Anti-Terrorist Finance In The United Kingdom And United States, Laura K. Donohue
Anti-Terrorist Finance In The United Kingdom And United States, Laura K. Donohue
Georgetown Law Faculty Publications and Other Works
This article adopts a two-tiered approach: it provides a detailed, historical account of anti-terrorist finance initiatives in the United Kingdom and United States—two states driving global norms in this area. It then proceeds to a critique of these laws. The analysis assumes—and accepts—the goals of the two states in adopting these provisions. It questions how well the measures achieve their aim. Specifically, it highlights how the transfer of money laundering tools undermines the effectiveness of the states' counterterrorist efforts—flooding the systems with suspicious activity reports, driving money out of the regulated sector, and using inappropriate metrics to gauge success. This …

Out Of Thin Air: Using First Amendment Public Forum Analysis To Redeem American Broadcasting Regulation, Anthony E. Varona
Out Of Thin Air: Using First Amendment Public Forum Analysis To Redeem American Broadcasting Regulation, Anthony E. Varona

American television and radio broadcasters are uniquely privileged among Federal Communications Commission (FCC) licensees. Exalted as public trustees by the 1934 Communications Act, broadcasters pay virtually nothing for the use of their channels of public radiofrequency spectrum, unlike many other FCC licensees who have paid billions of dollars for similar digital spectrum. Congress envisioned a social contract of sorts between broadcast licensees and the communities they served. In exchange for their free licenses, broadcast stations were charged with providing a platform for a "free marketplace of ideas" that would cultivate a democratically engaged and enlightened citizenry through the broadcasting of …
Principles Of Fairness For International Economic Treaties: Constructivism And Contractualism, John Linarelli
Principles Of Fairness For International Economic Treaties: Constructivism And Contractualism, John Linarelli
Scholarly Works
No legal system deserving of continued support can exist without an adequate theory of justice. A world trade constitution cannot credibly exist without a clear notion of justice upon which to base a consensus. This paper examines two accounts of fairness found in moral philosophy, those of John Rawls and Tim Scanlon. The Rawlsian theory of justice is well-known to legal scholars. Scanlon's contractualist account may be less well-known. The aim of the paper is to start the discussion as to how fairness theories can be used to develop the tools for examining international economic policies and institutions. After elaborating …

Perceptions Of The Value Of Problem-Based Learning Among Students With Special Needs And Their Teachers, Brian Robert Belland, P. A. Ertmer, K. D. Simons
Instructional Technology and Learning Sciences Faculty Publications
While problem-based learning (PBL) has been found to be effective with gifted and average students (Hmelo-Silver, 2004), little is known about its impact on students with special needs. This study examines the perceptions of middle-school students with mild, moderate, and severe disabilities and of their teachers regarding the value of participating in a PBL unit. The unit focused on the physical accessibility of a low-SES, rural community where the students’ school was located. We used the constant comparative method (Glaser & Strauss, 1967) to analyze interview data, and used observation data and artifacts to triangulate interview comments. Among the noteworthy findings …
Revisiting The Legal Link Between Genetics And Crime, Deborah W. Denno
Revisiting The Legal Link Between Genetics And Crime, Deborah W. Denno
Faculty Scholarship
Unwarranted constraints on the admissibility of genetics evidence in death penalty cases can undercut some defendants' efforts to fight their executions. For example, genetics evidence can help validate some traditionally accepted mitigating factors (such as certain psychiatric or behavioral disorders) that can otherwise be difficult for defendants to prove. By imposing unreasonable limitations on genetics arguments, the criminal justice system may be undermining the very principles and progressive thinking the cap on genetics evidence was originally intended to achieve. Part II of this article briefly reviews the facts and legal arguments in Mobley v. State. Part III addresses the primary …
Copyright, Commodification, And Culture: Locating The Public Domain, Julie E. Cohen
Copyright, Commodification, And Culture: Locating The Public Domain, Julie E. Cohen
Georgetown Law Faculty Publications and Other Works
The relationship between increased commodification and the public domain in copyright law is the subject of considerable controversy, both political and theoretical. The paper argues that beliefs about what legal definition the public domain requires depend crucially on implicit preconceptions about what a public domain is. When considered in broader historical context, the term public domain has a specific set of denotative and connotative meanings that constitute the artistic, intellectual, and informational public domain as a geographically separate place, portions of which are presumptively eligible for privatization. This idea meshes well with the current push toward commodification in copyright. The …
Defending And Despairing: The Agony Of Juvenile Defense, Abbe Smith
Defending And Despairing: The Agony Of Juvenile Defense, Abbe Smith
Georgetown Law Faculty Publications and Other Works
I believe there is no more important work than defending kids, especially those accused of serious crimes. The consequences of juvenile crime are increasingly severe, whether kids remain in the juvenile system or are prosecuted as adults. We lock up too many people in this country, many of whom are children. Surely, at the start of the twenty-first century - given our knowledge about the causes of juvenile delinquency and crime - we can do more than put troubled kids in cages. So, why not work with young offenders who are on their way to becoming adult clients, to try …
Anglo-American Privacy And Surveillance, Laura K. Donohue
Anglo-American Privacy And Surveillance, Laura K. Donohue
Georgetown Law Faculty Publications and Other Works
The United States’ Terrorism Surveillance Program represents just one of many expansions in surveillance since 9/11, as legal controls previously introduced to protect citizens’ privacy and to prevent the misuse of surveillance powers have been relaxed. What makes the situation qualitatively different now is not just the lowering of the bar: digitization and the rapid advancement of technology mean that the type and volume of information currently available eclipse that of previous generations. The issue is not confined to the United States. Despite the incorporation of the European Convention of Human Rights into British law, the United Kingdom also appears …
Statutory Interpretation In The Era Of Oira, Lisa Heinzerling
Statutory Interpretation In The Era Of Oira, Lisa Heinzerling
Georgetown Law Faculty Publications and Other Works
In recent years, the Office of Information and Regulatory Affairs (OIRA) within the Office of Management and Budget (OMB) has asserted a remarkable degree of authority over administrative agencies' rulemaking processes. One of the ways in which OIRA has exercised power over agencies has been to foist upon them its own views about the requirements of the statutes under which they operate. The most notable trend in this area has been OIRA's insistence on converting technology-based environmental laws into cost-benefit laws. In OIRA's hands, for example, the Clean Water Act ("the Act") is being transformed from a technology- based regime …

