Commodification And Contract Formation: Placing The Consideration Doctrine On Stronger Foundations, David Gamage, Allon Kedem Sep 2006

Commodification And Contract Formation: Placing The Consideration Doctrine On Stronger Foundations, David Gamage, Allon Kedem

University of Chicago Law Review

Under the traditional consideration doctrine, a promise is only legally enforceable if it is made in exchange for something of value. This doctrine lies at the heart of contract law, yet it lacks a sound theoretical justification-a fact that has confounded generations of scholars and created a mess of case law. This Article argues that the failure of traditional justifications for the doctrine comes from two mistaken assumptions. First, previous scholars have assumed that anyone can back a promise with nominal consideration if they wish to do so. We show how social norms against commodification limit the availability of the …

The Enfleshment Of Masculinity(S): The Maintenance Of Hegemonic Masculinity, Brett N. Billman Sep 2006

The Enfleshment Of Masculinity(S): The Maintenance Of Hegemonic Masculinity, Brett N. Billman

UNIversitas: Journal of Research, Scholarship, and Creative Activity

With the proliferation of the term “masculinities” over the past two decades men’s subjective experiences have come to light in an attempt to destabilize the patriarchy. However, in this time it seems that hegemonic masculinity has in fact been attempting, quite successfully, to maintain itself through the proliferation of multiple patriarchies. Examination of the enfleshment of masculinity through the physicality of the masculine body presents us with a more articulated version of hegemonic masculinity. This more articulate view begins to highlight the politics of difference present in a discussion of Brokeback Mountain and the wide spread deployment and growth of …

What I Overheard In The Sesquicentennial Conversation, Una M. Cadegan Sep 2006

What I Overheard In The Sesquicentennial Conversation, Una M. Cadegan

Journal of Catholic Education

Catholic higher education is in many ways still responding to the challenge first articulated by John Tracy Ellis in his 1955 essay. In efforts to promote both a unique Catholic identity and a culture of excellence on par with secular institutions, Catholic universities can learn much from their historical context, founding religious communities, and contemporary experience. This essay suggests some practical applications for campus life and governance that might be culled from a university’s religious history.

Acknowledging The “I” In Multicultural Education, Osman Ozturgut Sep 2006

Acknowledging The “I” In Multicultural Education, Osman Ozturgut

Essays in Education

Banks (2001) claims for students to become successful in a diverse world, they need to have the ability to communicate and negotiate among diverse cultures. Some argue that when the cultural diversity and global tolerance are promoted within multicultural education, traditional elitism and its shortcomings would be overcome (Schugurensky, 2002). Others argue that multicultural education hinders the assimilation efforts and creating a divisive society (Bernstein, 1994).

There are many views on the benefits or shortcomings of multiculturalization of education. The question is not whether a multicultural education should be adopted but it is rather what we understand from multicultural education …

Labor Supply With Social Interactions: Econometric Estimates And Their Tax Policy Implications, Andrew Grodner, Thomas J. Kniesner Sep 2006

Labor Supply With Social Interactions: Econometric Estimates And Their Tax Policy Implications, Andrew Grodner, Thomas J. Kniesner

Center for Policy Research

Our research fleshes out econometric details of examining possible social interactions in labor supply. We look for a response of a person's hours worked to hours worked in the labor market reference group, which includes those with similar age, family structure, and location. We identify endogenous spillovers by instrumenting average hours worked in the reference group with hours worked in neighboring reference groups. Estimates of the canonical labor supply model indicate positive economically important spillovers for adult men. The estimated total wage elasticity of labor supply is 0.22, where 0.08 is the exogenous wage change effect and 0.14 is the …

The Use Of Sports In The Teaching Of Culture And Civilization: Spain As A Case Study, Juan Castillo Sep 2006

The Use Of Sports In The Teaching Of Culture And Civilization: Spain As A Case Study, Juan Castillo

UNIversitas: Journal of Research, Scholarship, and Creative Activity

Most methodological approaches to the teaching of culture and civilization for second language students tend to have two things in common. First, they put an emphasis in history and high culture: fine arts, literature and film. Second, when they cover current events, they tend to take what I will call horizontal views of the civilization, trying to cover a wide spectrum of aspects of society, and not getting into an in-depth study of any of them.

This article wants to propose a different methodology on both counts. First, instead of focusing on high culture, I want to use an item …

Children’s literature is used across the curriculum in elementary classrooms today. How is this literature viewed by preservice teachers and how will their viewpoints affect their use of literature with students? The purpose of this study was to describe preservice teachers’ written responses to children’s literature with geometric content. Six related, but distinct themes emerged after multiple readings of the responses; these themes depict preservice teachers who are: (1) making personal connections with literature, (2) reading for children, (3) being the teachers, (4) looking for the math, (5) finding instructional ideas, and (6) focusing on the morals.

Assessment For Learning: Assessment In Interaction, Ian Clark

Essays in Education

Wherever there is challenge in our classrooms there exists the opportunity for better formative assessment. It is beyond time that policy reflected the need for cognitive and affective challenges to be constructive, enjoyable and collaborative. In so doing practitioners are able to co-construct a learning environment which lends positive support to the self-esteem among our young learners in elementary and high schools. This article discusses a remedy to a deepening crisis in our classrooms. That remedy has become known as Assessment for Learning (AfL). AfL is a crucial aspect of classroom practice, the sub-routines of which focus on: the quality …

An Uncertain Position: Examining The Status Of Teaching As A Profession, Kevin C. Robb Sep 2006

An Uncertain Position: Examining The Status Of Teaching As A Profession, Kevin C. Robb

Essays in Education

The purpose of this paper is to identify the characteristics of a full profession, to review how many and which characteristics cannot be ascribed to teaching, and how this situation has come to be. The affect of gender and social class on the perception of teaching as a profession is discussed. Although, teaching still has an ambiguous status as a profession, discussing it will allow people to continue to talk, think and write about this issue. Teaching will probably never be considered a full profession because it does not involve all the characteristics of a profession.

