[Excerpt] “This article supports Gewirth’s view: that is, the reason why utilitarian values such as national security, public safety, public order, public health, and public morality may outweigh human rights is that they contain human rights elements. Thus, as a rule, whenever human rights clash with nonrights value considerations, we should analyze whether they contain human rights elements. If they do, they may override human rights that conflict with them. If they do not, they cannot.”

DNA dragnets—the mass warrantless DNA testing of individuals whom authorities have neither probable cause nor reasonable suspicion to believe perpetrated a crime, but who merely live or work near a crime scene—have increasingly been used by police departments in a desperate attempt to solve puzzling crimes. The lack of success and the Fourth Amendment constitutional concerns raised by DNA dragnets, however, lead this practice to be suspect. Under the Fourth Amendment, all searches of an individual must be reasonable. The reasonableness of any search typically depends on the government obtaining a warrant prior to the search. Incomplete Compensation And Migration Behavior: Has Anything Changed Between 1990 And 2000?, William E. Herrin, David E. Clark, Thomas Knapp, Nancy White

Spatial equilibrium models rely on migration to arbitrage away differences in utility across locations net of moving costs, where remaining differences in wages and rents reflect the compensating differentials related to site-specific amenities. Recent refinements to the spatial equilibrium model focus upon the prospect of disequilibrium in amenity markets. Amenity market disequilibrium implies over- or undercompensation (incomplete compensation) across some locations, which suggests a role for these factors in subsequent migration. This paper follows the theoretical and empirical approach of Clark, Herrin, Knapp, and White (2003). An intercity wage regression is estimated where fixed effects capture the impact of site …

Based primarily on theory, it is suspected that violent and non-violent sex-offenders can be differentiated by their psychopathic profile, as measured by the Psychopathy Checklist-Revised (PCL-R; Hare, 1991). There is some concern that current risk-assessment instruments are not designed according to the characterological composition of violent and non-violent sex-offenders, which is believed to be essential to the instruments' predictive ability. Specifically, it is believed that such instruments are not sufficiently sensitive to the psychopathic characteristics associated with non-violent sex-offenders, as well as not sufficiently specific to the psychopathic characteristics associated with violent sex-offenders. This research investigated the quality and strength characteristics ofboth American and Chinese manufactured fasteners. The purpose of this research was to determine if there is a significant statistical difference between both manufacturers dimensional and tensile strength characteristics as to the American National Standards Institute's specified tolerances. The researcher selected the independent samples t-test to analyze the raw data collected from the experiment. SPSS 13.0 statistical analysis software was used to determine the degree of correlation between the independent variables: fastener dimensions, and ultimate tensile strengths. Down To The Wire: Assessing The Constitutionality Of The National Security Agency's Warrantless Wiretapping Program: Exit The Rule Of Law, Fletcher N. Baldwin Jr., Robert B. Shaw

The article discusses the constitutionality of warrantless wiretapping surveillance by the National Security Agency (NSA) on U.S. citizens. The wiretapping program existed weeks after the September 11, 2001 attacks, on the justification that Congress authorized the president to wiretap U.S. citizens without a warrant, and that the president had inherent authority as commander-in-chief. But it is argued that Congress did not expressly authorize the president to conduct warrantless wiretapping and that he does not have such inherent authority.

Resource equalization represents the historical and theoretical basis for American school finance and its ideals continue to dominate discussion and practice. During the last decade and a half, the national aspiration for equitable distribution of school finance resources has started a transformation into a derivative notion of adequacy. This equity policy derivative embraces the idea of sufficiency, which in turn implies a standard. The concept of educational adequacy has grown to mean the achievement of high absolute standards. This dissertation is a case study of an adult probation department in a southern state. Adult probation is an important part of the criminal justice system, as it provides a reduced program cost compared with incarceration. Current literature proposes that adult probation is in crisis due to poor to sub-standard performance by probationers, a collapse in supervision, and decline in probation funding. Policing strategies have gravitated toward a consensus paradigm model, commonly referred to as "community policing." This is a significant paradigm shift, yet most police academies continue to use traditional lecture-based pedagogical methods to train police officers. One possible alternative to passive lecture-based teaching is a more active problem-based learning. Problem-based methodologies consist of presenting ill-structured problems whereby an instructor facilitates and directs the students in active inquiry toward possible solutions for a specific problem.

This study focuses on the state corporate crime that occurred when Kalamazoo Department of Public Safety implemented two computer systems that never functioned as promised. Failure of these systems resulted in death, injury, and substantial waste of taxpayer money. A case study method is used to describe and explain how this social harm occurred. An integrated theory of state-corporate crime developed by Kauzlarich and Kramer (1998) is used to examine theintersection of deviance between corporate vendors, the public safety department, and the federal government. Assessing the impact of community development coalitions over time is relevant to Extension professionals who may wish to measure success and lessons learned. We describe an evaluation tool in which coalition members and key informants assess community goals before the existence of the community coalitions and after the coalitions have been operating, utilizing a retrospective pretest. The responses of coalition members are posted, and a facilitated discussion allows members to change their ratings. Key informants are then interviewed using the same questions. The responses of informants and coalition members are compared, resulting in a comprehensive yet quick evaluation.
