An Optimum Currency Area In South Asia: Is It Plausible?, Nilanjan Banik, Basudeb Biswas, Peter J. Saunders
All Faculty Scholarship for the College of Business
This article is an empirical investigation of the potential feasibility of an optimum currency area (OCA) in South Asia. Under an OCA, member countries share a common currency (like the Euro), and forego autonomy with respect to monetary policy instruments. Countries are good candidates for forming an OCA if there is a long-run relationship in the trend (permanent) component of output. Our results indicate existence of such a long-run relationship in the trend component of gross domestic product (GDP) among the member countries in South Asia. Hence, the South Asia region has the potential to form an OCA.
"Play In The Joints Between The Religion Clauses" And Other Supreme Court Catachreses, Carl H. Esbeck
"Play In The Joints Between The Religion Clauses" And Other Supreme Court Catachreses, Carl H. Esbeck
Hofstra Law Review
Consistent with its fumbling of late when dealing with cases involving religion, the U.S. Supreme Court has taken to reciting the metaphor of play in the joints between the Religion Clauses. This manner of framing the issue before the Court presumes that the Free Exercise and Establishment Clauses run in opposing directions, and indeed will often conflict. It then becomes the Court's task, as it sees it, to determine if the law in question falls safely in the narrows where there is space for legislative action neither compelled by the Free Exercise Clause nor prohibited by the Establishment Clause. The …

Contract Formalism, Scientism, And The M-Word: A Comment On Professor Movsesian's Under-Theorization Thesis, Jeffrey M. Lipshaw
Hofstra Law Review
In two recent essays, Professor Mark L. Movsesian has suggested that a significant difference between the classical formalism of Williston and the formalism of contemporary contracts scholars is the extent to which the earlier work was under-theorized. I want to suggest an area in which there is a consistency to the under-theorization between the classical and the modern contract formalists: the extent to which theorization in anything that approaches metaphysics is, and has been, consistently anathema. Modern theorizing is overwhelmingly of a particular form: dispassionate social science inquiry into how we tick, rarely questioned but implicit norms shaped solely around …

A Cross-Language Approach To Rapid Creation Of New Morpho-Syntactically Annotated Resources, Anna Feldman, Jirka Hana, Chris Brew
A Cross-Language Approach To Rapid Creation Of New Morpho-Syntactically Annotated Resources, Anna Feldman, Jirka Hana, Chris Brew
Department of Linguistics Faculty Scholarship and Creative Works
We take a novel approach to rapid, low-cost development of morpho-syntactically annotated resources without using parallel corpora or bilingual lexicons. The overall research question is how to exploit language resources and properties to facilitate and automate the creation of morphologically annotated corpora for new languages. This portability issue is especially relevant to minority languages, for which such resources are likely to remain unavailable in the foreseeable future. We compare the performance of our system on languages that belong to different language families (Romance vs. Slavic), as well as different language pairs within the same language family (Portuguese via Spanish vs. …

Economic Fundamentals, Financial Markets, And Voting Preferences: The 1994, 1998, And 2002 Brazilian Presidential Elections, Lucio Rennó, Anthony P. Spanakos
Department of Political Science and Law Faculty Scholarship and Creative Works
This article explores the relationship between macroeconomic indicators, financial markets, and voting intentions in the 1994, 1998, and 2002 Brazilian Presidential elections. Several hypotheses concerning the relationship between economic performance and politics were tested using a data set containing aggregate measures of self-reported preferences for the Presidential candidates and economic indicators (inflation, unemployment, exchange rate, C-Bond spread, and the São Paulo Stock Exchange Index). The first hypothesis refers to the potential simultaneity between economic indicators and voting intentions. Other hypotheses relate to the varied impact of different economic indicators on the intention to vote for a specific Presidential candidate as …
Comparison Of Combustion Sources And Measurement Techniques For Particulates Emitted From Engines And A Power Plant, Matthew F. Chandler
Comparison Of Combustion Sources And Measurement Techniques For Particulates Emitted From Engines And A Power Plant, Matthew F. Chandler
Masters Theses
"Sub-micron particulates emitted from various combustion sources have serious negative impacts on human health and the environment. It is essential to accurately characterize the physical properties of these particulates including size, shape, structure, and chemical composition in order to monitor, regulate, and model the various transport, toxic, optical, chemical, and deposition properties which dictate their harmful effects. This study consists of two related investigations involving the application of diagnostics methods to characterization and comparison of combustion generated particulate emissions from various sources. The first investigation includes the measurement of particulates emitted from a compression-ignition (diesel) engine using two independent measurement …

