Analyzing The International Criminal Court Complementarity Principle Through A Federal Courts Lens, Ada Y. Sheng
Analyzing The International Criminal Court Complementarity Principle Through A Federal Courts Lens, Ada Y. Sheng
ExpressO
The signing of the Rome Statute that created the International Criminal Court (ICC) was viewed by many in the international law community as a constitutional moment not unlike the passage of the Judiciary Act of 1789. In giving birth to a new type of legal institution, however, the Rome Statute created a void in the ability of any existing body of law to precisely convey the nature of the ICC. The Court is neither in a direct vertical nor horizontal relationship to State courts, with the result that traditional international or national legal norms do not apply. The UN referral …

Shielding Journalist-“Bloggers”: The Need To Protect Newsgathering Despite The Distribution Medium, Laura Durity
Shielding Journalist-“Bloggers”: The Need To Protect Newsgathering Despite The Distribution Medium, Laura Durity
Duke Law & Technology Review
The failure to agree on a sufficiently narrow definition of "journalist" has stalled efforts to enact a federal shield law to legally protect reporter-source communications from compelled disclosure in federal court. The increasing use of the Internet in news coverage and the greater reliance by the public on the Internet as a news source creates further problems as to who should qualify for federal shield law protection. This iBrief argues that a functional definition of "journalist" can be created to shield journalists from compelled source disclosure so as to protect the free flow of information to the public, but limits …
Gender Differences In Age Of Onset For Delinquency:Risk Factors And Consequences, Laura M. Gulledge
Gender Differences In Age Of Onset For Delinquency:Risk Factors And Consequences, Laura M. Gulledge
USF Tampa Graduate Theses and Dissertations
The age of onset of delinquency has long been viewed as a primary indicator for further delinquency and criminality. However, studies on the risk factors for onset, and future delinquency have focused predominantly on males. The purpose of this study was to explore gender differences and similarities in risk factors for onset and frequency of arrest. The data used in these analyses were from a longitudinal study, Pathways to Adulthood: A Three Generational Urban Study, 1960-1994. Sixty-six percent (N=1,758) of the eligible children completed the final survey. Of these children, only 515 were used in this particular study because they …

Entrapment By Numbers, Dru Stevenson
Entrapment By Numbers, Dru Stevenson
ExpressO
This essay analyzes emerging trends in entrapment law, and is the first to describe the declining numbers of reported cases that involve the entrapment defense. This phenomenon is attributed to decreasing levels of uncertainty in the rules pertaining to the defense, and to discreet procedural issues. The shifting degrees of certainty in penal rules, which have become increasingly mechanical and mathematical over time, are shown to disfavor certain defendants inherently, to the point of being a snare or source of “entrapment” themselves for these individuals. Marriage Mimicry: The Law Of Domestic Violence, Ruth Colker
Marriage Mimicry: The Law Of Domestic Violence, Ruth Colker
William & Mary Law Review
In this Article, Professor Colker argues that the legal system does not simply privilege those in marital relationships but has now begun to privilege those in "marriage-like" relationships through what she terms a marriage-mimicry model. She uses the law of domestic violence to critique this model. She traces the haphazard development of the law of domestic violence and argues that it has served to underprotect many of the victims of domestic violence because lawmakers have reflexively only provided legal recourse for those in marriage-like relationships without asking who is most in need of legal protection. She argues that the legal …
