International Law And Rehnquist-Era Reversals, Diane Marie Amann Jun 2006

International Law And Rehnquist-Era Reversals, Diane Marie Amann

Scholarly Works

In the last years of Chief Justice Rehnquist's tenure, the Supreme Court held that due process bars criminal prosecution of same-sex intimacy and that it is cruel and unusual to execute mentally retarded persons or juveniles. Each of the later decisions not only overruled precedents set earlier in Rehnquist's tenure, but also consulted international law as an aid to construing the U.S. Constitution. Analyzing that phenomenon, the article first discusses the underlying cases, then traces the role that international law played in Atkins, Lawrence, and Simmons. It next examines backlash to consultation, and demonstrates that critics tended to overlook the …

Judicial Anarchy: The Admission Of Convictions To Impeach -State Supreme Court Interpretive Standards, 1990-2004, Dannye Holley

ExpressO

This is the second and sequential national study of an important evidence and criminal justice issue - the admission of convictions to impeach. It is a longitudinal national study of how state supreme courts have recently, over the last decade and one-half, evaluated this issue. The longitudinal study period of 1990-2004 mirros the study period of state rules on this issue which was undertaken in the first article. The study period was chosen for an explicit substantive rationale that was explained in that article and is repeated in this article. Because both articles are decade and one-half studies they will …

Voices Behind Bars: Correctional Education From The Perspective Of The Prisoner Student, Renee Hall May 2006

Voices Behind Bars: Correctional Education From The Perspective Of The Prisoner Student, Renee Hall

LSU New Orleans Theses and Dissertations

Approximately two million men and women are currently incarcerated in the nation's penitentiaries. Ninety percent of these inmates will eventually be released from prison. There is a need for prisons to provide services that will prepare these men and women for successful reentry into society. These services include education and vocational training. To determine the effectiveness of education/training, the perspective of the prisoner student is key to the field of correctional education. The voice of the prisoner student, however, is absent from the literature on prisoner education. This qualitative study examined the thoughts, feelings, experiences, and plans/goals of prisoner students …

Mugshot Exposure Effects: Retroactive Interference, Mugshot Commitment, Source Confusion, And Unconscious Transference, Kenneth A. Deffenbacher, Brian H. Bornstein, Steven D. Penrod May 2006

Mugshot Exposure Effects: Retroactive Interference, Mugshot Commitment, Source Confusion, And Unconscious Transference, Kenneth A. Deffenbacher, Brian H. Bornstein, Steven D. Penrod

Department of Psychology: Faculty Publications

More than 25 years of research has accumulated concerning the possible biasing effects of mugshot exposure to eyewitnesses. Two separate metaanalyses were conducted on 32 independent tests of the hypothesis that prior mugshot exposure decreases witness accuracy at a subsequent lineup. Mugshot exposure both significantly decreased proportion correct and increased the false alarm rate, the effect being greater on false alarms. A mugshot commitment effect, arising from the identification of someone in a mugshot, was a substantial moderator of both these effects. Simple retroactive interference, where the target person is not included among mugshots and no one in a mugshot …

The Right To Be Hurt. Testing The Boundaries Of Consent., Vera Bergelson May 2006

The Right To Be Hurt. Testing The Boundaries Of Consent., Vera Bergelson

Rutgers Law School (Newark) Faculty Papers

People's right to consent to pain, injury or death has always been one of the most controversial issues in criminal law and moral philosophy. In recent years, that issue has moved to the forefront of public, legislative, and academic debates in the United States and abroad due to a series of high-profile criminal trials, which involved consenting victims in various contexts--from sadomasochism and cannibalism to experimental medical treatment and mercy killing.

Currently, American criminal law does not recognize consent of the victim as a defense to bodily harm, except in a few historically defined circumstances. That rule has been criticized …

The War On Terror, Local Police, And Immigration Enforcement: A Curious Tale Of Police Power In Post-9/11 America, David A. Harris May 2006

The War On Terror, Local Police, And Immigration Enforcement: A Curious Tale Of Police Power In Post-9/11 America, David A. Harris

ExpressO

In post-9/11 America, no goal ranks higher for law enforcement than preventing the next terrorist attack. This is as true for local police departments as it is for the FBI, and police in cities. At the same time, many advocates of tightening U.S. immigration enforcement have recast their efforts as national security and anti-terrorism campaigns. Thus, these advocates and their many allies in the current administration and in Congress have called for local police to become involved in enforcing immigration law. Officials in both the executive and legislative branches of the federal government have taken a number of actions designed …

Still Striking Foul Blows, Donald E. Wilkes Jr. May 2006

Still Striking Foul Blows, Donald E. Wilkes Jr.

Popular Media

Nearly three-quarters of a century ago, the Supreme Court of the United States, expounding on the legal and ethical responsibilities of a prosecutor, announced that “while he may strike hard blows, he is not at liberty to strike foul ones. It is as much his duty to refrain from improper methods calculated to produce a wrongful conviction as it is to use every legitimate means to bring about a just one.” Berger v. United States, 295 U.S. 78, 88 (1935).
