Medical Product Information Incentives And The Transparency Paradox, Daniel R. Cahoy
Medical Product Information Incentives And The Transparency Paradox, Daniel R. Cahoy
Indiana Law Journal
Recent allegations that essential safety and efficacy information is often suppressed by medical product manufacturers or poorly evaluated by regulators have led to calls for greater information transparency. The public is justifiably concerned that its ability to conduct an informed risk-benefit assessment of drugs and medical devices is compromised. Several changes have already been made to federal regulatory law and medical research policy to mandate greater disclosure and more changes are being considered. However, it is possible that these measures may backfire by enhancing significant tort-based economic disincentives for generating new information.I n other words, greater disclosure requirements could, paradoxically, …
Civil Society Constitutionalism: The Power Of Contract Law, Marc Amstutz, Adreas Abegg, Vaios Karavas
Civil Society Constitutionalism: The Power Of Contract Law, Marc Amstutz, Adreas Abegg, Vaios Karavas
Indiana Journal of Global Legal Studies
This article argues that the vision of a social law of contract is exhibited in the judgment of the Swiss Federal Court in Post v. Verein gegen Tierfabriken ("VgT"). The judgment is one of a law of contract that interacts with a community of the subjects instead of the individual subjects of a community. This paper contends that law today has the task of providing for the areas of social autonomy from which "civil society" is built up and in which, at the same time, the increasing social fragmentation can be overcome piecemeal. The article argues that conceiving contract law …

When asked to think about a foreign country the first thing that comes to my mind is the language barrier and the customs that accompany that specific country. The culture of the citizens and how it differs from my culture are also things which peak my interest. Things which I view as “normal” may seem very odd to someone who lives thousands of miles away, and likewise, traditions that have been past down from generations of people from distant lands may seem peculiar to me. These customs and cultures of which I speak are also the things that make this …

Tracking ‘Organic’ Agricultural Research In The United States, 1970-1989: What Federal Legislative And Selected Usda-Sponsored Documents Reveal, Leslie M. Delserone, Charles D. Bernholz
University of Nebraska-Lincoln Libraries: Faculty Publications
This paper enumerates federal government documentation of the period 1970-1989 pertaining to organic agriculture in the United States, identified in the Congressional Information Service’s Cumulative Indices and in bibliographies published by the United States National Agricultural Library. These Congressional hearings, federal legislation, and selected U. S. Department of Agriculture (USDA)-sponsored documents provide an historical context for the 1990 legislation that created the National Organic Program (NOP) and the National Organic Standards Board (NOSB). The paper provides chronological tabulations of the historical documents, and discusses the communication difficulties and relationships revealed therein between the Congress, the USDA, and organic producers of …

Personhood, The Soul And Non-Conscious Human Beings: Some Critical Reflections On Recent Forms Of Argumentation Within The Pro-Life Movement, Peter J. Colosi
Faculty and Staff - Articles & Papers
This paper has grown out of concerns that I have about the way in which some pro-life arguments have been developing recently, and it is written in a spirit of frank dialogue with those whom I consider allies. I present three basic problems within some prominent contemporary pro-life argumentation, all three of which are rooted in a general tendency towards relying on empirical science in an increasingly exclusive way as the foundation of those arguments. The three problems that I touch on are: a neglect of the role of God in human procreation, a neglect of the dignity of women, …

The GLOBE Comparing Surface and Subterranean Environments Field Guide provides an interdisciplinary framework for exploring the physical, chemical, and biological connections between surface environments and the subterranean systems beneath them. Designed for field-based education and undergraduate instruction, the guide supports direct observation, data collection, and comparative analysis across environments such as soils, karst landscapes, caves, groundwater systems, and surface waters using existing GLOBE protocols.
Through structured activities and guiding questions, the field guide emphasizes how water, energy, and nutrients move between surface and subsurface systems, shaping geological features, ecosystem processes, and environmental conditions. By integrating concepts from Earth science, hydrology, …

The focus of this panel is incrementally shifting from the previous panel. Whereas the previous was looking at public/private issues and issues relating to incentivizing innovation in the subject countries, we're going to take a focus more on, I think it's safe to say, from an external perspective looking at these countries and issues that are confronted by businesses who our either planning to deal with the four subject countries or are concerned about their technologies being used in their four subject countries.
We have four panelists, and each of them is going to speak to one of the four …

Trademarks And The Internet: The United States' Experience, Glynn S. Lunney Jr

This article is divided into three sections: (II) The past; (III) The Present; and (IV) The Future. Part II will focus on the early judicial decisions applying trademark law to the Internet. It will examine the Internet's frontier period, discuss some of the early cases and their fact patterns, and attempt to show how the courts re-wrote various doctrinal elements of trademark law so they could reach the bad actors before them. While this period is characterized more by the predominantly bad faith nature of the defendants than by a calendar, it runs for approximately five years, from the first …

