Reviving The Right To Vote, Ellen D. Katz

Losers in partisan districting battles have long challenged the resulting districting plans under seemingly unrelated legal doctrines. They have filed lawsuits alleging malapportionment, racial gerrymandering, and racial vote dilution, and they periodically prevail. Many election law scholars worry about these lawsuits, claiming that they needlessly "racialize" fundamentally political disputes, distort important legal doctrines designed for other purposes, and provide an inadequate remedy for a fundamentally distinct electoral problem. I am not convinced. This Article argues that the application of distinct doctrines to invalidate or diminish what are indisputably partisan gerrymanders is not necessarily problematic, and that the practice may well …

In 2005, the U.S. Supreme Court in Roper v. Simmons (125 S. Ct. 1183) banned executions of persons who commit capital murder before they reach age 18. Roper overturned death sentences for 72 people in 18 states (Streib, 2005). Most (but not all) were resentenced to natural life or life in prison without the possibility of parole (or JLWOP). Juvenile justice advocates now want to extend Roper’s maturity heuristic, proportionality analysis, aversion to errors, and deference to international laws and norms to argue for a constitutional ban on natural life sentences for adolescent offenders. This thesis looks at nuclear films, commercial and governmental, that were released between 1951 and 1964. Special attention is paid to the recursivity that existed between the propagandic, often outrageously inaccurate Civil Defense films made by the United States government and the subversive popular films made by visionary dissidents.

The films are divided into three periods. The earliest period focuses on Samuel Fuller's Pickup on South Street and the Robert Aldrich 's Kiss Me Deadly (based on the novel by Mickey Spillane), along with some of the earliest Civil Defense films. Holocaust On Your Plate: The Role Of Peta Extremism In The Animal Rights Movement, Christine Miller

This essay explores the ideological motivations behind PETA's 2003 vegetarian billboard campaign "Holocaust on Your Plate." The campaign's argument is dissected into a theoretical framework built on controversy, moral shock, confrontation, and oppositional argument. The more abstract cultural choices behind PETA's Holocaust billboards are further understood through rhetorical analysis, particularly focusing on visual messages of audience segregation (choosing sides), the transfer of guilt, and equal suffering between animals and humans. This essay concludes that PETA was successful in its aim to create new dialogue on the issue of animal rights with regard to the food industry.

The Cup Heard Round The World: A Burkean Analysis Of The Nba's Reaction To The Brawl At Auburn Hills, Katherine L. Lavelle

The November 19, 2004 brawl in Detroit provided vivid evidence of the National Basketball Association's (NBA) damaged image. The league embraces hip-hop culture to attract young fans, however, it ignores the violent aspects of urban life often associated with hip-hop. NBA Commissioner David Stern blamed the melee on Ron Artest. Artest had a troubled history, but he was not solely responsible for this incident. This paper uses Kenneth Burke's Terms of Order to show how scapegoating Artest highlighted a conflict in the NBA among its older fans and the younger fans and players who identify with hip-hop culture.

Police officers are often recognized as tough action figures whose only job is to fight ruthless criminals. A highly rated TV show called "Cops" presents police officers as such figures. Police officers drive noticeable squad cars with top lights and a printed motto reading "to protect and serve." They are well known for their work equipment, such as: night sticks, pepper sprays, armor, handcuffs, and most noticeably, guns. The United States gift tax is truly a unique tax insofar as it generates virtually no revenue. For 2005, the last year for which there is available data, the gift tax raised approximately $2 billion - considerably less than 0.1 percent of the overall revenue collected by the federal government for the same year and in stark contrast to the $1.1 trillion that the income tax alone raised for the same tax year. This 2005 collection figure, moreover, is not an aberration. Historically, the gift tax has raised very little revenue, and projections indicate that this trend is likely to …

Body size is perhaps the most fundamental property of an organism and is related to many biological traits, including abundance. The relationship between abundance and body size has received much attention, both to quantify the form of the relationship and to understand the processes that generate it. However, progress is impeded by the underappreciated fact that there are four distinct, but inter-related, relationships between size and abundance that are often confused in the literature. Here, we review and distinguish between these four patterns, and discuss the linkages between them. We argue that a synthetic understanding of size and abundance relationships …

The degree to which a species is predictably encountered within its range varies 36 tremendously across species. Understanding why some species occur less frequently within their 37 range than others has important consequences for conservation and for range map based analyses 38 of ecological patterns. Discerning the processes influencing geographic patterns of species richness remains one of the central goals of modern ecology. Traditional approaches to exploring these patterns have focused on environmental and ecological correlates of observed species richness. Recently, some have suggested these approaches suffered from the lack of an appropriate null model that accounts for species’ ranges being constrained to occur within a bounded domain. Proponents of these null geometric constraint models (GCMs), and the mid-domain effect these models produce, argue their utility in identifying meaningful gradients in species richness. "Ethanol and ionizing radiation exposure are independently known to cause tissue damage through various mechanisms. Non-enzymatic and enzymatic metabolism of ethanol, the latter via the cytochrome P₄₅₀2E1-dependent pathway, produces free radicals which deplete cellular glutathione (GSH). Ionizing radiation exposure has been shown to induce lipid peroxidation, DNA damage, protein oxidation, and GSH depletion, as well. It was postulated that initial exposure to ethanol, followed by ionizing radiation, would result in heightened oxidative stress. The in vitro model used in this investigation was HepG2 cells (human hepatocellular liver carcinoma cell line), while the in vivo model was Cd-1 mice"--Abstract, page iii.

A microarray study was performed which identified G2E3 as a novel, putative ubiquitin ligase that was both G2/M-specific in expression and down regulated at the transcriptional level following DNA damage by γ-irradiation. The initial characterization of this protein is described herein. G2E3 is composed of three PHD/RING (plant homoedomain/really interesting new gene) domains within its amino-terminal half and a carboxy-terminal HECT (homologous to E6AP carboxy-terminus) domain. G2E3 is regulated in part by its subcellular localization. The protein normally resides within the nucleoplasm of cultured cells and distinctly within the nucleolus of HeLa cells. Glioblastoma multiforme (GBM) is the most common form of cancer in the central nervous system in adults. Because of the infiltrative and aggressive nature of GBM, current treatments including surgical resection, radiation and chemotherapy provide little benefit to patients diagnosed with this tumor. Median survival, after treatment, is less than one year. Despite advances in the basic understanding of cancer biology, this poor prognosis has remained virtually unchanged for several decades. Given the continuing difficulty of clinical treatment of GBMs, a molecular appreciation of relevant signaling pathways has grown.
