Finding Effective Constraints On Executive Power: Interrogation, Detention, And Torture, Deborah N. Pearlstein

Articles

U.S. practices of coercive interrogation and torture since 2002 have called into question the efficacy of traditional structural constraints on executive power. Few dispute that the most egregious abuse of detainees in U.S. custody was unlawful, yet neither congressional oversight nor law-making functioned to check such treatment. This Article first considers why and how torture and abuse became such a pervasive problem post-9/11 despite affirmative laws prohibiting them. It then argues that the tools that were at all effective in checking executive power emerged from less classically "democratic" sources: a highly professionalized military and intelligence community; the media and organizations …

The domestic partnership chapter of the Principles is the shortest chapter, but, as the contributions to this volume suggest, among the most interesting to many people. The legal regulation of informal intimate unions generally and particularly the Principles' approach of creating a status that carries the legal rights and obligations of marriage between cohabiting parties have generated considerable debate. In some quarters, the domestic partnership provisions are admired as an effective mechanism to protect dependent partners in marriage-like unions who otherwise may be unable to establish claims to property and support when their relationships end. Cases implicating classified information can pose difficult legal issues for Article III courts, and these issues may well grow more complicated and arise more frequently as the global war on terror continues. The manner in which these issues are resolved has profound implications for the national security, for the procedural rights of litigants, and for the public's ability to scrutinize legal proceedings. Americans take seriously the difference between acts and ideas. We remain mystified, for example, by the to-do about the cartoons depicting the Prophet Muhammad. The act-idea distinction is alive and well in our culture, and it remains largely intact in American law. No store owner puts up a sign saying, “You covet it, you bought it!” If you want to show your commitment to “manliness” by refusing to hire women, you’re out of luck. Kelo v. City of New London, 125 S. Ct. 2655 (2005), is unique in the modem annals of law in terms of the negative response it has evoked. The initial reaction by lawyers familiar with the case was one of lack of surprise. The health care system in the United States is in turmoil. Patients are being harmed by too many, often fatal, mistakes. At the same time, physicians and hospitals are trying to cope with a costly medical malpractice crisis. These two crises create a vicious cycle. When something goes wrong in patient care, physicians and hospitals withhold apologies and offer as little information as possible for fear that anything they say may be used against them should patients or family members sue. A growing number of secure group applications in both civilian and military domains is being deployed in WAHNs. A Wireless Ad-hoc Network (WARN) is a collection of autonomous nodes or terminals that communicate with each other by forming a multi-hop radio network and maintaining connectivity in a decentralized manner. A Mobile Ad-hoc Network (MANET) is a special type of WARN with mobile users. MANET nodes have limited communication, computational capabilities, and power. The new edition of the U.S. Department of Health and Human Services’ (HHS) Research-Based Web Design and Usability Guidelines. These guidelines reflect HHS’ commitment to identifying innovative, research-based approaches that result in highly responsive and easy-to-use Web sites for the public.

These guidelines help move us in that direction by providing practical, yet authoritative, guidance on a broad range of Web design and communication issues. Having access to the best available research helps to ensure we make the right decisions the first time around and reduces the possibility of errors and costly mistakes.

Investigation of Earth’s mesosphere using sounding rockets equipped with a myriad of instruments has been a highly active field in the last 2 decades. This paper presents data from three separate instruments: an RF impedance probe, a DC fixed bias Langmuir probe, and an electric field probe, that were flown on a mesospheric sounding rocket flight investigating the presence of charged dust within and/or around a sporadic metal layer. Sounding rocket experiments were conducted during the NASA EQUIS II campaign on Kwajalein Atoll designed to elucidate the electrodynamics and layer structure of the postsunset equatorial F region ionosphere prior to the onset of equatorial spread F (ESF). Experiments took place on 7 and 15 August 2004, each comprised of the launch of an instrumented and two chemical release sounding rockets. The instrumented rockets measured plasma number density, vector electric fields, and other parameters to an apogee of about 450 km. The chemical release rockets deployed trails of trimethyl aluminum (TMA) which yielded wind profile measurements. The Altair radar was …

ISO/IEC 17799:2005 is one of the leading standards of information security. It is the code of practice including 133 controls in 11 different domains. There are a number of tools and software that are used by organizations to check whether they comply with this standard. The task of checking compliance helps organizations to determine their conformity to the controls listed in the standard and deliver useful outputs to the certification process. In this paper, a quantitative survey method is proposed for evaluating ISO 17799 compliance. Our case study has shown that the survey method gives accurate compliance results in a …
