A circuit split has recently developed regarding the correct interpretation of 29 C.F.R. § 825.220(d), a regulation issued pursuant to the Family and Medical Leave Act of 1993, which states in pertinent part, "Employees cannot waive, nor may employers induce employees to waive, their rights under FMLA." The Fifth Circuit correctly concluded that 29 C.F.R. § 825.220(d) bars only the prospective waiver of substantive rights under the FMLA and does not reach the post-dispute release or settlement of FMLA claims. Subsequently, the Fourth Circuit alternatively concluded that § 825.220(d) prohibits the prospective and retrospective waiver or release of both the …

The proteome can be defined as the complete set of global protein expression by an organism at any given time. It is this gene expression rather than genome itself that is responsible for most of the reactions taking place within a cell. Tools such as two-dimensional polyacrylamide gel electrophoresis (2D-PAGE) and mass spectroscopy (MS) are often utilized for the analysis and identification of the proteins that constitute the proteome. Estimating an unknown probability density function is a common problem arising frequently in many scientific disciplines. Among many density estimation methods, the kernel density estimators are widely used. However, the classical kernel density estimators suffer from an intrinsic problem as they assign positive values outside the support of the target density. This problem is commonly known as the `Spill over` effect. A modification to the regular kernel estimator is proposed to circumvent this problem. The proposed method uses a lognormal kernel and can be used even in the presence of censoring to estimate any density with a positive support without …

Sleep is a vital, highly organized process regulated by complex systems of neuronal networks and neurotransmitters. Sleep plays an important role in the regulation of central nervous system and body physiologic functions. Sleep architecture changes with age and is easily susceptible to external and internal disruption. Reduction or disruption of sleep can affect numerous functions varying from thermoregulation to learning and memory during the waking state.

In the wake of the so-called "social turn" in writing studies, the scholarship of invention has enjoyed renewed interest. This dissertation is primarily concerned with invigorating the research of invention by turning towards viable but untapped generative approaches for composing that have been forged by artists working in areas external to composition studies by putting into practice what media theorist Gregory Ulmer calls a "heuretic" approach to invention. (I use the term heuretic to indicate the appropriation of an inventional model from a domain or discipline such as art, though other domains such as engineering would suit just as well.) …

This study evaluates the shear behavior and capacity of the precast concrete box culverts subjected to HS 20 truck wheel load. The most critical culvert behavior was considered by studying culverts subjected to zero depth fill and placed on rigid laboratory floor without bedding material. Three major phases were considered to complete the study, which included: (1) experimental program; (2) finite element modeling; and (3) development of distribution width and the determination of shear capacity. The researcher's purpose was to conduct an analysis of the implementation of an inclusion program in three schools in a southeastern Georgia school district. The sample consisted of two elementary schools and one middle school. One elementary school was implementing inclusion for the first time and consisted of 586 students with 50 staff members serving a mixed population, racially, economically, and socially. The second elementary school consisted of 504 students with 50 staff members serving a mixed population, but with a slightly higher economic and social status than the previously mentioned elementary school. Two-loop Bethe logarithms are calculated for excited P and D states in hydrogenlike systems, and estimates are presented for all states with higher angular momenta. These results complete our knowledge of the P and D energy levels in hydrogen at the order of α8 mec2, where me is the electron mass and c is the speed of light, and scale as Z6, where Z is the nuclear charge number. Our analytic and numerical calculations are consistent with the complete absence of logarithmic terms of order (απ)2 (Zα)6 ln [(Zα)-2] …

As small form factor hard disk drives (HDD) are increasingly used in portable consumer devices, the performance of the HDD in daily activity is highly concerned. In this paper, the soft failure of the hard disk drive under forced vibration is investigated. To investigate the cause of the soft failure, experimental frequency analysis was conducted. Modal analysis of HDD was completed by experiment and verified by FEM simulations and the result was compared to the frequency response result. Studies show that the vibration modes of head suspension assembly (HSA) and disk platter at higher resonant frequencies do not directly relate …
