Bankruptcy And State Collections: The Case Of The Missing Garnishments, Richard M. Hynes

Recent bankruptcy reforms were spurred in part by a bankruptcy filing rate that has more than doubled in the last ten years and that has risen by approximately six hundred percent over the last generation. Some attribute this surge in filings to Americans' greater willingness to avoid debts by declaring bankruptcy. Most academics, however, argue that more Americans are forced into bankruptcy by crushing debt burdens and aggressive collections techniques. Jury Innovation In Practice: The Experience In New York And Elsewhere, Paula Hannaford-Agor

The article analyzes data reported in the National Center for State Courts 2006 survey of civil and criminal jury trial practice. The focus is on New York's use of various techniques to improve jury participation compared to use by nearby states, Connecticut and New Jersey, and other state courts. Innovative techniques discussed include juror notebooks, note-taking, juror questions of witnesses, and jury instructions. The article concludes that New York's courts lag behind other state courts in adopting these practices, and that both success in practice and ABA recommendations should be persuasive to New York judges that improvements can be made …

This paper takes another look at the displacement of lesbians and gays from civic society by being prohibited from accessing marriage rights. First, certain events in anti-gay discrimination and marriage history that contributed to the second-class citizenship of lesbians and gays are reviewed. Second, a look at how the secondclass citizenship is unique to lesbians and gays is examined. Finally, this paper looks at the marriage, fatherhood, and faith-based initiatives under welfare reform and how they reinforce heterosexual marriage and family in American society.

As the United States Environmental Protection Agency (EPA) seeks to model vehicle emissions based on dynamic engine operating conditions, modal PM datasets will be investigated for their robustness and limitations under the requirements of the EPA’s model: MOVES. The Kansas City PM Characterization Study tested more than 500 light-duty gasoline cars and trucks on a dynamometer in summertime and wintertime temperatures with four different modal PM2.5 instruments.

Using data reduction techniques used to prepare other datasets for the MOVES model, the modal PM data were analyzed to determine its ability to be incorporated into MOVES. It was found through averages …

A black coating of unknown origin obscures the pictographs in Little Lost River Cave, Idaho. We utilized x-ray photoelectron spectroscopy (XPS) to characterize the outermost surface of the black coating to understand how it was formed. Carbon and oxygen predominated in the XP spectra, whereas nitrogen was detected at varying levels in different samples. High-resolution carbon 1s XP spectra showed that carbon was present in at least three different forms: hydrocarbon C, carbonyl C, and carbonate C/ amide C. The N 1s peak was observed at ~399-400 eV binding energy, which is usually attributed to aromatic or amide N. The …

With the development of the World Wide Web, online courses are becoming more and more popular in modern science education. CyberLab aims to solve an important issue in distance science education -- laboratory experiments in online courses. It is a toolkit that handles creation, exportation, and execution of virtual experiments (within web browsers). It consists of LabCreator and LabExecutor. With LabCreator, instructors can create virtual experiments and export them into intermediate files. Students can download those files from online course websites and execute them in LabExecutor on their own computers.

A family-centered approach was espoused in IDEA Part C as the context for service to families with young children experiencing developmental delays. A phenomenological inquiry was conducted to explore how mothers of young children with disabilities orchestrate their engagement in an early intervention program, and to identify factors that support their participation. In-depth interviews were conducted with five mothers of children enrolled in a community-based program located in an urban area. An over-arching theme addressing the need for service providers to be “In my reality” emerged. Despite advances in diagnosis and treatment of patients with upper gastrointestinal hemorrhage (UGIH), the majority of hospitals do not risk-stratify patients with UGIH. One of the major challenges in triaging patients with nonvariceal UGIH is identifying patients’ who are at low risk. We retrospectively identified Rockall scores of 160 patients and the proportion of low-risk patients seen in the Emergency Department at Saint Joseph Mercy Hospital (SJMH) over a one-year period. Additionally, we determined adverse outcomes and healthcare resources utilized and evaluated whether certain antiplatelet agents, anticoagulants, and NSAIDS affected the Rockall scores. The Ecological Life: Discovering Citizenship And A Sense Of Humanity, Jeremy Bendik-Keymer

Written as a series of lectures, The Ecological Life offers a humanistic perspective on environmental philosophy that challenges some of the dogmas of deep ecology and radical environmentalism while speaking for their best desires. The book argues that being human-centered leaves us open to ecological identifications, rather than the opposite. Bendik-Keymer draws on analytic and continental traditions of philosophy as well as literature and visual media. He argues for a sense of ecological justice consonant with human rights, and shows how humanistic thinking is committed to deepening respect for life and our ecological orientation. It proceeds on the assumption that such skills are integral to competent lawyering and that they ought to be taught and evaluated in law school. Today, jurisdiction over immigration law is by no means well defined by clear limits. Limitations on jurisdiction have bred a multitude of litigation. The number of federal court cases reviewing removal orders has increased 970% in the past ten years. As of September 2005, the immigration cases represented 18% of the appellate civil docket.

Congress and the courts are not alone in augmenting the number of immigration cases in the federal courts. Congress has also urged the agencies enforcing the immigration laws to increase enforcement, to reduce backlogs and to make removal more swift and certain. At the same time …

The Authoritative Moment: Exploring The Boundaries Of Interpretation In The Recognition Of Queer Families, Kris Franklin

This article examines the boundaries of judicial interpretation as courts struggle to define the families formed by lesbians, gay men and transexuals. It compares the jurisprudence of numerous state courts examining queer families in different contexts. The article identifies three interwoven components of judicial reasoning: "lex" reasoning, grounded in the jurisdiction's binding and persuasive law; factual reasoning in which the courts must categorize queer families as analogous to those the law already recognizes or instead as something quite new and distinct; and finally methodological reasoning, in which courts self-consciously examine the boundaries of their own interpretive authority. The aeration effectiveness of a diffused oxygen system was compared with that of a tractor-powered paddlewheel during eight harvests of channel catfish Ictalurus punctatus at Top Cat II Fishery in Chicot County, Arkansas. Dissolved oxygen and water temperature data were collected from a grading net aerated by the diffused oxygen system, from a grading net aerated by a paddlewheel, and from the open culture pond between the two grading nets and were not significantly different. However, comparison of estimated oxygen consumption by the biomass confined in each grading net indicated that the aeration effectiveness of the diffused oxygen system equaled …
