Reconceptualizing Child Sexual Exploitation As A Bias Crime Under The Protect Act, Tracy Agyemang

The note argues that the PROTECT Act, while expanding legal measures to combat child sexual exploitation, fails to address the crime's root causes and its nature as a form of discrimination. Although most states have legislatively or judicially abolished the once-prevalent doctrine of charitable immunity, the Supreme Court of Virginia and the Virginia General Assembly have essentially retained the doctrine intact. Moreover, the Supreme Court of Virginia has declared on numerous occasions that it is the prerogative of the General Assembly, not the court, to abolish charitable immunity. Because Virginia doctrinal developments which involve charitable immunity do not comport with trends across the country and have significant implications for plaintiffs, and for defendants which assert charitable immunity, these doctrinal developments warrant analysis. This essay undertakes that effort.

Several questions need to be addressed to evaluate whether Tannerella forsythia is to be considered a periodontal pathogen. T. forsythia has been detected in periodontal health and disease, so could it be a pathogen? The species was not detected in many studies despite finding other putative pathogens, so could it be important in pathogenicity? The challenges of working with T. forsythia include its fastidious and anaerobic growth requirements for cultural detection. Thus, studies associating T. forsythia with periodontal and other oral infections have used noncultural approaches (immunoassays and DNA-based assays) in addition to cultural approaches. We feel …

We determine the electron effective mass parameter m*=0.086±0.004 m0 of thin-film n-type low-chlorine-doped Zn0.87Mn0.13Se with free-charge-carrier concentration N=4.5x1017 cm-3 and optical mobility ) =300±20 cm2 / (V s) using magneto-optic generalized ellipsometry in the terahertz and far-infrared spectral domain for wave numbers from ω =30–650 cm-1. The room-temperature measurements were carried out with magnetic fields up to 3 T. We employ synchrotron and black-body radiation sources for the terahertz and far-infrared spectral regions, respectively. Gelatinization And Solubility Of Corn Starch During Heating In Excess Water: New Insights, Wajira S. Ratnayake, David S. Jackson

Starch gelatinization is associated with the disruption of granular structure causing starch molecules to disperse in water. This study was designed to examine starch granules as they were heated in water, and their resulting morphological, structural, and solubility traits. The results indicate that starch gelatinization is a more complex process than the previously suggested order-to-disorder transition. The energy absorbed by the granules facilitates the rearrangement or formation of new bonds among molecules prior to the temperatures normally associated with the melting of amylopectin crystallites during gelatinization. This dissertation analyses the development in the understanding of mission in the life and writings of St Thérèse of Lisieux and considers its contemporary significance. The thesis is that Thérèse progressed from a ‘mother missiology’ to a ‘sister missiology.’ This missiological evolution is intrinsically united to Thérèse’s transcendence of the faith-categories of her era.

Initially, with her Catholic contemporaries, Thérèse regarded it as her duty to ‘mother’ unbelievers into divine life. This ‘mother missiology’ gradually became ‘sister missiology’ as two movements of grace, namely the emergence of the ‘little way’ and Thérèse’s intensifying union with Jesus, the kenotic Christ, took …

Modeling Volume Changes In Porous Electrodes, Parthasarathy M. Gomadam, John W. Weidner

A three-dimensional mathematical model is presented to describe volume changes in porous electrodes occurring during operation. Material conservation equations are used to derive governing relationships between electrode dimensions and porosity for deposition/precipitation, intercalation, and ionomer-based electrodes. By introducing a parameter, called the swelling coefficient, the relative magnitudes of the change in electrode dimensions and the change in porosity are determined. The swelling coefficient is design-dependent and measured experimentally for a given cell design. The model is general and forms a critical addition required to extend the existing porous electrode models to include volume change effects. For the special case of …

This paper describes a clinical project using a self-reported pain diary for the assessment of chronic pain in the communicative, cognitively-intact nursing home resident. There are estimates of chronic pain among nursing home residents that range from 4 – 83%. The goal of this clinical project was to evaluate a chronic pain diary in relation to its effectiveness and efficiency in accurately assessing pain among nursing home residents. Recently, the legal and academic communities have been studying the phenomenon of the "vanishing trial." The phenomenon is an observation of the fact that the American court system is experiencing a trend of shrinking trial dockets. At least one scholar has partially attributed the decline in trials to the value placed upon settlement rather than adjudication within our justice system. Phillips v. Congelton (In re White Mountain Mining Co.), presents a heightened version of the conflict between the general policy favoring enforcement of arbitration agreements and the policy favoring resolution of bankruptcy-related claims in the bankruptcy court proceedings as the case involves a dispute over the enforcement of an international agreement to arbitrate a claim that is a "core" bankruptcy proceeding. In Phillips, the Fourth Circuit analyzed the underlying purposes of both the bankruptcy code and the federal arbitration statutes, and resolved the conflicting purposes of the two by giving greater deference to the policy favoring resolution of bankruptcy-related claims …

The authors have fabricated combinatorial Ni–Ti–Pt ternary metal gate thin film libraries on HfO2 using magnetron co-sputtering to investigate flatband voltage shift (ΔVfb) , work function (Φm) , and leakage current density (JL) variations. A more negative ΔVfb is observed close to the Ti-rich corner than at the Ni- and Pt-rich corners, implying smaller Φm near the Ti-rich corners and higher Φm near the Ni- and Pt-rich corners. In addition, measured JL values can be explained consistently with the observed Φm variations. Combinatorial methodologies prove to be useful …

Nonplanar surfaces are often encountered in engineering structures. In aerospace structures, periodically corrugated boundaries are formed by friction-stir-welding. In civil engineering structures, rebars used in reinforced concrete beams and slabs have periodic surface. Periodic structures are also being used to create desired acoustic band gaps. For health monitoring of these structures, a good understanding of the elastic wave propagation through such periodic structures is necessary. The ultrasonicwave propagation in sinusoidally corrugated waveguides is studied in this paper. Periodically corrugated waveguides are gaining popularity in the field of vibration control and for designing structures with desired acoustic band gaps. Currently only numerical method (Boundary Element Method or Finite Element Method) based packages (e.g., PZFlex) are in principle capable of modeling ultrasonic fields in complex structures with rapid change of curvatures at the interfaces and boundaries but no analyses have been reported. Louis Fisher's new work, Nazi Saboteurs on Trial: A Military Tribunal and American Law3 (Nazi Saboteurs), and his valuable contribution to illuminating Ex parte Quirin merit scrutiny. In this Review, I first descriptively assess Nazi Saboteurs. The Review then treats the monograph's numerous beneficial features and ascertains that it enhances understanding of the important decision in Quirin. I conclude with several recommendations for future analysis of Quirin's impact.

This Note discusses the advantages and drawbacks of mandating participation in mediation in medical malpractice disputes. Part II of this Note reviews the extent of the current medical malpractice crisis. Part III examines litigation as the traditional means of resolving medical malpractice disputes and suggests that litigation's weaknesses eclipse any of its strengths. Part IV evaluates the lingering challenges to arbitration, accounting for its ineffectiveness in resolving medical malpractice disputes.
