Guideline Institutionalization: The Role Of Merger Guidelines In Antitrust Discourse, Hillary Greene

With the growth of the administrative state, agency-promulgated enforcement policy statements, typically referred to as guidelines, have become ubiquitous in the U.S. federal system. Yet, the actual usage and impact of such guidelines is poorly understood. Often the issuing agencies declare the guidelines to be nonbinding, even for themselves. Notwithstanding this disclaimer, the government, private parties, and even the courts frequently rely on the guidelines in a precedent-like manner. In this Article, Professor Greene examines the evolution of one system of enforcement policy guidelines-the U.S. federal antitrust merger guidelines--and finds that these guidelines have acted as a stealth force on …

The Justices of the Supreme Court have a great deal in common with the gifted pachyderm from the Walt Disney animated classic feature Dumbo. Like Dumbo's "magic" feather that purportedly enabled him to exercise his natural ability to fly, the tradition limitation on the Court's jurisprudence on unenumerated fundamental constitutional rights provides a more-apparent-than real constraint on the Court's almost unlimited ability to nullify legislative and executive action. In all too many substantive due process cases, reason seems to follow a predetermined result, rather than the result in the case following from the applicable governing principles. Coyotes (Canis latrans) have progressively colonized eastern North America following wolf extirpation and the clearing of forested landscapes. The coyote has expanded its geographic range into Georgia during the past 50 years, and its impact as the top predator is potentially influencing community dynamics via competition and/or predation. Few studies have examined coyote food habits in the southeastern United States. Our objective was to determine prey items consumed by free-ranging coyotes living on Berry College lands in northwestern Georgia. Band programs in today’s schools are facing pressures unheard of in the early days of the public school band movement. While budget limitations have always been a part of the public school dilemma, never before have directors been forced to fight so hard for the very existence of their programs. School administrators facing district, state, and federal testing pressures are spending more and more of the annual budget in an attempt to raise test scores. Liquid crystals are a soft condensed matter phase that share properties with both isotropic liquids and crystalline solids. Composite materials formed from both low molecular weight liquid crystals and polymers are of both fundamental and technological importance. One method for preparing dispersions of polymers and liquid crystals is polymerization-induced phase separation. Photo-polymerization induced phase separation utilizes a mixture of a liquid crystal and a photo curable polymer contained between two indium tin-oxide (ITO) coated glass substrates. Irradiation of the homogeneous pre-polymer mixture initiates polymerization, which in turn induces a phase separation between the polymer and liquid crystal. Holographically patterned polymer …

Regulation Of A Dna-Compacting Plastid Nucleoid Protein, Steven William Adamson

DCP68, a DNA-compacting nucleoid protein, was further characterized in order to understand how plastid nucleoid proteins affect the structure and function of chloroplast DNA. Previously, DCP68 was identified as ferredoxin: sulfite reductase, an enzyme that participates in reductive sulfur assimilation and inhibits chloroplast DNA replication and transcription in vitro [1, 2]. In this study, the portion of SiR that was found to be present in soluble and plastid nucleoid-enriched fractions indicated that most SiR was stromal in Arabidopsis and soybean plants. Although SiR was detected in Arabidopsis chloroplast nucleoid-enriched fractions, the study of nucleoid dynamics proved to be difficult due …

The purpose of this document is to compare the Alto F trumpet used by the players of Richard Wagner’s orchestra to the modem trumpet, with reference to specific excerpts from Der Ring des Nibelungen. It will discuss topics pertaining to transposition, range, keys, timbre, and crooking. Other elements that will be explored are the evolution of the valved trumpet and how it led to the Alto F trumpet. This report focuses on the evaluation of the factors affecting cone resistance measurement during cone penetration in saturated clayey soils and the application of the result to pile shaft capacity analysis. In particular, effects of drainage conditions around the cone tip were studied. Rate effects related to both drainage and shear strength dependence on loading rate were studied. In order to investigate the effects of drainage during penetration, penetration tests were performed with various velocities in the field and in a calibration chamber, and the obtained data were analyzed. Among twenty one species and isolates of fungi, the production of fibrinolytic protease in fifteen of them was recorded. The maximum lysis times of human plasma clot were 40,41,44,45,46,46,54 and 64 min recorded by Aspergillus niger (AB-11), Pleurotus ostreatus (white variety), Pleurotus ostreatus (gray variety), Aspergillus oryzae (AB-21). Pleurotus sajor-caju.Trichoderma harzianum, Coprinus cinerus and Agaricus bitorquis, respectively, when these fungi grown on the liquid medium No.1 composed essentially of sucrose.soya bean powder and yeast extract powder in a shacked culture conditions. Improvement Of Solar Cell Efficiency By Using Four Mirrors V-Trough Concentrator Covered With Fresnel Lenses, Ali Hadi Al-Hamadani, Sabri Jasem, Kawked Dawod

V-trough concentrator with four mirrors has been designed and constructed. Its effects on the silicon solar cell performance were studied with and with out cooling system. It was shown that the cell efficiency was increased from 11.94% to 21% with out cooling and from 13.3% to 25.55% with cooling system. The effect of a combination between Fresnel lens and V-trough concentrator was studied also. The solar cell efficiency was improved to 26.8% with out cooling and the best efficiency improvement was 30.3% with cooling system.

Ecology and biology of Gattan Barbus xanthopterus (Heckel) in Euphrates river, middle of Iraq have been studied through a period from September 2002 to December 2003, water temperature has been shown lowest values (14.5 °c) in January, whereas, the highest values (39°c) was in August. Salinity concentration and water turbidity values ranged between 0.68 to 0.81 gm/L and 11 to 57 NTU respectively. Slight fluctuation in pH ranged between 7.2 to 8.1 with 7.7 mean value. Dissolved oxygen shown highest mean values ranged between 6.9 to 11.5 mg/L in summer and winter respectively. Variation values of gonado somatic index (GSI) …

Preliminary study on the possibility of using gamma radiation to induce sexual sterility in males of the furniture carpet beetle A. flavipes was carried out as a part of programme aiming to use SIT in controlling this pest. Results indicated that the induction of complete sterility in males was occurred by irradiated them as adults (24 hours old) by 100 130 and 150 Gy. Furthermore, Results also showed that there was reducing ir. average number eggs laid by female that mated with irradiated male in comparison with females that matted with normal males.

In this article, we consider how long-term patterns of resistance to structural violence inform citizens’ responses to displacement before and after Katrina. Drawing on Abdou Maliq Simone’s (2004) conceptualization of people as infrastructure, we recenter the discussion about the rebuilding of New Orleans around displaced residents, taking the place-making practices of members of a social club as a lens through which to examine the predicament of the city as a whole. Members have been generating alternative ways of thinking about and dwelling together in a restructuring city. Their perspectives are articulated through in-depth interviews, focus groups, and the embodied practices …

The term ‘‘genocide’’ has been commonly used, particularly in political dialogue, to describe atrocities of great diversity, magnitude, and character. Yet the prospect of the term’s arising in policy making too often imposes an intimidating brake on effective responses. The political use of the term should be separated from its legal definition as a crime of individual responsibility. Governments and international organizations should be liberated to apply the term ‘‘genocide’’ more readily within a political context so as to publicly describe precursors of genocide and react rapidly either to prevent or to stop mass killings or other seeming acts of …
