Trial, Joel Flaxman
Michigan Law Review
This Note argues for the approach taken by the Sixth Circuit in McKinley: a proper understanding of the Fifth Amendment requires holding that an officer who coerces a confession that is used at trial to convict a defendant in violation of the right against self-incrimination should face liability for the harm of conviction and imprisonment. Part I examines how the Supreme Court and the circuits have applied the concept of common law proximate causation to constitutional torts and argues that lower courts are wrong to blindly adopt common law rules without reference to the constitutional rights at stake. It …

Evangelism On Target: A Proposal To Use Hunting And Fishing As Means To Evangelism And Discipleship, Jackie Andrew Mccullough
Evangelism On Target: A Proposal To Use Hunting And Fishing As Means To Evangelism And Discipleship, Jackie Andrew Mccullough
Doctoral Dissertations and Projects
Reach people where they are. The purpose of this project is to identify, explore, evaluate and recommend practical means of using hunting and fishing as tools of evangelism and discipleship. A review of printed literature reveals little about this subject. Other available information shows effective use of these means for the proposed purposes. The research utilized responses to questionnaires completed by pastors, seminary students, seminary graduates, and outdoor speakers who employ these means. Hunting and fishing are being used effectively for these goals. Practical methods for implementation of these means are explored and presented.

A Strategy For Educating The Church Concerning Those With Special Needs, William Blake Shrout
Doctoral Dissertations and Projects
The purpose of this paper is to inform and educate the church of the needs of people with disabilities. There is information given as to what the church can do to assist and understand the needs of the people, the requirements of the Law and the moral obligations as Christian disciples. Through a questionnaire, the author has compiled statistics for an overall view of what some churches are doing to accommodating these people. This thesis will also give Biblical and theological perspectives as the foundation for the research.
Effects Of Temperature And Illumination On Background Matching In Mediterranean Geckos (Hemidactylus Turcicus), Frederic Zaidan, Pamela L. Wiebusch
Effects Of Temperature And Illumination On Background Matching In Mediterranean Geckos (Hemidactylus Turcicus), Frederic Zaidan, Pamela L. Wiebusch
School of Integrative Biological & Chemical Sciences (Formerly Dept. of Biology)
The ability to change skin color is a relatively common phenomenon in lizards whose occurrence is often related to crypsis. Field observations suggest that Mediterranean geckos (an often ubiquitous introduced species in many metropolitan areas of the southern United States) have the ability to lighten and darken in response to their background. On light backgrounds, the geckos were typically light pink whereas on dark backgrounds they were typically much darker with a brownish hue to their skin. This study investigated the ability to background match in this species, the main effects of temperature (20, 25, and 30[degrees]C), illumination (total darkness …

Fecundity And Survival Of The Calanoid Copepod Acartia Tonsa Fed Isochrysis Galeana (Tahitian Strain) And Chaetoceros Mulleri, Angelos Apeitos
Master's Theses
Historically, red snapper (Lutjanus campechanus) larviculture at the Gulf Coast Research Lab (GCRL) used 25 ppt artificial salt water and mixed, wild zooplankton composed primarily of Acartia tonsa, a calanoid copepod. Acartia tonsa was collected from the estuarine waters of Davis Bayou and bloomed in outdoor tanks from which it was harvested and fed to red snapper larvae. We are developing a more controlled copepod mass culture system to support finfish larviculture. To that end, I examined the effect of single species versus mixed species of algae as food for the copepods. Wild A. tonsa were isolated and reared in …

Cholesterol-Lowering Properties Of Plant Sterols Esterified With Beef Tallow Fatty Acids In Hamsters, David M. Guderian Jr., Heather E. Rasmussen, Curtis A. Wray, Patrick Dussault, Timothy P. Carr
Department of Nutrition and Health Sciences: Faculty Publications
Plant sterol esters (PSE) reduce plasma low-density lipoprotein cholesterol concentration by inhibiting cholesterol absorption. Previous work in our laboratory indicated that PSE containing stearic acid (SA), compared to linoleic acid, were significantly more effective at reducing cholesterol absorption. We tested the cholesterol lowering properties of PSE containing fatty acids from beef tallow, a natural and abundant source of SA. Male hamsters were fed diets containing 0.0%, 0.5%, 1.0%, or 5.0% beef tallow PSE for 4 weeks. Dose-dependent reductions (P < .05) were observed in cholesterol absorption, liver esterified cholesterol, and plasma nonhigh-density lipoprotein cholesterol concentration; hamsters fed 5.0% PSE exhibited reductions of 56%, 98%, and 38%, respectively, compared to controls. Concurrent increases (P < .05) in fecal sterol excretion were also observed. In a second hamster study, the cholesterol-lowering properties of beef tallow PSE were compared to hamsters fed molar equivalents of free plant sterols (PS) and free SA. Beef tallow PSE were significantly more effective at reducing liver and plasma cholesterol concentrations than PS and SA consumed individually. Whether PS and SA act through independent or synergistic mechanisms will require further research, although the present findings support the use of dietary PSE containing beef tallow fatty acids in the management of hypercholesterolemia.