Cutaneous And Presumed Visceral Leishmaniasis In A Soldier Deployed To Afghanistan, James P. Woodrow, Joshua D. Hartzell, Jim Czarnik, David Brett-Major, Glenn Wortmann
Journal Articles: Epidemiology
Leishmaniasis has been frequently diagnosed in US military personnel returning from duty in Southwest Asia. The majority of cases have demonstrated cutaneous disease, although a few cases of visceral disease have been documented. We present the case of an immunocompetent, HIV-negative, US Army soldier who suffered both visceral and cutaneous manifestations of leishmaniasis after returning from deployment in Afghanistan. Overlap of cutaneous and visceral involvement is rare and has not been reported in our cohort. Latent Plasmodium vivax infection may have been an exacerbating cofactor. We discuss this case and present a review of the literature.

Profiling Of Lithium And Potassium Into Silicon, Ali M. Mousa
Turkish Journal of Physics
The profiling of Lithium and Potassium into Silicon doped by electro deposition from molten salts (LiBr, KI) has been studied for various time periods and deposition currents. For the samples studied, changes in the deposition time and current have significant effects on the conductivity type and sheet resistance variation. This has been attributed to the high value of solid solubility of Lithium and Potassium in Silicon. Additionally, surface concentration variation with depth is affected significantly by variation in deposition time, particular for samples with a deposition time of 7 minutes. A junction was found 156 microns from the surface. For …
Optical Pulse Distortion In Fibonacci-Class Multilayer Stacks, A Rostami, S. Matloub
Optical Pulse Distortion In Fibonacci-Class Multilayer Stacks, A Rostami, S. Matloub
Turkish Journal of Physics
Optical pulse distortion and propagation through quasi-periodic structures generally and especially for Fibonacci-class, is investigated analytically and simulated numerically. In this analysis, the transfer matrix method (TMM) for distortion evaluation is used. The simulated results for Fibonacci-class quasi-periodic structures and pure periodic multilayer stacks are compared. We show that the Fibonacci-class quasi-periodic structure has a large dispersion coefficient with respect to a similar case in the periodic structure. So, quasi-periodic structures will destroy the incident pulse shape for smaller stack length than a periodic case in a similar situation. Finally, using output power, the distortion limit can be estimated and …

Transient Photoconductivity In Amorphous Se-Ge-Ag System, R. S. Sharma, D. Kumar, A. Kumar
Transient Photoconductivity In Amorphous Se-Ge-Ag System, R. S. Sharma, D. Kumar, A. Kumar
Turkish Journal of Physics
Transient Photoconductivity measurements have been made in vacuum evaporated thin films of Se_{0.80 - x}Ge_{0.20}Ag_x at different intensities, temperatures and illumination times. The films exhibit long-lived residual photoconductivity, called persistent photoconductivity, with an extremely slow decay rate. The persistent photoconductivity (PPC) increases with an increase in intensity and illumination time. However, this quantity decreases with increase in temperature. These results indicate that the decay of photoconductivity is not only governed by the carrier trapped in the intrinsic defects but also gets affected by the light induced defect creation through structural changes The persistent photoconductivity effect is found to be suppressed …
Stagnation Point Flow And Heat Transfer Of A Micropolar Fluid In A Porous Medium, Hazem Ali Attia
Stagnation Point Flow And Heat Transfer Of A Micropolar Fluid In A Porous Medium, Hazem Ali Attia
Turkish Journal of Physics
The steady laminar flow in a porous medium of an incompressible non-Newtonian micropolar fluid impinging on a permeable flat plate with heat transfer is investigated. A numerical solution for the governing nonlinear momentum and energy equations is obtained. The effect of the porosity of the medium and the characteristics of the non-Newtonian fluid on both the flow and heat transfer is presented and discussed.

