Harmonising European Private International Law: A Replay Of Hannibal’S Crossing Of The Alps?, Eleanor Cashin Ritaine Jul 2006

Harmonising European Private International Law: A Replay Of Hannibal’S Crossing Of The Alps?, Eleanor Cashin Ritaine

International Journal of Legal Information

Everybody knows that the quickest way to go from Florence to Geneva is to fly by plane. Others go the long way, over the Alps, through snow covered passes. Once upon a time, Elephants attempted an impossible route, and the feat is still discussed nearly two thousand years later. They were unprepared and their thick hides did not protect them from the cold. Yet their leader Hannibal had a dream and he accomplished it.

The route chosen to harmonize Private International Law is just as difficult, but Private International lawyers tend to be dreamers, who luckily benefit from the very …

Judges, Juries, And Punitive Damages: Empirical Analyses Using The Civil Justice Survey Of State Courts 1992, 1996, And 2001 Data, Theodore Eisenberg, Paula L. Hannaford, Michael Heise, Neil Lafountain, Brian Ostrom, Martin T. Wells, G. Thomas Munsterman

Cornell Law Faculty Publications

We analyze thousands of trials from a substantial fraction of the nation's most populous counties. Evidence across ten years and three major datasets suggests that: (1) juries and judges award punitive damages in approximately the same ratio to compensatory damages, (2) the level of punitive damages awards has not increased, and (3) juries' and judges' tendencies to award punitive damages differ in bodily injury and no-bodily-injury cases. Jury trials are associated with a greater rate of punitive damages awards in financial injury cases. Judge trials are associated with a greater rate of punitive damages awards in bodily injury cases.

Detecting Filled Pauses In Tutorial Dialogs, Gaurav Garg, Nigel Ward Jul 2006

Detecting Filled Pauses In Tutorial Dialogs, Gaurav Garg, Nigel Ward

Departmental Technical Reports (CS)

As dialog systems become more capable, users tend to talk more spontaneously and less formally. Spontaneous speech includes features which convey information about the user's state. In particular, filled pauses, such as `um' and `uh', can indicate that the user is having trouble, wants more time, wants to hold the floor, or is uncertain. In this paper we present a first study of the acoustic characteristics of filled pauses in tutorial dialogs. We show that in this domain, as in other domains, filled pauses typically have flat pitch and fairly constant energy. We present a simple algorithm based on these …

Modernist Anti-Philosophicalism And Virginia Woolf's Critique Of Philosophy, Michael Lackey Jul 2006

Modernist Anti-Philosophicalism And Virginia Woolf's Critique Of Philosophy, Michael Lackey

English Publications

Woolf was one of many modernists who led an assault on philosophy. Given her anti-philosophical orientation, those scholars who use philosophy to interpret Woolf, I argue, are implicitly at odds with her aesthetic. Crucial to my argument is Woolf's conception of what I refer to as the semiotic unconscious, which predetermines the conceptual systems we use to systematize our experiences of the world. Based on my findings, I suggest an alternative frame for understanding Woolf's treatment of philosophy and, more generally, modernist anti-philosophicalism. Instead of assuming that philosophy signifies intellectual depth, as many scholars do, I suggest approaching Woolf, as …

Posttraumatic Stress Disorder And Civil War Reenactors, Kimberlee Bruce Jul 2006

Posttraumatic Stress Disorder And Civil War Reenactors, Kimberlee Bruce

Graduate Research Projects

The purpose of this phenomenological study was to explore the meaning of Civil War reenactments in military men with symptoms of posttraumatic stress disorder (PTSD). Six Caucasian males who have PTSD symptoms were interviewed in depth by responding to two questions. I. Why do you reenact? And 2. What sticks out in your mind about Civil War reenacting after having served in the military? Five themes emerged; escaping reality, structure and discipline, honor and duty, friendship and companionship, and love of history. The findings of this study will add to the body of nursing knowledge about PTSD by exploring a …

Opening Access To Environmental Software Systems, Daryl H. Hepting, Timothy Maciag Jul 2006

Opening Access To Environmental Software Systems, Daryl H. Hepting, Timothy Maciag

