Liability Externalities And Mandatory Choices: Should Doctors Pay Less?, Robert D. Cooter, Ariel Porat Nov 2006

Liability Externalities And Mandatory Choices: Should Doctors Pay Less?, Robert D. Cooter, Ariel Porat

Coase-Sandor Institute for Law & Economics Research Paper Series

According to legal principles, a driver who negligently breaks a pedestrian's leg should pay the same damages as a doctor who negligently breaks a patient's leg. According to economic principles, however, the driver should pay more than the doctor. Non-negligent drivers impose risk on others without being liable for it. When liability externalities are mainly negative as with driving, liability should increase beyond full compensation to discourage the activity. Unlike pedestrians, patients contract with doctors for treatment and willingly submit to the risk of harm. Imperfections in medical markets cause some kinds of doctors to convey more positive than negative …

Offestting Risks, Ariel Porat Nov 2006

Offestting Risks, Ariel Porat

Coase-Sandor Institute for Law & Economics Research Paper Series

Under prevailing tort law, an injurer who is required to choose between Course of Action A, which creates a risk of 500, and Course of Action B, which creates a risk of 400, and negligently chooses the former will be held liable for the harm that materializes in its entirety. This full liability forces the injurer to pay damages that are five times higher than necessary for making him internalize the risk of 100 that is actually created by his negligent choice. The argument advanced by this Article is that tort law should recognize the "Offsetting Risks Principle" ("ORP"), under …

The Second-Order Structure Of Immigration Law, Eric A. Posner, Adam B. Cox Nov 2006

The Second-Order Structure Of Immigration Law, Eric A. Posner, Adam B. Cox

Coase-Sandor Institute for Law & Economics Research Paper Series

Immigration law concerns both first-order issues about the number and types of immigrants who should be admitted into a country and second-order design issues concerning the legal rules and institutions that are used to implement those first-order policy goals. The literature has focused on the first set of issues and largely neglected the second. In fact, many current controversies concern the design issues. This Article addresses the second-order dimension and argues that a central design choice all states face is whether to evaluate potential immigrants on the basis of pre-entry characteristics (the ex ante approach) or post-entry conduct (the ex …

Rumor Propagation On Random And Small World Networks, Deana B. Olles Nov 2006

Rumor Propagation On Random And Small World Networks, Deana B. Olles

Theses

In this work; three specific dynamical systems models, the Basic, Maki-Thompson, and Daley-Kendall, are used to model rumor transmission on social networks. Rumor flow is a measure of the time it takes for the rumor to completely pass through a specified network. Comparisons between random social networks and a small world social networks yield the faster transmission of a rumor over a small world network.

Using unique adjacency matrices that define our random networks, observations of some characteristics of the random networks will be made that are specific to this type of graph. Differences in the constructs of the two …

Streamlining Of The State-Dependent Riccati Equation Controller Algorithm For An Embedded Implementation, Sergey Katsev Nov 2006

Streamlining Of The State-Dependent Riccati Equation Controller Algorithm For An Embedded Implementation, Sergey Katsev

Theses

In many practical control problems the dynamics of the plant to be controlled are nonlinear. However, in most cases the controller design is based on a linear approximation of the dynamics. One of the reasons for this is that, in general, nonlinear control design methods are difficult to apply to practical problems. The State Dependent Riccati Equation (SDRE) control approach is a relatively new practical approach to nonlinear control that has the simplicity of the classical Linear Quadratic control method. This approach has been recently applied to control experimental autonomous air vehicles with relative success. To make the SDRE approach …

Ex Ante Choices Of Law And Forum: An Empirical Analysis Of Corporate Merger Agreements, Theodore Eisenberg, Geoffrey Miller Nov 2006

Ex Ante Choices Of Law And Forum: An Empirical Analysis Of Corporate Merger Agreements, Theodore Eisenberg, Geoffrey Miller

Vanderbilt Law Review

A leading question in American corporate law is why such a large percentage of large firms choose Delaware as their state of incorporation. An early view saw Delaware as leading a "race to the bottom" by providing charter terms that favored corporate managers at the expense of shareholders and the public at large. Later theorists postulated that Delaware might rather be providing terms that benefited all parties to the corporate contract ex ante-the "race to the top" view. Some have suggested that Delaware incorporation may represent neither a race to the top nor to the bottom, but rather a race …

Pend Oreille River, Box Canyon Model: Model Development And Calibration, Robert Leslie Annear, Chris Berger, Scott A. Wells

Civil and Environmental Engineering Faculty Publications and Presentations

The purpose of this study was to improve the existing Version 3.0 application of CE-QUAL-W2 of the Pend Oreille River between Box Canyon Dam and Albeni Falls Dam by performing the tasks outlined above. In addition, the use of field data from 2004 as an additional calibration year would improve the confidence in the model’s predictive ability for temperature. The model simulations were run from January 1st to December 31st in each of the 3 years of model simulation: 1997, 1998 and 2004.