Dwba Of The Reaction ^0be(P, \Alpha )^6li At E_P = 18.6\Sim 50 Mev, S. E. Abdel-Kariem
Turkish Journal of Physics
The compound nucleus produced in the reaction ^9Be(p, \alpha)^6Li in the incident energy range E_p = 18.6 \sim 50 MeV is mainly occurred when its excitation energy is greater than the \alpha -particle threshold separation energy by about 20 MeV, strongly suggesting the reaction mechanism is a direct one-step process. To understand this phenomenon, we employ semi-microscopic zero-range distorted-wave Born approximation (DWBA) theory to analyse experimental data obtained in this energy range for the lower three ^6Li-states: ground state (1^+; 0); 2.186 MeV (3^+; 0); and 3.563 MeV (0^+; 1). The Kurath-Millener spectroscopic-factor amplitudes for the triton-cluster transfer are used …
Dimensional Crossover In Semiconductor Structures: From 3d Electron Transport To Ballistic Electrons In 1d, Karl-Fredrick Berggren
Dimensional Crossover In Semiconductor Structures: From 3d Electron Transport To Ballistic Electrons In 1d, Karl-Fredrick Berggren
Turkish Journal of Physics
Modern semiconductor technologies have made possible special devices in which a gradual dimensional crossover may be induced by means of applied electric fields. Two specific examples are described. The first one is a special GaAs field effect transistor in which the thickness of the active electron gas layer may be varied by external voltages. With decreasing layer thickness transverse states become quantized and by depopulating the corresponding subbands a tunable dimensional crossover from 3D to 2D is achieved. The second example describes how a 2D to 1D crossover may be obtained in high-mobility split-gate GaAs/AlGaAs heterostructures. Effects of interactions in …

Self-Assembled Nano-Structures On The Icosahedral Al-Pd-Mn Quasicrystal, Mehmet Erbudak, Jean-Nicolas Longchamp, Yves Weisskopf
Turkish Journal of Physics
A quasicrystal is a solid with an aperiodic atomic distribution, but displaying discrete diffraction pattern. At an interface where an ordinary crystal and a quasicrystal intersect, the lack of commensurability between the structures leads to misfits on atomic scale resulting in a wealth of novelties. Here, we present experimental observations on three essentially different cases: Al, Fe, and Si ultra-thin layers grown in vacuum on the pentagonal surface of an icosahedral Al-Pd-Mn quasicrystal. In all three cases, the growing layer decays into nm-size islands. Al is the major alloy component of the substrate material and provides a natural tool to …

Computational Studies On Mechanical Properties Of Carbon Nanotori, Tahi̇r Çağin, Guanghua Gao, William A. Goddard Iii
Turkish Journal of Physics
Carbon has diverse structures, especially (0-dimensional) fullerenes, (1-dimensional) tubes have generated great interest among scientists and technologists. Studies of the structures and properties of these low dimensional carbon molecules show tremendous potential for use in nanoscale device applications. Motivated by these exciting possibilities in finding new forms of carbon materials and their potential applications, we have designed hypothetical single wall carbon nano-toroids. Carbon toroids are also ideal in studying the elastic and plastic deformation behavior of nanotubes under bending loads. We can accurately correlate the behavior of the tubes to its uniform curvature. In this particular work we focused on …

Tkachenko Modes Of The Square Vortex Lattice In A Two-Component Bose-Einstein Condensate, M. Keçeli̇, M. Ö. Oktel
Turkish Journal of Physics
We study Tkachenko modes of the square vortex lattice of a two-component Bose-Einstein condensate (BEC) in the mean-field quantum Hall regime, considering the coupling of these modes with density excitations. We derive the hydrodynamic equations and obtain the dispersion relations of the excitation modes. We find that there are two types of excitations, gapped inertial modes and gapless Tkachenko modes. These modes have two branches which we call acoustic and optical modes in analogy with phonons. The former has quadratic while the latter has linear wave-number dependence in both inertial and Tkachenko modes. Acoustic Tkachenko mode is found to be …