Am I A Man Or A Feminist? Constructing Positive Male Feminist Thought, Cory Aragon Sep 2006

Am I A Man Or A Feminist? Constructing Positive Male Feminist Thought, Cory Aragon

UNIversitas: Journal of Research, Scholarship, and Creative Activity

Male Feminists find themselves in the weird position of opposing entrenched patriarchal gender hierarchies while effectively reinforcing them. The question arises, am I a man or a Feminist? This question is seated in a seemingly oppositional relationship between the culturally masculine, the culturally male, and the positive theory of Feminist thought.

In this paper, I attempt to provide a way of being both a man and a feminist. In the first section, I try to debunk the common notion of many Feminist separatist movements that the culturally male and masculine are destructive to the feminist cause. After showing that the …

Evaluation Of Program Outcomes: Assessment In Children, Cheryl M. Romano

Loma Linda University Electronic Theses, Dissertations & Projects

In an age of increased concern for accountability and the review of services, administrators of health programs should be able to present their clinics effectiveness, and demonstrate their excellent service to the community, along with providing evidence for the continued need of such clinics. Outcome evaluation plays an integral part in providing this information, and is intended to provide information concerning the effectiveness of a particular program, thus allowing for modification, and even better outcomes.

This project addressed pre and post functioning in children referred for academic and/or behavioral difficulties, in a university of health sciences-based clinic. The aim was …

Use Of Section 5310 Transportation Resources In Urban And Rural America: A Baseline Assessment, Tom Seekins Ph.D., University Of Montana Rural Institute

Independent Living and Community Participation

Consistently, people with disabilities living in rural areas and those who serve them report the lack of transportation as a primary concern (Jackson, Seekins, & Offner, 1992; National Council on Disability, 2005). Section 5310 of the Federal Transit Act (49 USC 5310) authorizes a program of capital assistance to help local organizations acquire vehicles to transport elderly individuals and people with disabilities when other public transportation is unavailable or insufficient. To effectively maximize the availability and use of transportation resources, rural disability advocates and transportation planners need data on rural and urban distribution and use of Section 5310 funds (e.g., …

Promoting Compliance Of Private Security And Military Companies With International Humanitarian Law, Benjamin Perrin

All Faculty Publications

Private security and military companies have become a ubiquitous part of modern armed conflict and post-conflict reconstruction. Their diverse clients include governments in the developed and developing world alike, non-state belligerents, international corporations, non-governmental organizations, the United Nations, and private individuals. The implications of this proliferation of private security and military companies for international humanitarian law and human rights are only beginning to be appreciated, as potential violations and misconduct by their employees have come to light in Iraq and Afghanistan. The author critically examines the theoretical risks posed by private military and security company activity with respect to violations …

A Bakhtinian Perspective On Feminist Lesbian Crime Writing, Sarah Posman Sep 2006

A Bakhtinian Perspective On Feminist Lesbian Crime Writing, Sarah Posman

CLCWeb: Comparative Literature and Culture

In her paper, "A Bakhtinian Perspective on Feminist Lesbian Crime Writing," Sarah Posman discusses how the Bakhtinian concepts "ethos" and "chronotope" add to the discussion of feminist lesbian crime writing. She sets out from a Bakhtinian typology of action stories and situates recent crime writing as a curious mixture of mission stories and transformation stories. Focusing on the innovative potential of feminist lesbian crime writing, Posman explores how such stories tackle the iconically masculine and heterosexual conventions of the detective story and manage to balance tradition and subversion successfully. Posman infuses her analysis with issues central to feminism and queer …

Gender Identities In The Contemporary Slovene Novel, Alojzija Zupan Sosic Sep 2006

Gender Identities In The Contemporary Slovene Novel, Alojzija Zupan Sosic

CLCWeb: Comparative Literature and Culture

In her article, "Gender Identities in the Contemporary Slovene Novel," Alojzija Zupan Sosic argues that perspectives of sexual identity have become prominent topics. Based on her library and publication research, Zupan Sosic proposes that in the period of 1990–2005 the Slovene novel is illuminated by a development of the personal or intimate story. In this development, changes of sexual identity evolve through the binary system of the heterosexual matrix whereby issues of sexual minorities remain. Important innovation in the Slovene novel include aspects connected to an identity formation determined by sexual identity where perhaps the most significant innovation is found …

Remoulding The Critical Junctures Approach, John Hogan Sep 2006

Remoulding The Critical Junctures Approach, John Hogan

Articles

This paper improves our understanding of critical junctures, a concept employed in historical institutionalism for exploring change. However, the concept lacks rigour, weakening our ability to define critical junctures. Of late, academics have utilized other mechanisms to identify change in historical institutionalism. Thus, it is within this context that the critical junctures approach is remoulded through the specification of standards, hence reducing uncertainty as to what constitutes a critical juncture. The remoulded approach is employed here in examining change in the Irish Congress of Trade Unions’ ~ICTU! influence over public policy in 1987.
