The Diatom Flora Of Phosphorus-Enriched And Unenriched Sites In An Everglades Marsh, Jennifer E. Slate, R Jan Stevenson
The Diatom Flora Of Phosphorus-Enriched And Unenriched Sites In An Everglades Marsh, Jennifer E. Slate, R Jan Stevenson
Biology Faculty Publications
Diatoms are used as environmental indicators in the Florida Everglades, a large subtropical wetland highly impacted by phosphorus pollution. However, the taxonomy of the diatom flora, a mix of temperate and tropical diatoms, is understudied. Therefore, we analyzed the taxonomy of 71 diatom taxa collected in Water Conservation Area 2A (WCA-2A). Diatoms were analyzed from sediment cores and from floating algal mats collected in phosphorus-enriched northern WCA-2A and in relatively unenriched southern WCA-2A. In addition, diatoms were analyzed from experimental mesocosms in southern WCA- 2A dosed with 0-126 µgL-1 P-PO4. Total phosphorus optima were calculated for dominant …
White Challengers, Black Majorities: Reconciling Competition In Majority-Minority Districts With The Promise Of The Voting Rights Act, Janai S. Nelson
White Challengers, Black Majorities: Reconciling Competition In Majority-Minority Districts With The Promise Of The Voting Rights Act, Janai S. Nelson
Faculty Publications
Majority-minority districts have been the subject of extensive, and often rancorous, critique and debate. In their prime, these districts nearly single-handedly changed the face of American politics by enabling racial minorities to elect their preferred candidates who reflected both their interests and identity. However, precisely at the point when these districts achieve an optimal balance of majority and minority populations and host multi-candidate competition, they reveal a frailty that not only thwarts their immediate purpose but contradicts both the express and implicit goals of their source: The Voting Rights Act of 1965. Majority-minority districts possess an inherent limitation that contradicts …

The Nuremberg Roles Of Justice Robert H. Jackson, John Q. Barrett
The Nuremberg Roles Of Justice Robert H. Jackson, John Q. Barrett
Faculty Publications
This lecture covers the background of Robert H. Jackson and the story of "Nuremberg," which is Jackson's Nuremberg. The program of this Nuremberg conference states that Prof. Barrett will speak about "The Crucial Role of Robert H. Jackson." In fact, there were multiple Jackson roles at Nuremberg—many, many roles and moments were encompassed in the undertaking that has come to be so significant historically that the primary, global meaning of the word "Nuremberg" today is, and probably always will be, the 1945-46 international trial of the principal surviving Nazi criminals. Justice Jackson's Nuremberg was over 15 months of full time …
Post-Traumatic Stress Disorder (Ptsd) In Children Following Acute Injuries Requiring Emergency Medical Care, Virginia Depp Cline
Post-Traumatic Stress Disorder (Ptsd) In Children Following Acute Injuries Requiring Emergency Medical Care, Virginia Depp Cline
University of Kentucky Doctoral Dissertations
Unfortunately, one rite of passage of childhood is often serious injury that carries psychological impact along with the obvious physical repercussions. Prior studies have found conflicting results for protective/risk factors, thus this study attempted to explore PTSD in a sample of children ages seven to thirteen years of age with moderate to severe injuries. In this study (N = 32), 31.3% of children experiencing such a sudden injury requiring hospitalization at the University of Kentucky Childrens Hospital demonstrated significant indications of post-traumatic stress disorder (PTSD) following the injury. Several pre, peri, and post-trauma variables from during the childs hospitalization to …
Institutional Review Boards, Regulatory Incentives, And Some Modest Proposals For Reform, Dale Carpenter
Institutional Review Boards, Regulatory Incentives, And Some Modest Proposals For Reform, Dale Carpenter
Faculty Journal Articles and Book Chapters
It is time to rethink the role of Institutional Review Boards (IRBs) in approving social science research. While most law professors conduct their research in an almost unregulated environment - pouring through cases, statutes, and each other's articles, all without the kind of human interaction subject to IRB regulation - their colleagues elsewhere in the university have been coping for decades with an increasingly intrusive bureaucracy that sometimes undermines basic academic values. Three things seem very clear. First, there are a lot of IRBs - at least 4,000 - and their numbers are growing. Second, they have recently "increased their …

