Transcript from Who Profits from Nonprofits? A Symposium on Nonprofit Organizations. I have followed the development of CUNY Law School from its founding, and I really have to salute you. Today, I am going to explore some of the myths and realities of the nonprofit sector.

Victimhood, Jessie K. Liu Jan 2006

Victimhood, Jessie K. Liu

Missouri Law Review

Part I of this paper examines the theoretical tension between using the total harm caused by a convicted defendant to determine the proper punishment and limiting the categories of harm for which punishment can be imposed. This is the equivalent in the criminal context of the problem discussed in the classic tort case of Palsgraf v Long Island Railroad. How should a legal regime limit the universe of victims? Part II provides a brief overview of pre-Guidelines decisions defining the term "victim" for sentencing purposes, focusing in particular on constitutional decisions about victim participation. Although the Sentencing Guidelines have made …

A Study To Evaluate The Efficacy Of A Cognitive Change Program, Thinking For A Change, On The Behavior Of Adult Male Offenders Incarcerated In Indiana Prisons, Harry James Sykes

All-Inclusive List of Electronic Theses and Dissertations

Indiana correctional officials continually look for programs that change offender behavior, both within the correctional facility setting and subsequent to their release back into the community. The Thinking for a Change program, developed in 1997 by Bush, Glick, and Taymans is a cognitive behavioral program currently being used to affect change in adult males incarcerated within the Indiana Correctional system. This study compared Class "A" and Class "B" disciplinary write-ups received by three groups of offenders; those who completed the Thinking for a Change (Bush et al.) program and received a time cut, those who completed the Thinking for a …

Headscarf Stories, Ian Ward Jan 2006

Headscarf Stories, Ian Ward

UC Law SF International Law Review

The seemingly intractable issue of headscarves - when they can be worn, and when they cannot - is currently contested in much of Europe. The apparent intractability is a common experience. The purpose of this article is to present three headscarf 'stories,' and in so doing, stress the narrative nature of this intensely moral and political, as well as legal, controversy. Narrativity, it will be suggested, offers a far more effective means of approaching this kind of issue and its inevitable indeterminacies than the simple recourse to blunt legal instrumentation. While the law must, it seems, play a role in …

Sensor-Based Computing Techniques For Real-Time Traffic Evacuation Management, Georgiana Hamza-Lup Jan 2006

Sensor-Based Computing Techniques For Real-Time Traffic Evacuation Management, Georgiana Hamza-Lup

Electronic Theses and Dissertations

The threat of terrorist incidents is higher than ever before and devastating acts, such as the terrorist attacks on the World Trade Center and the Pentagon, have left many concerns about the possibility of future incidents and their potential impact. Unlike some natural disasters that can be anticipated, terrorist attacks are sudden and unexpected. Even if sometimes we do have partial information about a possible attack, it is generally not known exactly where, when, or how an attack will occur. This lack of information posses great challenges on those responsible for security, specifically, on their ability to respond fast, whenever …

Streamlining Habeas Corpus While Undermining Judicial Review: How 28 U.S.C. Sec. 2254(D)(1) Violates The Constitution, Muhammad U. Faridi Jan 2006

Streamlining Habeas Corpus While Undermining Judicial Review: How 28 U.S.C. Sec. 2254(D)(1) Violates The Constitution, Muhammad U. Faridi

St. Thomas Law Review

Although this article focuses on the writ of habeas corpus as filed by prisoners in state custody and as regulated by 28 U.S.C. § 2254, the recent developments involving the writ as filed by prisoners in federal custody and as regulated by 28 U.S.C. § 2241 are worth noting. Section II of Justice Steven's majority opinion in Rasul v. Bush2 deserves reading and re-reading because it recognizes the importance of the writ of habeas corpus in American jurisprudence. Section IV of the opinion holds that even "[a]liens held at the [Guantanamo Bay] base, no less than American citizens, are entitled …

Still, What's So Compelling? The Supreme Court's Continued Application Of The Ginsberg Analysis And Its Effect On The Attempted Regulation Of Internet Pornography In Ashcroft V. American Civil Liberties Union, 542 U.S. 656 (2004), Michael J. Kuhn

Nebraska Law Review

This Note will begin with an examination of the circumstances leading to the Supreme Court's decision, discussing both the case history of sex speech as well as the legislative backdrop to the creation of COPA. Next, section III.A will demonstrate how the majority opinion of the Supreme Court narrowed the protected class originally intended by Congress. Section III.B will explain how the majority opinion's arguments touting filtering software as a more effective and less restrictive means fail when applied to the intended broader class. Section III.C will argue that these findings are directly related to the Supreme Court's implicit reliance …

Dog-Focused Law's Impact On Disability Rights: Ontario's Pit Bull Legislation As A Case In Point, Barbara Hanson Jan 2006

Dog-Focused Law's Impact On Disability Rights: Ontario's Pit Bull Legislation As A Case In Point, Barbara Hanson

Animal Law Review

Legislation that affects dogs also affects persons with disabilities to some extent. This link shows up in statutory definitions, is justified by social construction theory, and has been reified in case law. Thus, it is important to examine statutes like Ontario’s pit bull legislation in terms of their potential impact on persons with disabilities. Upon close examination, it appears that the legislation suffers from vague definitions, conflicting onus of proof, absence of fair process, and severe penalties, including imprisonment. Further, it contains no reference to dogs used by persons with disabilities. This means that there is potential for persons with …