The model chosen for development is CE-QUAL-W2 Version 3.5 (Cole and Wells, 2006). This is a twodimensional …

Capillary-Driven Flows Along Rounded Interior Corners, Yongkang Chen, Mark M. Weislogel, Cory L. Nardin Nov 2006

Capillary-Driven Flows Along Rounded Interior Corners, Yongkang Chen, Mark M. Weislogel, Cory L. Nardin

Mechanical and Materials Engineering Faculty Publications and Presentations

The problem of low-gravity isothermal capillary flow along interior corners that are rounded is revisited analytically in this work. By careful selection of geometric length scales and through the introduction of a new geometric scaling parameter Tc, the Navier–Stokes equation is reduced to a convenient∼O(1) form for both analytic and numeric solutions for all values of corner half-angle α and corner roundedness ratio λ for perfectly wetting fluids. The scaling and analysis of the problem captures much of the intricate geometric dependence of the viscous resistance and significantly reduces the reliance on numerical data compared with several previous solution methods …

Predicting U.S. Jet Fighter Aircraft Introductions From 1944 To 1982: A Dogfight Between Regression And Tfdea, Lane Inman, Timothy R. Anderson, Robert R. Harmon Nov 2006

Predicting U.S. Jet Fighter Aircraft Introductions From 1944 To 1982: A Dogfight Between Regression And Tfdea, Lane Inman, Timothy R. Anderson, Robert R. Harmon

Engineering and Technology Management Faculty Publications and Presentations

Since its inception in 2001, technology forecasting using data envelopment analysis (TFDEA) has been used with a number of applications. This paper presents a formal comparison of TFDEA to a previously published application from Technological Forecasting and Social Change by Joseph Martino. Using the data and Martino’s multiple regression model, we compare results obtained from TFDEA to those previously published. Both techniques predict the first flights of fighter jets introduced between 1960 and 1982 by using the first flights of aircraft introduced between 1944 and 1960. TFDEA was found to better predict the first flight dates than the forecast using …

Texts And Traditions: The Consequences Of Humanist New Testament Scholarship For The Reformation, Laura Rickelman Nov 2006

Texts And Traditions: The Consequences Of Humanist New Testament Scholarship For The Reformation, Laura Rickelman

Senior Honors Theses

Martin Luther's Reformation of Christianity was preceded by a conceptual reform of New Testament studies arising from the Renaissance scorn for medieval perceptions. The Reformation was thrust into a volatile academic area of conflicting humanist and scholastic methods of biblical interpretation. Lorenzo Valla and Desiderius Erasmus applied advanced methods of linguistic, historical, and literary criticism to the translation and emendation of the New Testament. The debate over authority for textual meaning held particular applicability for disregarding the authority of tradition in interpreting scripture. The humanist view of scripture was adopted by and consequently associated with the Reformation, although the conflicting …

On The Logic Of The Economic Integration Of Hong Kong Into The Greater China Economy, Hoi Cheung Cheung Nov 2006

On The Logic Of The Economic Integration Of Hong Kong Into The Greater China Economy, Hoi Cheung Cheung

CAPS Working Paper Series

Hong Kong has encountered an economic downturn since the outbreak of the Asian Financial Crisis in 1997. It was a result of the lack of long-term preparation for adjustment to changes in the industrial structure. Without a foundation to upgrade its industrial structure from labour-intensive manufacturing to mid and high-tech industry, Hong Kong could only transit its industrial structure directly from the secondary sector to the tertiary sector – financial services, trading and logistics, and related services. Nonetheless, due to the keen competition in terms of cost advantages from the neighbouring economies, mainly those regional economies in the Pearl River …

The Cognitive Psychology Of Circumstantial Evidence, Kevin Jon Heller Nov 2006

The Cognitive Psychology Of Circumstantial Evidence, Kevin Jon Heller

Michigan Law Review

Empirical research indicates that jurors routinely undervalue circumstantial evidence (DNA, fingerprints, and the like) and overvalue direct evidence (eyewitness identifications and confessions) when making verdict choices, even though false-conviction statistics indicate that the former is normally more probative and more reliable than the latter The traditional explanation of this paradox, based on the probability-threshold model of jury decision-making, is that jurors simply do not understand circumstantial evidence and thus routinely underestimate its effect on the objective probability of the defendant's guilt. That may be true in some situations, but it fails to account for what is known in cognitive psychology …

"Eggshell" Victims, Private Precautions, And The Societal Benefits Of Shifting Crime, Robert A. Mikos Nov 2006

"Eggshell" Victims, Private Precautions, And The Societal Benefits Of Shifting Crime, Robert A. Mikos

Michigan Law Review

Individuals spend billions of dollars every year on precautions to protect themselves from crime. Yet the legal academy has criticized many private precautions because they merely shift crime onto other, less guarded citizens, rather than reduce crime. The conventional wisdom likens such precaution-taking to rent-seeking: citizens spend resources to shift crime losses onto other victims, without reducing the size of those losses to society. The result is an unambiguous reduction in social welfare. This Article argues that the conventional wisdom is flawed because it overlooks how the law systematically understates the harms suffered by some victims of crime, first, by …

