Redefining Open Access For The Legal Information Market, James G. Milles Jan 2006

Redefining Open Access For The Legal Information Market, James G. Milles

Journal Articles

The open access movement in legal scholarship, inasmuch as it is driven within the law library community over concerns about the rising cost of legal information, fails to address - and in fact diverts resources from - the real problem facing law libraries today: the soaring costs of nonscholarly, commercially published, practitioner-oriented legal publications. The current system of legal scholarly publishing - in student-edited journals and without meaningful peer review - does not face the pressures to increase prices common in the science and health disciplines. One solution to this problem is for law schools to redirect some of their …

The Rise, Development And Future Directions Of Critical Race Theory And Related Scholarship, Athena D. Mutua Jan 2006

The Rise, Development And Future Directions Of Critical Race Theory And Related Scholarship, Athena D. Mutua

Journal Articles

This essay tells the story of the rise, development and future directions of critical race theory and related scholarship. In telling the story, I suggest that critical race theory (CRT) rises, in part, as a challenge to the emergence of colorblind ideology in law, a major theme of the scholarship. I also contend that conflict, as a process of intellectual and institutional growth, marks the development of critical race theory and provides concrete and experiential examples of some of its key insights and themes. These conflicts are waged in various institutional settings over the structural and discursive meanings of race …

Gender Equality And Women's Solidarity Across Religious, Ethnic And Class Difference In The Kenyan Constitutional Review Process, Athena D. Mutua

Journal Articles

This paper examines Kenyan's women's struggle to gain new legal authority for gender equality and women's empowerment in the Kenya Constitutional Review process. Specifically it examines the efforts of the campaign to "safeguard the gains of women in the Draft Constitution," a campaign launched by a coalition of four civil society organizations in Kenya after the release of a new Draft constitution in 2002. Its focus is the 2002 Draft, the Draft's relationship to the current Kenyan Constitution and to recent constitutional proposals, from a gender perspective.

The constitutional review process is part of a larger movement to democratize the …

Residual Stress Distribution, Intermolecular Force, And Frictional Coefficient Maps In Diamond Films: Processing-Structure-Mechanical Property Relationship, Sanju Gupta, Oliver Williams, R. J. Patel, Eric W. Bohannan, P. W. May

Chemistry Faculty Research & Creative Works

Carbon in its various forms, specifically nanocrystalline diamond, may become a key material for the manufacturing of micro- and nano-electromechanical (M/NEMS) devices in the 21st Century. in order to utilize effectively these materials for M/NEMS applications, understanding of their microscopic structure and physical properties (mechanical, in particular) become indispensable. the micro- and nanocrystalline diamond films were grown using hot-filament and microwave chemical vapor deposition techniques involving novel CH4 / [TMB for boron doping and H2S for sulfur incorporation] in high hydrogen dilution chemistry. to investigate residual stress distribution and intermolecular forces at the nanoscale, the films were characterized using Raman …

Application Of Cognitive Engineering Principles To The Redesign Of A Dichotomous Identification Key For Parasitology, Kimberly A. Smith-Akins, Sharon Mclane, Thomas M. Craig, Todd R. Johnson Jan 2006

Application Of Cognitive Engineering Principles To The Redesign Of A Dichotomous Identification Key For Parasitology, Kimberly A. Smith-Akins, Sharon Mclane, Thomas M. Craig, Todd R. Johnson

Faculty, Staff and Student Publications

Dichotomous identification keys are used throughout biology for identification of plants, insects, and parasites. However, correct use of identification keys can be difficult as they are not usually intended for novice users who may not be familiar with the terminology used or with the morphology of the organism being identified. Therefore, we applied cognitive engineering principles to redesign a parasitology identification key for the Internet. We addressed issues of visual clutter and spatial distance by displaying a single question couplet at a time and by switching to the appropriate next couplet after the user made a choice. Our analysis of …

A Time-Motion Study Of Registered Nurses’ Workflow In Intensive Care Unit Remote Monitoring, Zhihua Tang, Janine Mazabob, Liza Weavind, Eric Thomas, Todd R. Johnson

Faculty, Staff and Student Publications

Utilizing advanced information technology, Intensive Care Unit (ICU) remote monitoring allows highly trained specialists to oversee a large number of patients at multiple sites on a continuous basis. In the current research, we conducted a time-motion study of registered nurses’ work in an ICU remote monitoring facility. Data were collected on seven nurses through 40 hours of observation. The results showed that nurses’ essential tasks were centered on three themes: monitoring patients, maintaining patients’ health records, and managing technology use. In monitoring patients, nurses spent 52% of the time assimilating information embedded in a clinical information system and 15% on …

On Sovereignty And Overhumanity Why It Matters How We Read Nietzsche's Genealogy 11:2, Christa Davis Acampora Jan 2006

On Sovereignty And Overhumanity Why It Matters How We Read Nietzsche's Genealogy 11:2, Christa Davis Acampora

Publications and Research

There is nearly unanimous agreement, among those who bother to pay attention to Nietzsche's anomalous claim about the "sovereign individual" in the second essay of On the Genealogy of Morals that the "sovereign" is Nietzsche's ideal, and many more still take sovereignty as the signature feature of the overman Nietzsche heralds in his Thus Spoke Zarathustra and other writings. I describe the reception among Nietzsche scholars as "nearly unanimous" because there has been at least one cry of dissent: that issued by Lawrence Harab. Curiously, his brief but incisive comments about the problematic nature of several readings along these lines …