Information Consensus And Its Application In Multi-Vehicle Cooperative Control, Ella Atkins, Randal Beard, Wei Ren
Faculty Publications
In the last two decades, advances in networking and distributed computing have facilitated a paradigm shift from large, monolithic mainframe computers to networks of less expensive, less powerful workstations. One motivation for multi-vehicle systems is to achieve the same gains for mechanically controlled systems as has been gained in distributed computation. Rather than having a single monolithic (and therefore expensive and complicated) machine do everything, the hope is that many inexpensive, simple machines, can achieve the same, or enhanced functionality, through coordination. In essence, the objective is to replace expensive complicated hardware with software and multiple copies of simple hardware. …

Dinner In The City: Reclaiming The Female Half Of History: Christine De Pisan's The Book Of The City Of Ladies And Judy Chicago's The Dinner Party, Marsha M. Pippenger
Master of Humanities Capstone Projects
Although separated by more than 500 years, Christine de Pisan's "The Book of the City of Ladies" (1405) and Judy Chicago's "The Dinner Party" (1979) were created to validate and defend women and women's achievements and to move them from the periphery of the historical canon to the center, alongside accomplished men of history. Both are responses to misogynist beliefs and texts of their times. In this essay I present the historical basis of misogyny as well as events that led the two women to create their pieces. I illuminate the parallels between "The Book of the City of Ladies" …
Present Effects Of Past Wildfires On The Diets Of Stream Fish, Peter Koetsier, Quenton Tuckett, Joshua White
Present Effects Of Past Wildfires On The Diets Of Stream Fish, Peter Koetsier, Quenton Tuckett, Joshua White
Biology Faculty Publications and Presentations
We investigated present indirect effects from a decade-old burn on the diets of stream fish. Based on soil instability and burn patterns from a 12–14-year-old wildfire complex, we separated 9 streams into 3 conditions: unburned, burned, and burned/scoured (i.e., experiencing a massive scour event 1 year post-burn). In the streams, we measured light levels and water temperatures, and we estimated fish density and biomass. We removed the digestive tracts from 9–15 rainbow trout (Oncorhynchus mykiss) from each stream and used a gravimetric procedure to analyze gut contents. Canopy cover development may dictate the composition of dietary items. Greater …

Parallel Facilitatory Reflex Pathways From The Foot And Hip To Flexors And Extensors In The Injured Human Spinal Cord, Maria Knikou, Elizabeth Kay, Brian D. Schmit
Biomedical Engineering Faculty Research and Publications
Spinal integration of sensory signals associated with hip position, muscle loading, and cutaneous sensation of the foot contributes to movement regulation. The exact interactive effects of these sensory signals under controlled dynamic conditions are unknown. The purpose of the present study was to establish the effects of combined plantar cutaneous afferent excitation and hip movement on the Hoffmann (H) and flexion reflexes in people with a spinal cord injury (SCI). The flexion and H-reflexes were elicited through stimulation of the right sural (at non-nociceptive levels) and posterior tibial nerves respectively. Reflex responses were recorded from the ipsilateral tibialis anterior (TA) …
Physiological Notch Signaling Promotes Gliogenesis In The Developing Peripheral And Central Nervous Systems, Merritt Taylor, Kelly Yeager, Sean J. Morrison
Physiological Notch Signaling Promotes Gliogenesis In The Developing Peripheral And Central Nervous Systems, Merritt Taylor, Kelly Yeager, Sean J. Morrison
Peer Reviewed Articles
Constitutive activation of the Notch pathway can promote gliogenesis by peripheral (PNS) and central (CNS) nervous system progenitors. This raises the question of whether physiological Notch signaling regulates gliogenesis in vivo. To test this, we conditionally deleted Rbpsuh (Rbpj) from mouse PNS or CNS progenitors using Wnt1-Cre or Nestin-Cre. Rbpsuh encodes a DNAbinding protein (RBP/J) that is required for canonical signaling by all Notch receptors. In most regions of the developing PNS and spinal cord, Rbpsuh deletion caused only mild defects in neurogenesis, but severe defects in gliogenesis. These resulted from defects in glial specification or differentiation, …

How William F. Cody Helped Save The Buffalo Without Really Trying, David Nesheim
How William F. Cody Helped Save The Buffalo Without Really Trying, David Nesheim
Department of History: Dissertations, Theses, and Student Research
Many historical accounts of the restoration of the American bison omit an important piece of that phenomenon. Most historians have focused their attention on two elements: western ranchers who started the earliest private herds and eastern conservationists who raised funds and lobbied for the creation of the first national preserves. However, the perpetuation of the image of buffalo in the hearts and minds of Americans was equally important in the eventual recovery of the species. No one was a more effective popularizer than William F. Cody, despite his belief that bison neither could nor would recover. Buffalo Bill's Wild West …

MicroRNAs (miRNAs) are powerful regulators of gene expression. Although first discovered in worm larvae, miRNAs play fundamental biological roles-including in humans-well beyond development. MiRNAs participate in the regulation of metabolism (including lipid metabolism) for all animal species studied. A review of the fascinating and fast-growing literature on miRNA regulation of metabolism can be parsed into three main categories: (1) adipocyte biochemistry and cell fate determination; (2) regulation of metabolic biochemistry in invertebrates; and (3) regulation of metabolic biochemistry in mammals. Most research into the 'function' of a given miRNA in metabolic pathways has concentrated on a given miRNA acting upon …
