Large economic corporations play a central role in the economies of modern societies. Much of what we consume is produced and marketed by corporations, and many of us are employed by them. Our economic fates appear to be inextricably linked to their actions. Not for the first time, however, corporations are facing pressures to expand the scope of their concerns even further. Two cases neatly illustrate the nature of these pressures. First, movements promoting corporate social responsibility exert pressures on corporations to take account of the negative and positive consequences of their actions to third parties; they are requesting that …

Effects of sprint training on plasma K⁺ concentration ([K⁺]) regulation during intense exercise and on muscle Na⁺-K⁺-ATPase were investigated in subjects with Type 1 diabetes mellitus (T1D) under real-life conditions and in nondiabetic subjects(CON). Eight subjects with T1D and seven CON undertook 7 wk of sprint cycling training. Before training, subjects cycled to exhaustion at 130% peak O₂ uptake. After training, identical work was performed. Arterialized venous blood was drawn at rest, during exercise, and at recovery and analyzed for plasma glucose, [K⁺], Na⁺ concentration ([Na⁺]), catecholamines, …

Antidiscrimination Law In The Administrative State, Julie C. Suk

Articles

The article argues that antidiscrimination law in the U.S. should shift its focus from corrective justice, which addresses individual wrongs, to distributive justice, which aims to eradicate systemic inequalities and promote equal opportunities. This shift would require enhancing the role of administrative agencies, such as the EEOC, to enforce antidiscrimination laws more effectively through proactive regulation and rulemaking. The article draws on the British model, where administrative agencies have stronger enforcement powers, to suggest reforms for the EEOC.

This Article explores the implications of allowing private parties to challenge mergers and acquisitions under the antitrust laws. It highlights a number of relatively recent developments in antitrust law that suggest an increase in private merger challenges in the future, and it identifies antiquated time of suit doctrines that may lead to inefficient and/or frivolous antimerger filings. It concludes by proposing several significant changes to the existing legal regime: (1) limited fee-shifting; (2) rigid time-of-suit deadlines; (3) single damages; and (4) limits on the use of postacquisition evidence to establish liability. Out of more than two thousand bike messengers in New York City, a few hundred participate in alleycats—illegal races held in open traffic. Surrounding this racing scene is a vibrant messenger community. Messengers who race in or attend alleycats carry their messenger identity into all aspects of their lives. Through direct participant observation, this article proposes that alleycats function as Durkheimian rituals for these messengers. Alleycats express the central values of the social world. Lost in collective effervescence, the individual confronts these values as objectified truths, which allow messengers to form stable identities. These guidelines help move us in that direction by providing practical, yet authoritative, guidance on a broad range of Web design and communication issues. Having access to the best available research helps to ensure we make the right decisions the first time around and reduces the possibility of errors and costly mistakes.

The ability to integrate a material with a high permeability on chip, allows for magnetically coupled circuits and structures to be designed and incorporated along side CMOS circuitry. Devices ranging from A.C. transformers to magnetically driven MEMS structures can be designed and fabricated. Desirable characteristics of magnetic cores for integrated inductors and transformers are first high saturation flux in order to obtain high saturation current; high permeability to obtain high inductance; high resistivity to reduce eddy current loss at high frequencies and compatible deposition and patterning processes. This research aims at analyzing the effective mechanical properties of thin film materials that are used in MEMS. Using the effective mechanical properties, reliable simulations of new or slightly altered designs can be performed successfully. The main reason for investigating effective material properties of MEMS devices is that the existing techniques can not provide consistent prediction of the mechanical properties without time-consuming and costly physical prototyping if the device or the fabrication recipe is slightly altered. The privatization movement is on the verge of succeeding too well. The fact that some of what government does can be done better and cheaper by the private sector has gained such momentum that the public sector is sometimes seen as redundant or irrelevant. But the economist's make-or-buy choice simply fails to capture the full range of responsibilities that government faces in deciding whether to outsource a particular function to private contractors.

"Radical Integration" explores the two primary theoretical frameworks for achieving black liberation: the integration approach (which can be understood as assimilationist) and the identity-based, community-centered approach (which can be understood as isolationist). I argue that neither framework, by itself, is enough to ensure the achievement of true black liberation. I extract key elements of each approach and harmonize them to envision an entirely new framework. This framework, "radical integration," refocuses on the impact of racial segregation on the black community and simultaneously recognizes the need to address concerns about black identity and black authenticity in an integrated environment.

U.S. practices of coercive interrogation and torture since 2002 have called into question the efficacy of traditional structural constraints on executive power. Few dispute that the most egregious abuse of detainees in U.S. custody was unlawful, yet neither congressional oversight nor law-making functioned to check such treatment. This Article first considers why and how torture and abuse became such a pervasive problem post-9/11 despite affirmative laws prohibiting them. It then argues that the tools that were at all effective in checking executive power emerged from less classically "democratic" sources: a highly professionalized military and intelligence community; the media and organizations …

The article argues that the findings from the silica multidistrict litigation (MDL), presided over by U.S. District Court Judge Janis Jack, have significant implications for understanding the fraudulent practices in asbestos litigation. The author contends that both silica and asbestos litigations share a common "entrepreneurial model" where a small group of doctors and screening companies generate specious claims for financial gain, often without proper medical oversight. Judge Jack's findings in the silica MDL, which revealed widespread fraud and manipulation of medical diagnoses, corroborate the author's long-standing critique of asbestos litigation practices.

Geographical Indications (GIs) are terms for foodstuffs that are associated with certain geographical areas. The law of GIs is currently in a state of flux. Legal protection for GIs mandated in the TRIPS Agreement is implemented through appellations law in France and through certification mark systems in the United States and Canada. This Article first examines the state of GIs throughout the world. The author then turns to the continuing debate between the European Union and other industrialized economies over this unique form of intellectual property. The paper examines the metaphors and dynamics of Atsabe Kemak group identity construction, with a strong emphasis on local cultural `remembering' of Atsabe history via-a-vis relations of power. The analysis utilizes the analytical frameworks of Foucault's notion of discourse and Bourdieu's concept of habitus. The secondary burial of a former chieftain highlights the dynamics of Atsabe Kemak responses to new nation-building processes and to international influences that have appeared during the United Nations' transitional administration.
