After 14 years of unconscionable wrath against local civilians, including enforced recruitment of thousands of child soldiers, the rebel group The Lord’s Resistance Army (“LRA”) was offered amnesty by the Ugandan government in 2000. However, as the conflict continued unabated, the Ugandan government, for the first time in the history of the Court, referred its case to the International Criminal Court (“ICC”). The ICC Prosecutor announced the beginning of an investigation and issued warrants for seven top LRA officers in October of 2005. The potential ICC prosecution raises many questions about the jurisdiction of the new court, including whether the …

Electrospray ionization (ESI) has become one of the most commonly used ionization techniques for mass spectrometry (MS) and ion mobility spectrometry (IMS), and efforts continue to improve its performance. ESI-MS is most recognized for its wide application to biomacromolecules where high sensitivity is of paramount importance. However, the major limitation in sensitivity with ESI-MS is due to its low ion transmission efficiency from the ESI source into the sampling orifice and through any stages utilized for transfer of ions from atmosphere to vacuum in the MS. Developing Development Theory: Law & Development Orthodoxies And The Northeast Asian Experience, John K.M. Ohnesorge

None of the orthodox theories about law and economic development produced in recent decades has been based on a study of the "miracle" economies of Northeast Asia, nor have any of these orthodoxies seriously been tested against the Northeast Asian experience of law and development. This article conducts such a test, finding that none of these orthodoxies fares well when its claims are tested against the Northeast Asian experience. Rather than using Northeast Asia's experience to produce yet another orthodoxy, however, this article instead proposes rethinking how we understand the task of legal technical assistance, a rethinking which is based …

Recent scholarship has focused on Boyce's relationship with Hapgood as the prototype of the modern open marriage. In her book, Intimate Warriors, editor Ellen Kay Trimberger uses portions of both writers' works to argue that the couple's "warfare" (33)-over his affairs, her desire to work, and his aversion to working at all-enhanced her creativity and kept the marriage alive. l Carol DeBoer-Langworthy takes the opposite view. In her book, The Modern World of Neith Boyce, she argues that Boyce's difficult marriage jeopardized her health, sapped her creative energy, and ultimately shortened her career. Two Spirits, Two Eras, Same Sex: For A Traditionalist Perspective On Native American Tribal Same-Sex Marriage Policy, Jeffrey S. Jacobi

University of Michigan Journal of Law Reform

Recently, several states amended their constitutions to define marriage as only a union between a man and a woman. Many Native American Indian tribal governments thereafter also adopted laws prohibiting homosexual marriages. However, this new policy conflicts with traditional tribal values. This Note shows that historically many tribes accepted and even honored same-sex unions. This Note proposes that tribes consider their traditions as they existed before European contact, and argues that, for some tribes, same-sex civil unions are a historically and culturally appropriate answer to the modern objections to same-sex marriage.

This article discusses how rape and other forms of sexual violence have been prominent features of the ongoing attacks (from 2003 to the present) committed by government of Sudan (GoS) troops and the Janjaweed (Arab militia) in Darfur, Sudan. It first provides a historical overview of wartime rape in law and society, then discusses some of the many reports (including the UN’s Commission of Inquiry on Darfur) that have documented the perpetration of rape and other forms of sexual violence in Darfur by GoS troops and Janjaweed. Genocide Studies and Prevention: An International Journal

The article presents a comparative analysis of genocide in Rwanda and Darfur. The first half of the article examines the patterns and origins of violence in both cases and uses the comparison to generate some theoretical inferences about the causes of genocide. The analysis finds that both cases demonstrate a similar character of violence but that in Rwanda the violence was more intense, more exterminatory, and more participatory than in Darfur. Both episodes took place in the midst of civil war, in periods of political transition, in countries with histories of ethnic nationalism, and in areas where the conflicting ethnic …

Increased corporate-sponsored university research and professorial consulting has caused medical, psychological, and other scientific journals to adopt conflicts-of-interest disclosure policies. This study examines editorial policies concerning conflicts of interest at communication journals in the context of Habermas’s theory of communicative action. The results show that communication journals do not have the same mandatory disclosure requirements that journals of other disciplines have. In this regard, communication research journals are similar to the mass media. Consequently, the article suggests that disclosure policies are needed if communication research journals are to function as part of a larger dialogic process. To explore the implications of riders - provisions added to appropriation bills that "ride" on the underlying bill - on the United States' continued military force in Iraq, the author draws three hypotheticals, each focusing on the debate surrounding the policy and political disputes raised by the use of such riders. A "withdrawal" rider, which would authorize funding only if there exists a plan to withdraw American ground troops by a set deadline, remains the most important - and controversial - rider. This Strategic Forum analyzes the institutional challenges facing strategic decisionmaking within the U.S. Department of Defense and proposes reforms to improve how senior leaders make and support decisions. It highlights how existing processes — designed to be rational and methodical — are often undermined by bureaucratic stovepipes, consensus-oriented products, and limited integration of analytic support. The paper argues for the creation of a dedicated Decision Support Cell reporting directly to the Secretary of Defense to provide integrated rational analyses and to enhance intuitive decisionmaking through exercises and shared experience.
