Criminal Law Beyond The State: Popular Trials On The Frontier, Andrea Mcdowell

Before the civil war, “lynching” signified all forms of group-inflicted punishments, including vigilantism and mob killings. By this definition, lynchings happen in every country. Only in America, however, was lynching widespread and socially accepted. Scholars say this shows that the American commitment to due process often succumbed to “vigilante values,” that is, the desire for speedy, certain and severe penalties. They contend that vigilante values triumphed on the frontier, where courts were weak and vigilance committees strong. This article demonstrates that this view must be substantially qualified because due process was of great concern to Americans on the frontier, especially …

This essay considers the current debate in legal theory over the future of marriage. Should the state, as some scholars argue, privilege marriage because of the benefits it provides to society? Or should it, as others argue, distance itself from relationships between adults on the ground that adults should be left to order their own affairs? The essay argues that scholars involved in this debate have reached such diametrically different conclusions from one another because each side has focused on a particular, narrow range of goods at issue in these relationships. The article considers how liberal democracies and their courts should address disputes about children’s education when they arise in public schools. I argue that in a liberal democracy it is inevitable that there will be conflicts among parents, children, and the state’s interests with respect to public education. Given the legitimacy of claims by the community to have a say in how its future citizens should be educated; the equally legitimate claims of parents to have a say in how their own children should be educated; the need for children to develop the autonomy that liberalism demands; and the needs …

The selection of confounders and their functional relationship with the out- come affects exposure effect estimates. In practice, there is often substantial uncertainty about this selection, which we define here as “adjustment uncertainty.” We address the problem of estimating the effect of exposure on an outcome with focus on quantifying the effect of unknown confounders from a large set of potential confounders. We propose a general statistical framework for handling adjustment uncertainty in exposure effect estimation, a specific implementation called "Structured Estimation under Adjustment Uncertainty (STEADy)", and associated visualization tools. Theoretical results and simulation studies show that STEADy consistently estimates …

Domestic Violence Physical And Emotional In The Male Gay Community, Lee A. Rhodes

Domestic violence partner abuse both physical and emotional occurs in male same sex relationships at the same rate as in heterosexual relationships. The National Coalition of Anti-Violence programs conducted a 10-year study in 10 United States cities, which documented violence at a rate between 25-33% in same sex relationships. A 1991 study found that 46% of the women responding had experienced two or more incidents of physical violence in their relationships (Coleman, 1991). The Survivor Project in Portland, Oregon, is currently conducting a study of gay, lesbian, bisexual and transgender people regarding domestic violence. Domestic violence can begin as emotional …

Experimental And Modeling Investigations Of Biomass Particle Combustion, Hong Lu

This investigation provides a comprehensive analysis of entrained-flow biomass combustion processes. Experimental and theoretical investigations indicate how particle shape and size influence biomass combustion rates. Experimental samples include flake-like, cylinder-like, and equant (nearly spherical) shapes with similar particle masses and volumes but different surface areas. Samples of small (less than 500 µm) particles were passed through a laboratory entrained-flow reactor in a nitrogen/air atmosphere and a maximum reactor wall temperature of 1600 K, while large samples were reacted in suspension in a single particle furnace operated at similar conditions as the entrained-flow reactor. The purpose of this article is to understand how the public domain has been construed by the Courts. In the first part of the article, the different ways the public domain has been qualified and construed by scholars are briefly sketched out- for descriptive and introductory purposes to the analyzed cases law. In light of the different ways the public domain has been qualified and characterized by scholars, in the second part of the article, several well-known and often-quoted cases law are analyzed. Many soils of the McMurdo Dry Valleys (MDV), Antarctica, being old, hyperarid, and frigid, have accumulated abundant atmospheric salts over the last several million years. This salt repository offers an opportunity to study atmospheric chemistry (past and present), the origin and transport of ions in soils, the weathering activity of soils, and postdepositional soil-leaching processes within this unique environment. In particular, soil sulfate in the MDV is known to have multiple origins, but the precise proportions of different sulfate components remain elusive. Here we test a hypothesis that soil sulfate in the MDV is a predictable mixture of three major …

One important problem in genomic research is to identify genomic features such as gene expression data or DNA single nucleotide polymorphisms (SNPs) that are related to clinical phenotypes. Often these genomic data can be naturally divided into biologically meaningful groups such as genes belonging to the same pathways or SNPs within genes. In this paper, we propose group additive regression models and a group gradient descent boosting procedure for identifying groups of genomic features that are related to clinical phenotypes. Our simulation results show that by dividing the variables into appropriate groups, we can obtain better identification of the group …