The cytosolic acyl-CoA thioesterase I (Acot1) is an enzyme that hydrolyzes longchain acyl-CoAs of C12-C20-CoA in chain-length, to the free fatty acid and coenzyme A. Acot1 was previously shown to be strongly upregulated at mRNA and protein level in rodents by fibrates. In this study, we show that Acot1 mRNA levels were increased 90-fold in liver by treatment with Wy-14,643 and that Acot1 mRNA is also increased 15-fold in the liver of hepatocyte nuclear factor 4 alpha (HNF4a) knockout animals. Our study identified a direct repeat 1 (DR1) located in the Acot1 gene promotor in mouse, which binds the peroxisome …

Law Firms, Ethics, And Equity Capital: A Conversation, Georgetown University Law Center, The Center For The Study Of The Legal Profession
CSLP Papers & Reports
The correspondence collected here represents an effort to start a conversation. Pending legislation in the United Kingdom, based on what is known as the Clementi Report, would permit non-lawyer equity investment in law firms, subject to regulatory oversight. In other words, UK law firms could become publicly-traded businesses. This legislation has been proposed as part of reforms heralded as improving the delivery of legal services to consumers. By contrast, such investment in law firms is forbidden by ethical rules in the United States. What will happen when the two countries with the most dominant global law firms begin to move …
Pour Forth The Sparkling Chalice: An Examination Of Libation Practices In The Levant, Amy M. Fisher
Pour Forth The Sparkling Chalice: An Examination Of Libation Practices In The Levant, Amy M. Fisher
Classical Mediterranean and Middle East Honors Projects
Across the Levant “libation installations” have been identified at numerous ancient archaeological sites. This paper examines these claims in light of both the surrounding material remains and the surviving texts of the region that mention libations of wine and water. It shows that libation, the ritual pouring out of a liquid offering to a god, in ancient Syria-Palestine did not require a receptacle for successful completion of the act. Rather, the category “libation installation” exists not because of solid evidence but to fulfill the needs of modern scholars and any such claim must be carefully scrutinized before being accepted.

Meso- And Bathypelagic Fish Interactions With Seamounts And Mid-Ocean Ridges, Tracey Sutton, Filipe M. Porteiro, John K. Horne, Cairistiona I. H. Anderson
Marine & Environmental Sciences Faculty Proceedings, Presentations, Speeches, Lectures
The World Ocean's midwaters contain the vast majority of Earth's vertebrates in the form of mesoand bathypelagic ('deep-pelagic,' in the combined sense) fishes. Understanding the ecology and variability of deep-pelagic ecosystems has increased substantially in the past few decades due to advances in sampling/observation technology. Researchers have discovered that the deep sea hosts a complex assemblage of organisms adapted to a “harsh” environment by terrestrial standards (i.e., dark, cold, high pressure). We have learned that despite the lack of physical barriers, the deep-sea realm is not a homogeneous ecosystem, but is spatially and temporally variable on multiple scales. While there …

Suburban Coyote Management And Research Needs: A Northeast Perspective, Paul D. Curtis, Daniel A. Bogan, Gordon Batcheller
Wildlife Damage Management Conference Proceedings
Several factors may be responsible for increasing predator abundance in suburbia. These include an enhanced forage base associated with residential sprawl, and protection of predator species that were once persecuted and suppressed by hunters, trappers, and landowners. In the Northeast, anecdotal reports of coyotes (Canis latrans) killing pets in backyards are on the rise. The bulk of coyote complaints, concerns, and questions received from the public by state wildlife agencies are from areas with high human populations. Scant research exists on coyote behavioral ecology in human-altered landscapes. Biologists and managers need to understand changes in the social structure …