Constructing Whiteness In Health Disparities Research, Jessie Daniels, Amy J. Schulz Jan 2006

Constructing Whiteness In Health Disparities Research, Jessie Daniels, Amy J. Schulz

Publications and Research

There is a long tradition within the United States of constructing whiteness (the racial subject) against racialized others (the racial object) and in the process displacing the focus of critical analysis. Here we turn our lens to the often invisible--or at least underinterrogated--concept of whiteness within the context of the literature on racial disparities in health. Specifically, we examine how whiteness is constructed in the active literature documenting and interpreting racial disparities in health and the implications of these constructions for efforts to eradicate inequalities in health. We draw on the concepts of racial formation and "racial projects" that emphasize …

Engineering Enterprise Software Systems With Interactive Uml Models And Aspect-Oriented Middleware, Paul Nguyen Jan 2006

Engineering Enterprise Software Systems With Interactive Uml Models And Aspect-Oriented Middleware, Paul Nguyen

Master's Projects

Large scale enterprise software systems are inherently complex and hard to maintain. To deal with this complexity, current mainstream software engineering practices aim at raising the level of abstraction to visual models described in OMG’s UML modeling language. Current UML tools, however, produce static design diagrams for documentation which quickly become out-of-sync with the software, and thus obsolete. To address this issue, current model-driven software development approaches aim at software automation using generators that translate models into code. However, these solutions don’t have a good answer for dealing with legacy source code and the evolution of existing enterprise software systems. …

Geometry-Based Detection Of Flash Worms, Sang Soo Kim Jan 2006

Geometry-Based Detection Of Flash Worms, Sang Soo Kim

Master's Projects

While it takes traditional internet worms hours to infect all the vulnerable hosts on the Internet, a flash worm takes seconds. Because of the rapid rate with which flash worms spread, the existing worm defense mechanisms cannot respond fast enough to detect and stop the flash worm infections. In this project, we propose a geometric-based detection mechanism that can detect the spread of flash worms in a short period of time. We tested the mechanism on various simulated flash worm traffics consisting of more than 10,000 nodes. In addition to testing on flash worm traffics, we also tested the mechanism …

Heuristics And Genetic Algorithms, Michael D. Mobley, Cihan H. Dagli, David Enke Jan 2006

Heuristics And Genetic Algorithms, Michael D. Mobley, Cihan H. Dagli, David Enke

Engineering Management and Systems Engineering Faculty Research & Creative Works

Genetic algorithms are design tools used in generating optimal solutions. While they can often be shown to outperform various heuristic methods and hybrid approaches, using a combination of evolutionary algorithms and heuristic approaches can generate an optimal solution more quickly than either of the two methods independently. Our purpose is to provide an overview of genetic algorithms, to discuss the types of problems that lend themselves to being solved by genetic algorithms, and to identify heuristics that have been shown to aid genetic algorithms in their quest for optimal solutions. While the sample problems discussed in this paper are generally …

Applying The Mahalanobis-Taguchi System To Vehicle Handling, Kioumars Paryani, Elizabeth A. Cudney, K. M. Ragsdell Jan 2006

Applying The Mahalanobis-Taguchi System To Vehicle Handling, Kioumars Paryani, Elizabeth A. Cudney, K. M. Ragsdell

Engineering Management and Systems Engineering Faculty Research & Creative Works

The Mahalanobis-Taguchi system (MTS) is a diagnosis and forecasting method using multivariate data. Mahalanobis distance (MD) is a measure based on correlations between the variables and patterns that can be identified and analyzed with respect to a base or reference group. The MTS is of interest because of its reported accuracy in forecasting using small, correlated data sets. This is the type of data that is encountered with consumer vehicle ratings. MTS enables a reduction in dimensionality and the ability to develop a scale based on MD values. MTS identifies a set of useful variables from the complete data set …

Modeling Design History In A Graphic Design Curriculum, Eunjin Jeong Jan 2006

Modeling Design History In A Graphic Design Curriculum, Eunjin Jeong

Theses

Graphic design history can be a valuable resource, contributing to graphic design students' understanding of design theories, and applied to problem solving exploration. According to many graphic design educators, current history courses are too often taught as superficial surveys of graphic style with no examinations of social, cultural, and political contexts, and have little interaction with practical studio courses. It is essential to bridge the gap between graphic design history and practical studio classes to further enhance graphic design education. This thesis will develop a means by which to show the tangible connection between graphic design history and applied problem-solving …

Habitat And Fauna Of Deep-Water Lophelia Pertusa Coral Reefs Off The Southeastern Us: Blake Plateau, Straits Of Florida, And Gulf Of Mexico., John K. Reed, Doug C. Weaver, Shirley A. Pomponi

Faculty Scholarship

Expeditions from 1999 to 2004 for biomedical research explored various deep-sea coral ecosystems (DSCE) off the southeastern U.S. (Blake Plateau, Straits of Florida, and eastern Gulf of Mexico). Habitat and benthos were documented from 57 dives with human occupied submersibles and three with a remotely operated vehicle (ROV), and resulted in ~100 hrs of videotapes, 259 in situ digital images, 621 museum specimens, and > 400 microbial isolates. These were the first dives to document the habitat, benthic fauna, and fish diversity of some of these poorly known deepwater reefs. Fifty-eight fish species and 142 benthic invertebrate taxa were identified. High-definition …