Burkean Minimalism, Cass R. Sunstein Nov 2006

Burkean Minimalism, Cass R. Sunstein

Michigan Law Review

Burkean minimalism has long played an important role in constitutional law. Like other judicial minimalists, Burkeans believe in rulings that are at once narrow and theoretically unambitious; what Burkeans add is an insistence on respect for traditional practices and an intense distrust of those who would renovate social practices by reference to moral or political reasoning of their own. An understanding of the uses and limits of Burkean minimalism helps to illuminate a number of current debates, including those involving substantive due process, the Establishment Clause, and the power of the president to protect national security. Burkean minimalists oppose, and …

The Glucksberg Renaissance: Substantive Due Process Since Lawrence V. Texas, Brian Hawkins Nov 2006

The Glucksberg Renaissance: Substantive Due Process Since Lawrence V. Texas, Brian Hawkins

Michigan Law Review

On their faces, Washington v. Glucksberg and Lawrence v. Texas seem to have little in common. In Glucksberg, the Supreme Court upheld a law prohibiting assisted suicide and rejected a claim that the Constitution protects a "right to die"; in Lawrence, the Court struck down a law prohibiting homosexual sodomy and embraced a claim that the Constitution protects homosexual persons' choices to engage in intimate relationships. Thus, in both subject matter and result, Lawrence and Glucksberg appear far apart. The Lawrence Court, however, faced a peculiar challenge in reaching its decision, and its response to that challenge brings …

Seasonal Variation In The Stable Isotopic Composition Of Precipitation In The Tropical Montane Forests Of Monteverde, Costa Rica, Amy L. Rhodes, Andrew J. Guswa, Silvia E. Newell Nov 2006

Seasonal Variation In The Stable Isotopic Composition Of Precipitation In The Tropical Montane Forests Of Monteverde, Costa Rica, Amy L. Rhodes, Andrew J. Guswa, Silvia E. Newell

Engineering: Faculty Publications

Climate and land use change may diminish orographic clouds over tropical montane forests, stressing biota and water resources during dry seasons. From 2003 to 2005 we measured the stable isotopic composition of precipitation and throughfall in Monteverde, Costa Rica, to distinguish convective, wet season rainfall associated with the Intertropical Convergence Zone (ITCZ) from dry season, orographic rain produced by northeasterly trade winds. While event-to-event fluctuations of δ18O and δ2H are high, monthly samples reveal a seasonal signal that may be used to trace water through the hydrologic cycle. Deuterium excess indicates that water evaporated from land is an important flux …

Analysis Of Two-Dimensional Photoelectron Momentum Spectra And The Effect Of The Long-Range Coulomb Potential In Single Ionization Of Atoms By Intense Lasers, Zhangjin Chen, Toru Morishita, Anh-Thu Le, M. Wickenhauser, X. M. Tong, C. D. Lin

Physics Faculty Research & Creative Works

Two-dimensional (2D) electron momentum distributions and energy spectra for multiphoton ionization of atoms by intense laser pulses, calculated by solving the time-dependent Schrödinger equation (TDSE) for different wavelengths and intensities, are compared to those predicted by the strong-field approximation (SFA). It is shown that the momentum spectra at low energies between the TDSE and SFA are quite different and the differences arise largely from the absence of a long-range Coulomb interaction in the SFA. We further found that the low-energy 2D momentum spectra from the TDSE exhibit ubiquitous fanlike features where the number of stripes is due to a single …

A Simplified Model For Growth Factor Induced Healing Of Wounds, F. J. Vermolen, E. Van Baaren, J. A. Adam Nov 2006

A Simplified Model For Growth Factor Induced Healing Of Wounds, F. J. Vermolen, E. Van Baaren, J. A. Adam

Mathematics & Statistics Faculty Publications

A mathematical model is developed for the rate of healing of a circular or elliptic wound. In this paper the regeneration, decay and transport of a generic 'growth factor', which induces the healing of the wound, is taken into account. Further, an equation of motion is derived for radial healing of a circular wound. The expressions for the equation of motion and the distribution of the growth factor are related in such a way that no healing occurs if the growth factor concentration at the wound edge is below a threshold value. In this paper we investigate the influence of …

Measures Of Investor Sentiment: Who Wins The Horse Race?, Arindam Bandopadhyaya Nov 2006

Measures Of Investor Sentiment: Who Wins The Horse Race?, Arindam Bandopadhyaya

Financial Services Forum Publications

Traditional research on asset pricing has focused on firm-specific and economywide factors that affect asset prices. Recently, the finance literature has turned to noneconomic factors such as investor sentiment as possible determinants of asset prices. Some researchers (e.g., Eichengreen and Mody, 1998) suggest that a change in one set of asset prices may change investor sentiment, thus triggering changes in a seemingly unrelated set of asset prices, especially in the short run, giving rise to pure contagion. Fisher and Statman (2000) and Baker and Wurgler (2006) have also recognized that investor sentiment may be an important component of the market …