Adjustment factors to allow comparison of EPD from several breed associations for birth, weaning, and yearling weights have been available for more than 10 yr. This paper describes steps to calculate adjustment factors for EPD for 4 carcass traits: marbling score, fat thickness, ribeye area, and retail product percentage. The required information is the same as for the weight traits: 1) breed of sire solutions based on measurements on progeny at the US Meat Animal Research Center (USMARC) that have sires with breed association EPD, 2) mean EPD of sires weighted by number of progeny at USMARC (USMARC progeny not …

Knowledge Management At The Village Level: How Thai Rice Farmers Incorporate Technologies To Improve Production Systems, Jude William R. Genilo
Knowledge Management At The Village Level: How Thai Rice Farmers Incorporate Technologies To Improve Production Systems, Jude William R. Genilo
The South East Asian Journal of Management
The shift from agricultural to industrial and from industrial to knowledge societies has affected the ways farmers run their small-scale field activitiesin Central Thailand. To remain competitive, rice farmers need to continuously incorporate innovations and upgrade their technologies to sustain operations. These innovations and technologies may be seen in practically all aspects of the rice production process – from seed selection to fertilization, from seed raising and growth to irrigation, from crop protection to harvesting, threshing and drying. The study basically aims to explore the plausibility of rice farming villages as “learning organizations” and within these villages, the viability of …

Resisting Agricultural Assimilation: The Political Ecology Of Hmong Growers In The Twin Cities Metropolitan Region, Laura M. Kerr
Resisting Agricultural Assimilation: The Political Ecology Of Hmong Growers In The Twin Cities Metropolitan Region, Laura M. Kerr
Geography Honors Projects
Over one and a half million Hmong refugees have arrived in the United States since the end of the “Secret War” in 1974. The Saint Paul and Minneapolis metropolitan area is home to the largest urban population of Hmong immigrants in the United States. A significant number of Hmong refugees living in the Twin Cities metropolitan area have chosen farming as both a primary and supplemental source of income. While living in the metro area many Hmong rent land in peri-urban areas to farm and subsequently sell at local markets. Employing a cultural and political ecology framework, this research critically …

Selenoproteins are an elite group of proteins containing a rare amino acid, selenocysteine (Sec), encoded by the codon, UGA. In eukaryotes, incorporation of Sec requires a Sec insertion sequence (SECIS) element, a stem–loop structure located in the 3'-untranslated regions of selenoprotein mRNAs. Here we report identification of a noncanonical form of SECIS element in Toxoplasma gondii and Neospora canine, single-celled apicomplexan parasites of humans and domestic animals. This SECIS has a GGGA sequence in the SBP2-binding site in place of AUGA previously considered invariant. Using a combination of computational and molecular techniques, we show that Toxoplasma and Neospora possess …
Behavioral And Neuropharmacological Characterization Of Nicotine As A Conditional Stimulus, Jennifer E. Murray, Rick A. Bevins
Behavioral And Neuropharmacological Characterization Of Nicotine As A Conditional Stimulus, Jennifer E. Murray, Rick A. Bevins
Department of Psychology: Faculty Publications
In rats, the pharmacological (interoceptive) effects of 0.4 mg/kg nicotine can serve as a conditional stimulus in a Pavlovian conditioning task. Nicotine administration is paired with intermittent access to a liquid sucrose unconditional stimulus; sucrose is withheld on saline sessions. An increase in sucrose receptacle entries (goal tracking) on nicotine sessions indicates conditioning. Rats were trained on a nicotine dose ((-)-1-Methyl-2-(3-pyridyl)pyrrolidine; 0.1, 0.2, or 0.4 mg base/kg, s.c.). Generalization was examined using 0.025, 0.05, 0.1, 0.2, and 0.4 mg/kg nicotine and saline. Some behavioral effects of nicotine have been attributed to dopamine and glutamate. Accordingly, potential blockade of the nicotine …

Acute epibulbar infections in humans are one of the most frequently diagnosed eye diseases. The majority of these are thought to be caused by the adenovirus. This review focuses on the features of the human adenovirus eye diseases, mode of transmission, signs and symptoms, available interventions, and preventive measures. It is concluded that infection control is still widely accepted to be the key to the management of human adenovirus infection in order to prevent the spread, individual suffering and economic damage.
