When the Supreme Court first grappled with prior restraints and the rights of reporters to attend criminal trials, it looked to history and the societal functions of the media in establishing presumptions that favored the press. This Article follows a similar path. Part II sketches the role of leaks in governance between the adoption of the Constitution and World War II to underscore the integral role leaks have played in the nation's political communication. Part III shows that the general law of journalists' confidentiality before and after Branzburg developed with little regard for the distinct institutional contributions of leaks. Part …

At the Battle of Gettysburg, Robert E. Lee made a mistake that doomed the hopes of the Confederate States of America to compel the United States to sue for peace. Why one of the great generals of his time made such a blunder continues to be a topic of research and intense debate. Lee said little at the time or afterward to justify his decision to launch what has become known as Pickett’s Charge, so analysis must be inferential and inconclusive. In an effort to predict and avert threats to national security, governments in general, and that of the United States in particular, have devoted considerable resources to developing technological systems that gather information about individuals. In the past five years, the U.S. government has collected information about the movement of individuals across and within its national borders from various sources, including border security stations, law enforcement officials, and immigration authorities. The decision of Brown v. Board of Education to desegregate schools in the United States fifty-two years ago was approached with hesitation by many school districts. For half of those fifty-two years, school desegregation proceeded at a snail's pace in southern and northern school districts as civil rights lawyers waged trench warfare in federal courts. Even though it was "law," many school districts ignored the mandate or suffered from the "with all deliberate speed" syndrome. The focus of this study was to investigate the educational segregation and desegregation of students in the Edinburg Consolidated Independent School District (ECISD).

Establishing A Historic Benchmark For Rimrock Pine Communities At New River Gorge National River, West Virginia, Richard Stockton Maxwell

The structure and composition of a rimrock pine community was studied in the New River Gorge National River, West Virginia. A forest survey found that the overstory was dominated by Pinus virginiana, Nyssa sylvatica, Oxydendrum arboreum, Acer rubrum, and Quercus spp. The importance of Pinus virginiana decreased rapidly with increasing distance from the cliff edge and was replaced by hardwood competitors. Regeneration of Pinus virginiana (∼4,200 stems/ha) was deemed inadequate to sustain a pine forest except on the harshest sites near the cliff edge. A 108-year (1897-2005) fire chronology was constructed from 51 fire scars recorded by 23 pines along …

West Virginia University's Center for Industrial Research Applications (CIRA) was sponsored by the United States Army National Guard (USANG) and the Department of Defense (DOD) to design a standardized, articulating sensor platform for the C-130 Hercules military aircraft. This sensor platform was to be capable of in-flight deployment and capable of facilitating a diverse spectrum of sensor configurations in order to aid in surveillance and reconnaissance for counter narco-terrorism efforts. Swarmed Unmanned Aerial Vehicles (UAVs) with Automatic Target Recognition (ATR) technology are becoming an important element of electronic warfare. The advantages of UAVs over piloted vehicles have increased the need to develop robust and reliable ATR algorithms. Various issues like changing weather, camouflage, low contrast and resolution, clutter, inadequate databases place a limit on the performance capabilities of a typical ATR algorithm. In an effort to deal with these issues, a correlation-based algorithm is proposed in this thesis. The American-flag merchant marine became the world's largest during World War II. U.S.-flag ships carried most of the nation's commerce, and the world looked to America for shipping strength. After the war, the different parties in the maritime industry began to fight for their individual interests as the American standard of living became the highest in the world. The federal government hesitated to step in and calm the growing discord, and several decades passed as American maritime policy stagnated. Both student activism and Internet use by students are among the fastest growing variables in national reports of student engagement (Astin, 2004; Levine & Cureton, 1998b). This study introduces the term estudentprotest to describe how contemporary student activists use information and communication technologies (ICTs) for protest. A sequential mixed methods design (Creswell, 2003) was utilized. This approach involved obtaining statistical information from a sample for descriptive and outcome analyses, using the results to suggest nodes for an investigation of social networks, and finally interviewing individuals to explore those results in more depth. The National Trust for Historic Preservation defines heritage tourism as: “traveling to experience the places and activities that authentically represent the stories and peoples of the past and present. It includes irreplaceable historic, cultural, and natural resources.”1 Heritage tourism is a lucrative industry in the United States. Born in New York City to what he describes as “a very privileged childhood…in every possible way,” J. Vinton (“Vint”) Lawrence attended Phillips Exeter Academy and Princeton University. Recruited by the CIA, he was sent to Laos in the very early days of “Operation Momentum,” the campaign to train and arm the Hmong to fight against Communist forces. A new method for design and scale-up of thermocatalytic processes is disclosed. The method is based on optimizing process energetics by decoupling of the process energetics from the DRE for target contaminants. The technique is applicable to high temperature thermocatalytic reactor design and scale-up. The method is based on the implementation of polymeric and other low-pressure drop support for thermocatalytic media as well as the multifunctional catalytic media in conjunction with a novel rotating fluidized particle bed reactor.