You Are Living In A Gold Rush, Richard Delgado
You Are Living In A Gold Rush, Richard Delgado
Hofstra Law Review
This article argues that our times, characterized as they are by dreams of vast wealth, environmental destruction, and growing social inequality, resemble nothing so much as earlier get-rich-quick periods like the Gilded Age and the California gold rush.
I put forward a number of parallels between those earlier periods and now, and suggest that the current fever is likely to end soon. This will come as a relief to those of you who, like me, deplore the regressive social policies, bellicose foreign relations, and coarsening of public taste that we have been living through-even if some of our more libertarian …
Reviving The Nuclear Power Option In The United States: Using Domestic Energy Law To Cure Two Perceptions Of International Law Illegality, James E. Hickey Jr.
Reviving The Nuclear Power Option In The United States: Using Domestic Energy Law To Cure Two Perceptions Of International Law Illegality, James E. Hickey Jr.
Hofstra Law Review
Two perceptions, right or wrong, of international law illegality on the part of the United States have arisen in the last few years with regard to both the use of military force in Iraq and to global warming. The first perception is that the United States invaded Iraq illegally to secure a significant source of foreign oil. The second perception is that the United States ignores the letter and spirit of the evolving international climate change regime to reduce greenhouse gas ("GHG") emissions.
Both perceptions of international law illegality directly reflect the domestic growth energy policy of the United States …
The Nature And Impact Of The "Tort Reform" Movement, F. Patrick Hubbard
The Nature And Impact Of The "Tort Reform" Movement, F. Patrick Hubbard
Hofstra Law Review
For over thirty years, repeat players on the defense side of tort litigation have undertaken to "reform" tort doctrine in their favor. Initially, these efforts consisted of ad hoc efforts to address a series of "crises," primarily in terms of the cost and availability of liability insurance. In the 1980s, the tort reform movement began to develop a more permanent institutionalized approach to the push for "reform." Not surprisingly, there has been considerable debate about the goals of this movement, the fairness or efficiency of the specific doctrinal reforms it seeks, and the methods it uses. This Article places this …

Foreword: Biomedical Reasearch And The Law-Selected Issues: The Pharmaceutical Industry And Its Relationship With Government, Academia, Physicians And Consumers, Janet L. Dolgin, Joel Weintraub
Hofstra Law Review
The articles in this issue developed from a conference entitled Biomedical Research and the Law, held at Hofstra University in the fall of 2006. The conference explored conflicts of interest created by industry's support for biomedical research. Participants considered how to safeguard the integrity of research and the safety of drugs while encouraging the development of treatments for disease.
The Case For Selective Abolition Of The Rules Of Evidence, David Crump
The Case For Selective Abolition Of The Rules Of Evidence, David Crump
Hofstra Law Review
This article advocates selectively abolishing the exclusionary components in the Federal Rules of Evidence. Arguing that some parts of the existing rules cost more than the value of any benefits they provide, it is the author's position that the current system is sufficiently dysfunctional so as to make significant revisions in the Rules of Evidence worthwhile. The article examines the hearsay rule, the rules governing repetitive-behavior evidence, and issues regarding opinion evidence, experts, and authentication. The article proceeds to consider the rest of the FRE 400 series - particularly Rules 401 through 403 - and proposes modifications. Next, the article …

Lawyers' Ethics In An Adversary System - Foreword: Like Gravity, Roy D. Simon

This issue collects nearly all of the papers delivered at the conference. Of equal interest, each paper is followed by a transcript of the fascinating exchanges that occurred between the speaker and members of the audience during a lengthy question and answer session after each speech.

The Zeal Shortage, Anita Bernstein
The Zeal Shortage, Anita Bernstein
Hofstra Law Review
Although the duty of zealous advocacy enjoys nominal approval in most state bar rules and the secondary literature, today the majority of writings about zeal in the practice of law present zeal in a negative light. Critics use this word to object to lawyers' dishonesty, hyperpartisanship, aggressive or confrontational work styles, rudeness, and disregard for the interests of adversaries, the courts, and the public. This article, part of a Hofstra University symposium, builds on the literature that praises zealous advocacy (much of it written by symposium honoree Monroe Freedman) to identify a shortage of zeal in American legal practice and …
Reconsidering The Corporate Attorney-Client Privilege: A Response To The Compelled-Voluntary Waiver Paradox, Lonnie T. Brown Jr.
Reconsidering The Corporate Attorney-Client Privilege: A Response To The Compelled-Voluntary Waiver Paradox, Lonnie T. Brown Jr.
Hofstra Law Review
Many within the legal profession are presently of the opinion that the protection traditionally accorded by the corporate attorney-client privilege is being seriously eroded, if not completely destroyed. This sentiment has largely been inspired by the perceived effect of government use of what I refer to as "compelled-voluntary" waiver in the context of investigations into corporate wrongdoing. Various governmental bodies employ this waiver device, but the United States Department of Justice ("DOJ") is perhaps the best known and certainly the most vilified.
The DOJ guidelines for prosecuting corporations, embodied first in the so-called "Holder Memorandum" and now in the "Thompson …
Evaluating Lookup-Based Monocular Human Pose Tracking On The Humaneva Test Data, Nicholas Howe
Evaluating Lookup-Based Monocular Human Pose Tracking On The Humaneva Test Data, Nicholas Howe
Computer Science: Faculty Publications
This work presents an evaluation of several lookup-based methods for recovering three-dimensional human pose from monocular video sequences. The methods themselves are largely described elsewhere [1, 2], although the work presented here incorporates a few minor enhancements. The primary contribution of this work is the evaluation of the results on a data set with ground truth available, which allows for quantitative comparisons with other techniques. Methods relying upon silhouettes produced via background subtraction tend to act as a “straw man” in relation to the current state of the art; many recently proposed techniques work without reliance upon background subtraction and …
