Exploring Cultural Competence In The Lived Experience Of Instructional Designers, Paul Clinton Rogers Mar 2006

Exploring Cultural Competence In The Lived Experience Of Instructional Designers, Paul Clinton Rogers

Theses and Dissertations

There has been a limited amount of research concerning culture and online education. Although human beings have the ability to transcend past and current environments, helping professions are recognizing the influence of cultural epistemologies on themselves and those they intend to serve. The purpose of this study was to explore the nature of additional challenges and concerns present when designing online instruction in a cross-cultural context. The data collected in this study stands as preliminary work to creating a substantive theory regarding the importance of cultural influences in the thinking, practice and lived experience of instructional designers, specifically those who …

A Unified Theory Of Constitutional Facts, David L. Faigman Mar 2006

A Unified Theory Of Constitutional Facts, David L. Faigman

ExpressO

Facts play an essential role in constitutional cases, ranging from giving meaning to the text’s words to giving those words operational effect. Yet the Supreme Court does not take facts seriously, preferring to see them as a constituent part of doctrine. The Court does not find facts, it interprets them to conform to, or buttress, conclusions reached on other grounds. This constructive view of facts has the salutary effect of consistency, in that doctrine need not change as facts, or our knowledge of the facts, change. This consistency comes at a cost, however, for doctrine built on erroneous factual premises …

Sex Torts, D A. Pollard Mar 2006

Sex Torts, D A. Pollard

ExpressO

America has a serious sexual problem. The sexual practices of a small percentage of Americans has created an unprecedented disease rate that is costing the American public about $20 billion per year. Lawsuits seeking damages for sexual disease transmission are on the rise, yet current sex tort law is mired with anti-heartbalm sentiment, is unpredictable, and is failing as a tool of deterrence, compensation, and education. This Article discusses the gravity of the sexual disease crisis, part of which is the public’s incredible ignorance about the rate of sexual disease, and tort law’s failure to do its part to help …

Principles Of U.S. Family Law, Vivian E. Hamilton Mar 2006

Principles Of U.S. Family Law, Vivian E. Hamilton

ExpressO

What explains U.S. family law? To answer this question, this Article undertakes a conceptual analysis of the legal practices that govern families. This analysis has yet to be done, and its absence hamstrings constructive thought on our family law. The Article develops a typology that conceptualizes U.S. family law and exposes its underlying principles: First, it identifies the significant elements, or rules, of family law. Second, it demonstrates that these rules reflect or embody four important concepts – conjugality, privacy (familial as well as individual), contract, and parens patriae. Finally, it shows that the concepts of family law in turn …

Immigration, The American West, And The Twentieth Century: German From Russia, Omaha Indian, And Vietnamese-Urban Villagers In Lincoln, Nebraska, Kurt Kinbacher Mar 2006

Immigration, The American West, And The Twentieth Century: German From Russia, Omaha Indian, And Vietnamese-Urban Villagers In Lincoln, Nebraska, Kurt Kinbacher

Department of History: Dissertations, Theses, and Student Research

The North American West is a culturally and geographically diverse region that has long been a beacon for successive waves of human immigration and migration. A case in point, the population of Lincoln, Nebraska -- a capital city on the eastern cusp of the Great Plains -- was augmented during the twentieth century by significant influxes of Germans from Russia, Omaha Indians, and Vietnamese. Arriving in clusters beginning in 1876, 1941, and 1975 respectively, these newcomers were generally set in motion by dismal economic, social, or political situations in their sending nations. Seeking better lives, they entered a mainstream milieu …

Nrea Report: Rural School Consolidation: History, Research Summary, Conclusions, And Recommendations, Joe Bard, Clark Gardener, Regi Wieland

The Rural Educator

The consolidation of rural schools in the United States has been a controversial topic for policy-makers, school administrators, and rural communities since the 1800s. At issue in the consolidation movement have been concerns of efficiency, economics, student achievement, school size, and community identity. Throughout the history of schooling in America, school consolidation has been a way to solve rural issues in the eyes of policy makers and many education officials. Today, faced with declining enrollments and financial cutbacks, many rural schools and communities continue to deal with challenges associated with possible school reorganizations and consolidations. This paper, developed by the …

Edward W. Chance Dissertation Award: The Transition Practices Of One County’S Rural Elementary School Districts And Their Receiving Independent School District, Stephen E. Smith

