The Value Of Government Tort Liability: Washington State's Journey From Immunity To Accountability, Debra L. Stephens, Bryan P. Harnetiaux
Seattle University Law Review
Part I of this Article traces Washington's history with the common law doctrine of government immunity from tort liability. It also identifies other distinct common law immunities protecting executive, legislative, and judicial functions-immunities that lay dormant during the reign of sovereign immunity. Part II discusses the legislature's broad waiver of sovereign immunity in 1961 and the legislature's subsequent reaffirmation of the waiver. It also notes isolated instances in which the legislature has partially restored immunity or otherwise limited tort liability. Part III addresses the development of case law interpreting the scope of government tort liability in light of the legislative …

Corporate Investigations, Attorney-Client Privilege, And Selective Waiver: Is A Half-Privilege Worth Having At All?, Colin P. Marks

This article will explore both the various problems that arise with a policy that essentially mandates waiver of the attorney-client privilege as well as the limited appeal of the selective waiver theory as a compromise position. It concludes that selective waiver is inadequate in addressing the many problems created by policies that coerce waiver and that a more desirable solution is to eliminate or amend the governmental policies that coerce waiver. In today's highly punitive culture, perhaps Weldon Angelos' fifty-five-year sentence does not seem unusual. He's a 25-year-old man who was convicted in December 2003 of selling marijuana, possessing firearms while drug dealing, and money laundering. 3 The facts proven at trial are that on three occasions in June and July, 2002, Angelos sold eight one-ounce bags of marijuana for $350 each to a government informant. 4 The purchaser testified that a firearm was visible during two of these drug sales.5 Police seized another gun from Angelos' home five months later pursuant to a warrant.6 At no time was …

The study of information requirements for e-business systems reveals that the level of detail, granularity, format of presentation, and a broad range of information types are required for the applications. The provision of relevant information affects how e-business systems can efficiently support the business goals and processes. This paper presents an approach for determining information requirements for e-business systems (DIRES) which will allow the user to describe the core business processes, whose specification maps onto a business activity space. Since previous research in the information technology (IT) field focused on successes and failures of IT outsourcing (ITO) by organizations, this paper investigates the critical success factors (CSF) for IT outsourcing in the existing global environment. It is intended to provide assistance for the consideration of business professionals and IT managers when they make, examine or evaluate ITO decisions. Fifty four IT outsourcing CSFs were identified through an extensive literature review research. Information systems integration (ISI) represents the degree of cooperation in information system practices between business functions within a firm and between a firm and its trading partners. A key challenge to top management is the alignment of IS and business plans for the purpose of producing an IT-based competitive advantage. This study uses a well known communication theory to provide new insight into the impact of CEO and CIO planning participation on IS and business alignment via the convergence of views between the CEO and CIO regarding the current and future strategic impact of IT on the firm’s success. The slicing of Silicon wafer is a complex manufacturing process in producing the raw materials for electronic chips and requires the efforts to effectively monitor the stability in production line and ensure the quality for the products composed of different shapes and materials.
