When A Killer Body Isn’T Enough: Cross-Gender Identification In Action-Adventure Video Games, Marc Ouellette

While sports games try to recreate the atmosphere of a stadium or of television broadcasts of games, role-playing and action-adventure games attempt to duplicate cinematography through animation. For Tomb Raider, the virtual reality created by the cinematic animation of the game produces an environment for male-to-female cross-gender identification, a topic that has received little critical attention. The question that this paper seeks to tackle is whether in the contest of allegations of biopiracy and in the search for effective mechanisms for the protection of indigenous knowledge of the medicinal uses of plants possessed by traditional healers of southern Nigeria, there is any role for the patent regime. Given the popularity of alternative forms of health care, this question is of importance in contemporary discourse.

An important debate is currently underway in the inter-American human rights system involving the proper approach litigators, adjudicators, and advocates should take to supranational litigation of economic, social and cultural rights. Centered on questions of jurisdiction and the proper characterization and limits of justiciability, its resolution has tremendous implications for the tools available to on-the-ground advocates, their real-world effectiveness and sustainability in adjudicatory and advocacy contexts alike, and the rationalization of the system's developing jurisprudence over the long-term.

Rethinking The "Less As More" Thesis: Supranational Litigation Of Economic, Social And Cultural Rights In The Americas, Tara J. Melish

In their 2005 law review article Less as More: Rethinking Supranational Litigation of Economic and Social Rights in the Americas, James Cavallaro and Emily Schaffer argue for a "rethinking" of strategies to advance economic, social and cultural rights in the Americas. They posit that to achieve higher rates of real-world protection for such rights, social rights advocates should do two things: first, bring less litigation and, second, frame any marginal litigation that is pursued as violations of classic civil and political rights. The recent explosion in intellectual property litigation has witnessed increasing recourse to secondary liability theories. The courts have responded favorably to plaintiffs by enunciating substantial reinterpretations of extant principles, thereby precipitating a veritable secondary liability revolution. Numerous commentators have bemoaned this trend, contending that judicial recasting of liability rules expands intellectual property rights beyond their intended scope, thereby resulting in an overprotective regime that stifles innovation. Since the founding, all gerrymandering of election districts, at both the state and congressional levels, has been accomplished by state actors operating almost exclusively under state law. State constitutions have often served as a first line of defense against publicly disfavored practices, and the treatment of gerrymandering is no exception. The state constitutional record reveals a gradual introduction, diffusion, and evolution of a wide variety of provisions intended to control gerrymandering, including requirements of contiguity, compactness, respect for local political boundaries, and preservation of communities of interest, among others. Institutions of higher education have many assets, but it is the human capital that is necessary for them to operate. Without the right personnel it would be impossible for colleges to function. Shortages of personnel at all levels have been predicted; however, it is the potential leadership crisis that is a rising concern. Many changes may be causing the shortages. Population and workforce changes in conjunction with growing college campuses may be partially to blame. The Prairie Pothole Region (PPR) contains 5-8 million small wetlands and is one of the most ecologically valuable freshwater resources of the Nation. These wetlands provide abundant ecosystem services, including groundwater recharge, water for agriculture, water purification, and recreation. The PPR is best known as the “duck factory” of North America. By some estimates, this region produces over 50% of the ducks in North America.

Lininger, Jay Charles, Fall 2006 Environmental Studies Chair: Dr. Len Broberg This case study documents the effectiveness of stand-scale forest restoration activities undertaken in the “Penny Stew” project on federal land in the central Siskiyou Mountains of southwest Oregon. Its dual purpose is to 1) define reference conditions and build a site-specific case for restoration through multi-scale analysis of historical ecology (Chapter III), and 2) demonstrate streamlined monitoring protocols that practitioners can use to adapt restoration practices over time (Chapter IV). Forensic Anthropology : Its Contribution To Forensic Cases Submitted To The University Of Montana For Analysis, Ana M. Byrne

The Anthropology Lab at the University of Montana is regularly consulted by law enforcement agencies throughout the state of Montana on cases suspected to involve skeletal human remains. In this paper, how specifically Forensic Anthropology contributes to these cases is examined. Cases submitted to the UM Lab for analysis between the years of 1971 and 2004 are followed up and the agencies involved are asked specific questions regarding each case. Agencies responded to questions regarding 97 of the UM’s 238 total cases. Results of this study show that of those cases containing contemporary human remains about 18% were identified after …
