Professional Integrity In Higher Education: Behind The Green Curtain In The Land Of Oz, Gordon A. Crews, Angela D. Crews Apr 2006

Professional Integrity In Higher Education: Behind The Green Curtain In The Land Of Oz, Gordon A. Crews, Angela D. Crews

Criminal Justice Faculty Research

This article discusses concerns related to professional integrity in academics and to the use of collegiality as an informal criterion for employment and evaluation decisions. We question the nature of the educational enterprise and the academic environment within which both students and faculty operate. We use the AAUP Statement on Professional Ethics to guide our examination of collegiality, and the three traditional areas of faculty evaluation (teaching, scholarship, and service), as they relate to professional integrity. We discuss potential pitfalls in situations involving integrity concerns, and suggest that the use of collegiality in professional decisions is more prevalent and potentially …

A New Perspective On Aggression In The Schools: Exploring Parental Aggression Towards Teachers, Lisa Hutchinson Wallace, David May Apr 2006

A New Perspective On Aggression In The Schools: Exploring Parental Aggression Towards Teachers, Lisa Hutchinson Wallace, David May

Kentucky Justice and Safety Research Bulletin

While a substantial amount of research has been devoted to identifying the causal influences and perpetrators of delinquency and victimization among students in the public school setting, similar literature focusing on aggression against teachers is typically concerned only with those instances where the students are the perpetrators. In an exploratory effort to add to that literature, we use data collected from a sample of 544 public school teachers in Kentucky to examine teacher perceptions of the prevalence, predictors, and consequences of problematic parental behavior in schools. Our results suggest, within the limitations of the sample under study, a substantial minority …

A Cost Study Of Gaps In Substance Abuse Treatment Services In Nebraska, R. K. Piper, Jerry Deichert

Past Publications

This internal report has been prepared as part of the larger Methamphetamine Treatment Facility Feasibility Study conducted by the College of Public Affairs and Community Services for the Nebraska State Legislature. The major purposes of this report are as follows: 1) to integrate previously submitted working findings and tables into a single “stand-alone” document and 2) to provide an overview and context for the findings that will be useful to technical writers, faculty, staff and graduate assistants who are responsible for preparing the final report for the legislature.

The Political Economy Of Application Fees For Indigent Criminal Defense, Wayne A. Logan, Ronald F. Wright Apr 2006

The Political Economy Of Application Fees For Indigent Criminal Defense, Wayne A. Logan, Ronald F. Wright

Scholarly Publications

In this article, we trace the origin and spread of state laws designed to make indigent criminal defendants pay, up-front, a portion of the costs of their state-appointed counsel. These co-pays, which can range from $10 to over $200, are part of the increasingly popular pay-as-you-go movement, requiring criminal defendants to defray the system costs of their prosecution and punishment.

On their face, such laws would appear to be a natural target of vigorous resistance by the defense bar. This turns out to be only half true, however, for it is often the leaders of public defense organizations, faced with …

Adult Attachment As A Risk Factor For Intimate Partner Violence, Christine L. Pearson Apr 2006

Adult Attachment As A Risk Factor For Intimate Partner Violence, Christine L. Pearson

McNair Scholars Research Journal

This study examined the relationship between intimate partner violence and adult attachment in a sample of 35 community couples. Both partners’ attachment anxiety and attachment avoidance were examined simultaneously as predictors of male-perpetrated verbal and physical intimate partner violence. Results from hierarchical regression analyses indicated high levels of female attachment anxiety predicted high levels of male-perpetrated verbal and physical violence. In contrast, male attachment was not predictive of male-perpetrated violence. These findings suggest for females, fear of abandonment and rejection may be a risk factor for becoming a victim of violence. Alternatively, exposure to violence may contribute to the development …

Capital Campaign To Mark Clags's 15th Anniversary, Paisley Currah

Center for LGBTQ Studies (CLAGS)

It may seem hard to believe, but when the new year rolled in, CLAGS turned 15. In 1991, CLAGS opened as the first university-based research center for what was then called "lesbian and gay studies" in the US. It's been a heady, infectiously exciting, and sometimes contentious 15 years.

Evolution And Denial: State Sentencing After Blakely And Booker, Steven L. Chanenson, Daniel F. Wilhelm Apr 2006

Evolution And Denial: State Sentencing After Blakely And Booker, Steven L. Chanenson, Daniel F. Wilhelm

Working Paper Series

Justice Louis Brandeis famously described the states as laboratories where individual jurisdictions can experiment with various legal strategies. In the wake of Blakley v. Washington, and United States v. Booker those laboratories have been working overtime. Since June 2004, both state legislatures and state courts have grappled with the significance of the United States Supreme Court's treatment of the Sixth Amendment in sentencing. It is unsurprising, given the extraordinary significance and potential reach of Blakely and Booker, that this Herculean task has produced divergent results.

Although there are many potential ways to sort those results, for the purposes of these …

Adult Punishment For Juvenile Offenders: Does It Reduce Crime?, Richard E. Redding Apr 2006

Adult Punishment For Juvenile Offenders: Does It Reduce Crime?, Richard E. Redding

Working Paper Series

This chapter discusses the research on the general and specific deterrent effects of transferring juveniles for trial in adult criminal court, identifies gaps in our knowledge base that require further research, discusses the circumstances under which effective deterrence may be achieved, and examines whether there are effective alternatives for achieving deterrence other than adult sanctions for serious juvenile offenders. As a backdrop to this analysis, the chapter first examines the role of public opinion in shaping the get tough policies, and how policy makers have misunderstood and perceived support for these policies.

Identifying Individual And Group Effects In The Presence Of Sorting: A Neighborhood Effects Application, Patrick Bayer, Stephen L. Ross Apr 2006

Identifying Individual And Group Effects In The Presence Of Sorting: A Neighborhood Effects Application, Patrick Bayer, Stephen L. Ross

Economics Working Papers

Researchers have long recognized that the non-random sorting of individuals into groups generates correlation between individual and group attributes that is likely to bias naive estimates of both individual and group effects. This paper proposes a non-parametric strategy for identifying these effects in a model that allows for both individual and group unobservables, applying this strategy to the estimation of neighborhood effects on labor market outcomes. The first part of this strategy is guided by a robust feature of the equilibrium in the canonical vertical sorting model of Epple and Platt (1998), that there is a monotonic relationship between neighborhood …

United States V. Booker: The Presumption Of Prejudice In Plain Error Review, Deborah S. Nall Apr 2006

United States V. Booker: The Presumption Of Prejudice In Plain Error Review, Deborah S. Nall

Chicago-Kent Law Review

United States v. Booker created a sea change in the law by rendering the federal sentencing guidelines advisory rather than mandatory. Although it is clear that federal appellate courts are to use the plain error standard when Booker error is raised for the first time on direct appeal, the Supreme Court of the United States offers no guidance in Booker for the proper interpretation of the third plain error prong, when the error prejudices a defendant's substantial rights. This omission has created an intercircuit split over the correct application of the substantial rights prong of plain error review in cases …