A Redefined Feminine From Paleolithic To Twenty-First Century Through Children's Literature & Film, Pamela Dee Mccombs
A Redefined Feminine From Paleolithic To Twenty-First Century Through Children's Literature & Film, Pamela Dee Mccombs
Master's Theses and Doctoral Dissertations
The intention of my critical discourse is to redefine the knowledge of the feminine that Western tradition, through “master narratives,” silenced, subverted, and deferred. My guidelines were drawn from the deconstruction of philosophical works by Jacques Derrida and redefined the unique circle of “Being and beings” to be not just God and man, but God, Goddess, and Human, the Goddess being the original feminine. I discovered the feminine beginning, through archaeomythologists Gimbutas, Dever, and Davis-Kimball, with the unearthing of female figurines, temple models, and warrior priestesses. I found examples of the feminine survival through the Dark Ages in Lithuanian Dainos …

Characterization Of A Black Coating Overlying Rock Paintings Found In Little Lost River Cave, Idaho Using Thm-Gc-Ms, Jamie Brown-Sinha
Master's Theses and Doctoral Dissertations
A black coating overlies rock paintings found within Little Lost Rive Cave, Idaho. A calibrated radiocarbon date of 1390-1040 B.C. was obtained by Steelman et al.1 However, this relies on the assumption that the black coating was formed by some human activity. For further characterization and to verify that the coating is anthropogenic, THM-GC-MS was performed on various samples collected throughout the cave, including soil samples from inside, outside, and above the cave. Humic and fulvic acids, synthetic and natural melanin, and experimentally created cooking residues were also analyzed as standard materials. By comparing the resulting chromatograms and the compounds …
International Human Rights And Comparative Mental Disability Law: The Universal Factors, Michael L. Perlin
International Human Rights And Comparative Mental Disability Law: The Universal Factors, Michael L. Perlin
Articles & Chapters
An examination of comparative mental disability law reveals that there are at least five dominant, universal, core factors that must be considered carefully in any evaluation of the key question of whether international human rights standards have been violated. Each of these five factors is a reflection of the shame that the worldwide state of mental disability law brings to all of us who work in this field. Each is tainted by the pervasive corruption of sanism that permeates all of mental disability law. Each reflects a blinding pretextuality that contaminates legal practice in this area.
These are the factors …

The (Futile) Search For A Common Law Right Of Confrontation: Beyond Brasier's Irrelevance To (Perhaps) Relevant American Cases, Randolph N. Jonakait
Articles & Chapters
After Crawford v. Washington asserted that the Confrontation Clause constitutionalized the common law right of confrontation, cases have been suggested that illustrate that right. This short essay considers whether the 1779 English case Rex v. Brasier is such a decision, as some contend. The essay concludes that Brasier says nothing about the right of confrontation and points to a comparable framing-era, American case that indicates that general rules about hearsay and confrontation were not at issue. The essay maintains that if the historical understandings of the right of confrontation and hearsay are to control the Confrontation Clause, then framing-era, American …

The Effects Of Harvesting And Hauling On The Blood Physiology And Fillet Quality Of Market-Size Channel Catfish, C. Douglas Minchew, Rachael V. Beecham, Philip R. Pearson, Bartholomew W. Green, Jin M. Kim, Susan B. Bailey
United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications
Commercially produced, food-size channel catfish Ictalurus punctatus that were harvested using routine procedures had significant elevations in plasma cortisol, glucose, and lactate compared with preharvest fish captured from open ponds. Blood samples were taken from 10 fish in each of two treatments (liquid oxygen diffuser- and paddlewheel-aerated holding socks) and four sampling periods (before harvest, after socking, before loading, and before unloading) during each of 10 harvest events. Water column temperatures averaged approximately 278 C during the study. Ten fillet samples were taken from fish held overnight in paddlewheel- and liquid oxygen-aerated holding socks during some harvest events. Mean plasma …

