Translated Opinions

Facts: The appellant in CA 11152/04 (‘the appellant’) was injured in a road accident. As a result of the accident, his sexual functioning was impaired. The main issue addressed by the court regarded the compensation awarded to the appellant for the use of escort services.

Held: The appellant did not succeed in proving, from a factual viewpoint, a need for resorting to escort services. In addition, the law of compensation does not recognize the possibility of pecuniary damages for the expenses of using escort services. Compensation for impairment of sexual functioning can be awarded for pecuniary loss, i.e. expenses for …

A Comparison Of The Perceived Performance Of Mentoring Functions Of National Boardcertified And Non-National Board-Certified Teachers With Their Protégés, Amy Jo Smith Wilson

USF Tampa Graduate Theses and Dissertations

National Board-certified (NBC) teachers are recognized as accomplished teachers who have met the National Board’s stringent standards. These teachers are encouraged to serve as mentors to novice teachers and veteran teachers in candidacy for National Board Certification. This study identified and compared the career and psychosocial mentoring functions that NBC teacher mentors and non-NBC teacher mentors perceived they provided to their protégés at the elementary grade levels. National Board-certified protégés’ perceptions of having the functions provided were compared with those of their teacher mentors and with the protégés of non-NBC teacher mentors.

The research was conducted in a large urban …

Compulsory Labor In A National Emergency: Public Service Or Involuntary Servitude? The Case Of Crippled Ports, Michael H. Leroy Oct 2006

Compulsory Labor In A National Emergency: Public Service Or Involuntary Servitude? The Case Of Crippled Ports, Michael H. Leroy

ExpressO

The 13th Amendment ban on involuntary servitude has new relevance as the U.S. grapples with national emergencies such as catastrophic hurricanes, flu pandemics, and terrorism. This Article considers work refusal and coerced work performance in life-threatening employment contexts. Overwhelmed by fear, hundreds of police officers and health care workers abandoned their jobs during Hurricane Katrina. Postal clerks worked against their will without masks in facilities with anthrax. A report by Congress worries that avian flu will cause sick and frightened medical personnel to stay away from work, thus jeopardizing a coherent response to a crisis.

How far can the U.S. …

The Shell-Shocked Hobbit: The First World War And Tolkien's Trauma Of The Ring, Michael Livingston Oct 2006

The Shell-Shocked Hobbit: The First World War And Tolkien's Trauma Of The Ring, Michael Livingston

Mythlore: A Journal of J.R.R. Tolkien, C.S. Lewis, Charles Williams, and Mythopoeic Literature

Describes the Battle of the Somme and Tolkien’s participation in it. Pointing out the parallels between the battle-scarred landscapes of Northern Europe and Middle-earth, Livingston notes that while they are worth cataloging, it is Tolkien’s nuanced and sympathetic depiction of Frodo’s post-traumatic stress disorder that is the most compelling result of the author’s war experiences. Provides a good overview of Tolkien’s war experiences and his literary response to them.

With One Stroke Of The Pen: How Can Wildlife Extension Specialists Involve Developers And Policy-Makers In Wildlife Conservation?, Mark Hostetler Oct 2006

With One Stroke Of The Pen: How Can Wildlife Extension Specialists Involve Developers And Policy-Makers In Wildlife Conservation?, Mark Hostetler

Triennial National Wildlife and Fisheries Extension Specialists Conference: 11th (2006)

Residential developments have a huge impact on natural resources and wildlife, and sustainable or “green” communities are beginning to be built throughout the United States with goals to conserve wildlife habitat, to create healthy lifestyles, and to promote a sense of community. Buzzwords can be heard in the media and in town meetings: sustainability, smart growth, new urbanism, low impact development, and conservation subdivisions. Ultimately, with one stroke of a pen, developers and policymakers can determine how a community will look and feel for many years to come. Plus, citizens make day-to-day decisions that determine whether a community operates as …

Approaches For Delivering Integrated Forestry And Wildlife Extension Programs: The Missouri Woodland Steward Short Course And Missouri Master Wildlifer Program, Robert A. Pierce Ii, H. E. Stelzer

Triennial National Wildlife and Fisheries Extension Specialists Conference: 11th (2006)

Extension educational programs related to the stewardship of Missouri’s natural resources have been identified as a priority in the MU College of Agriculture Food and Natural Resource’s “Extension Base Program” (MU CAFNR 2001). Citizens own approximately 94% of the land in the state and therefore manage most of the natural resource base, including forests, agricultural lands, prairies and grasslands, wetlands, streams, and other natural habitats. Abundant natural resources, renewable and nonrenewable alike, provide for agriculture and timber production as well as recreational opportunities, each of which are directly or indirectly responsible for a majority of the economic activity within Missouri. …

The Case For American History In The Law-School Curriculum, Harold P. Southerland Oct 2006

The Case For American History In The Law-School Curriculum, Harold P. Southerland

ExpressO

This article argues for the teaching of American History throughout the first year of law school. I do not believe that students can fully understand the cases they are reading in other courses without a knowledge of environing context. Understanding American History -- which is many respects doesn't paint a flattering picture -- may also help students in making fundamental choices about what role they wish to play in their careers as lawyers. I believe it is time to recognize that too much of the profession is run as a business and not as a noble calling dedicated to helping …