The Rural Educator

The purpose of this study was to describe the transition implementation experienced by rural elementary school district students entering the ninth grade at an independent school district, and to describe the ties to the school that exist among these same ninth grade students. This qualitative research involved interviewing 11 ninth grade students, six rural elementary school district counselors and/or administrators, and one independent school district counselor. Conclusions of the study revealed that the independent school district in the study does not have a structured transition implementation program to assist rural elementary school district students. Despite literature that supports the success …

A Technology Supported Induction Network For Rural Student Teachers, Sara Winstead Fry Mar 2006

A Technology Supported Induction Network For Rural Student Teachers, Sara Winstead Fry

The Rural Educator

Student teaching is a challenging period for preservice teachers as they make the transition from preparation to practice. Support from mentor teachers and university personnel can make this time easier, helping preservice teachers successfully integrate educational theory into their practice. Because of logistical, financial, and personnel limitations, many student teachers with rural placements receive inadequate support. The Technology Supported Induction Network (TSIN) was developed to address these issues by providing support and ongoing professional learning opportunities for preservice teachers through distance technology. A qualitative case study was used to investigate the TSIN’s impact on elementary level student teachers. Results indicate …

Demographic Trends In Rural And Small Town America, Kenneth M. Johnson

Carsey Publications

This report examines the changing demographics of rural America and shows that the makeup of rural America is changing as certain regions grow with the migration of retirees and baby boomers into amenity-rich areas. At the same time, other places face economic uncertainty as younger residents continue to leave in search of more opportunities. Racial and ethnic diversity, meanwhile, continues to increase.

Desperate Cities: Eminent Domain And Economic Development In A Post-Kelo World, Asmara Tekle Johnson Mar 2006

Desperate Cities: Eminent Domain And Economic Development In A Post-Kelo World, Asmara Tekle Johnson

ExpressO

Kelo v. City of New London unleashed an unprecedented legislative response when the Court upheld the use of eminent domain for private economic development as consistent with the Takings Clause of the Fifth Amendment. By exhibiting an extreme deference to the legislative branch and failing to consider the current model of economic development, in which “desperate” cities have seen their economic bases contract and have embarked on fervent urban revitalization campaigns as a result, the Kelo Court failed to take into account the immense influence that large corporate interests wield in the legislature. This influence is generally exercised to the …

Contracting Out Of The Culture Wars: How The Law Should Enforce And Communities Of Faith Should Encourage More Enduring Marital Commitments, Jamie A. Aycock Mar 2006

Contracting Out Of The Culture Wars: How The Law Should Enforce And Communities Of Faith Should Encourage More Enduring Marital Commitments, Jamie A. Aycock

ExpressO

This article attempts to transcend the “culture wars” as they are played out in the family law arena by drawing on postmodern values, such as individualism and neutrality, to allow individuals who so desire to choose to emphasize more traditional or communitarian values, such as interdependence and attachment. This article argues, then, as others have, that the role of contract in marriage should be extended for those who choose to agree to additional terms. Here, the argument goes a step further, however, by positing an active, positive role for communities of faith to play in a marriage regime of expanded …

Holistic Health: Does It Really Include Mental Health?, Kimberly K. Mcclanahan, Marlene B. Huff, Hatim A. Omar

Pediatrics Faculty Publications

Holistic health, incorporating mind and body as equally important and unified components of health, is a concept utilized in some health care arenas in the United States (U.S.) over the past 30 years. However, in the U.S., mental health is not seen as conceptually integral to physical health and, thus, holistic health cannot be realized until the historical concept of mind-body dualism, continuing stigma regarding mental illness, lack of mental health parity in insurance, and inaccurate public perceptions regarding mental illness are adequately addressed and resolved. Until then, mental and physical health will continue to be viewed as disparate entities …

Why Do Students Seek Enrollment Into A Bachelor's Degree Program In Hospitality Management?, Terrance R. Dinan

Theses

This study identifies underlying factors which influence students to enroll in a hospitality management bachelor's degree program. It is an important study for educational institutions from the standpoint of recruitment and for the purpose of assessing student aspirations. This study focuses exclusively on the question: "Why do students seek enrollment into a bachelor's degree program in hospitality management?"

New York City College of Technology, 300 Jay Street, Brooklyn, New York is the sole institution surveyed in this study.

The findings of this study indicate that students seek such enrollment because they have come to believe that hospitality industry jobs are …