Militating Democracy: Comparative Constitutional Perspectives, Ruti Teitel
Militating Democracy: Comparative Constitutional Perspectives, Ruti Teitel
Articles & Chapters
Can constitutional review by judges save democracy? This Article identifies and discusses the rise of militant constitutional democracy by exploring diverse approaches to the role of constitutional and transnational judicial review in rights protection and the challenges that these approaches present to the workings of democracy, the possibilities of compromise, consensus, and conciliation in political life, and the challenge to other constitutional values as well. Militant constitutional democracy ought to be understood as belonging to transitional constitutionalism, associated with periods of political transformation that often demand closer judicial vigilance in the presence of fledgling and often fragile democratic institutions; it …

The Rhetoric Of Picasso, Matthew R. Sharp
The Rhetoric Of Picasso, Matthew R. Sharp
Theses and Dissertations
Pablo Picasso was arguably the most famous and controversial artist of the twentieth century, and some of his most famous pieces were created during the Spanish Civil War (1936-1939) in response to the horrible atrocities taking place in his homeland. "The Rhetoric of Picasso" by Matthew R. Sharp, filed December 2007, examines some of these works—including paintings such as Guernica and Weeping Woman —and theorizes their rhetorical force, using speech act theory as the theoretical lens. Based on common images and themes in Picasso's symbolism, it is determined that Picasso's works during the Spanish Civil War are expressive speech acts …

Life Without Water : Expression Of Plant Lea Genes By An Anhydrobiotic Arthropod., Steven Hand, Dana Jones, Michael Menze, Trudy Witt
Faculty and Staff Scholarship
Anhydrobiotic animals protect cellular architecture and metabolic machinery in the dry state, yet the molecular repertoire supporting this profound dehydration tolerance is not fully understood. For the desiccation-tolerant crustacean, Artemia franciscana, we report differential expression of two distinct mRNAs encoding for proteins that share sequence similarities and structural features with late-embryogenesis abundant (LEA) proteins originally discovered in plants. Bioinformatic analyses support assignment of the LEA proteins from A. franciscana to group 3. This eucoelomate species is the most highly evolved animal for which LEA gene expression has been reported. It is becoming clear that an ensemble of micromolecules and macromolecules …
Terrorizing Bodies, Chris Gutierrez
Terrorizing Bodies, Chris Gutierrez
Reconstruction: Studies in Contemporary Culture
Beginning with one single body painted by Gustave Courbet in 1866 and one temple destroyed on September 11th, this paper moves to consider the far reaching impact that the War on Terror has on the entire social body. By paying attention to the unknowable status of both the events and the perpetrators of terrorism, it will be argued that the overwhelming ambiguity of terrorism and counter-terrorist activity has allowed the War on Terror to return to prior discourses of racism and homophobia to mark the corporeal otherness it hopes to confront. Here, images from Abu Ghraib prison, joke pictures forwarded …

In recent years, multimedia has become a commonly used tool for presenting contents to the users. The employment of multimedia is no longer limited to only the entertainment industry, but spans in other areas as well. In academics, lectures are recorded to audio and video for storage and distribution to students. Free online multimedia hosting services are popularly cherished, such as “youtube.com” and “yahoo video”, and with the increasing affordability of digital camera, hundreds, or maybe thousands, of home-made videos and music audio are created daily and published online. Low-cost digital recorders such as webcams also help promote the use …

Long Term Monitoring Of A Deep-Water Coral Reef: Effects Of Bottom Trawling., John K. Reed, Christopher C. Koenig, Andrew N. Shepard, R. G. Gilmore
Faculty Scholarship
The deep-water Oculina coral reef ecosystem is unique and exists solely off the east coast of central Florida. Oculina varicosa forms azooxanthellate colonies up to 2 m in diameter which coalesce into dense thickets on 20-m tall mounds that are thousands of years old. Recently restored videotapes that were made in the 1970s with the Johnson-Sea-Link submersibles show large breeding aggregations of grouper associated with the coral habitat. Historical photographic surveys provide evidence of the status and health of the reefs prior to heavy fishing and trawling activities of the 1980s and 1990s. Recent quantitative analyses by point count of …