International Congress on Environmental Modelling and Software

As individuals are increasingly being called to act in environmentally-conscious ways, they will seek out any and all resources which might help to inform their actions. Unfortunately, a 2002 OECD report indicated that there seemed to be declining trust of environmental information sources and increasing confusion about which actions could be most beneficial. Environmental Software Systems can provide relief in this context, if the software design is user-centered. The very specialized nature of much environmental software may discourage these design practices, but this is a false economy. Instead of software that is based on technical models developed by environmental scientists, …

Towards Agent-Based Modelling Of Stakeholder Behaviour – A Pilot Study On Drought Vulnerability Of Decentral Water Supply In Ne Brazil, Anne Gunkel, Ch Külls

International Congress on Environmental Modelling and Software

While Integrated Natural Resources Management (INRM) creates a need for an integration of natural and socio-economic information, suitable approaches and tools are needed to facilitate this integration. If these tools are meant to support the decision-making process of the stakeholders, it is important that they are adapted to the needs and requirements of these end-users. One way to achieve this is the flexible and seamless direct participation of stakeholders through adequate model structures and interfaces. Participatory methods should facilitate the communication process with different stakeholders and allow for interactions between them. Models for this purpose ideally contribute to the stakeholder’s …

Reexamining Relational Youth Ministry: Implications From The Theology Of Bonhoeffer, Andrew Root Jul 2006

Reexamining Relational Youth Ministry: Implications From The Theology Of Bonhoeffer, Andrew Root

Faculty Publications

Youth ministry often focuses on building relationships between youth ministers and adolescents. But to what end? A relationship designed to influence the other is no relationship and is unworthy of Christ. In a true relationship Christians must be willing fully to share the place of another.

Engineering Students' Perceptions Of And Attitudes Towards Cheating, Donald D. Carpenter, Trevor S. Harding, Cynthia J. Finelli, Susan M. Montgomery, Honor J. Passow Jul 2006

Engineering Students' Perceptions Of And Attitudes Towards Cheating, Donald D. Carpenter, Trevor S. Harding, Cynthia J. Finelli, Susan M. Montgomery, Honor J. Passow

Materials Engineering

Academic dishonesty has become a serious problem at institutions of higher learning. This is particularly true in engineering where, according to previous research, engineering undergraduates are among the most likely to cheat in college. To investigate this concern, the authors embarked on a research project whose goal was to develop a better understanding of what students and faculty perceive as cheating and to use this knowledge to help instructors and institutions increase the level of academic integrity among students. The primary instrument for this project was a seven-page survey that was administered to 643 engineering and pre-engineering undergraduates at eleven …

Measuring The Influence Of Built Neighborhood Environments On Walking In Older Adults, Yvonne L. Michael, Tracey Beard, Dongseok Choi, Stephanie Farquhar, Nichole Carlson Jul 2006

Measuring The Influence Of Built Neighborhood Environments On Walking In Older Adults, Yvonne L. Michael, Tracey Beard, Dongseok Choi, Stephanie Farquhar, Nichole Carlson

Community Health Faculty Publications and Presentations

Examined the degree of association between perceived and objective characteristics of the neighborhood environment and the relation of each type of measurement to neighborhood walking in older adults. Participants included 105 adults aged 65-92 (mean age 75.1) from 10 neighborhoods in Portland, Oregon, participating in Senior Health and Physical Exercise (SHAPE), a randomized walking intervention. Neighborhoods were stratified by a "walking friendliness" ranking variable. This variable was derived for each neighborhood based on available social and environmental data that were hypothesized to correlate with walking and physical activity: high income, high older adult population density, high proportion of white residents, …

Among the behaviors addressed by the WW, alcohol and other drug …

Role Of The Nurse Practitioner: Health Promotion And Education In Teenage Pregnancy Prevention, Alissa Anne Hood Jul 2006

Role Of The Nurse Practitioner: Health Promotion And Education In Teenage Pregnancy Prevention, Alissa Anne Hood

MSN Research Projects

According to Martin, Kochanek, Strobino, Guyer, & MacDorman (2005), the lowest reported rate in the past six decades for teenage pregnancy in the United States occurred in the year 2003. Although this was found significant, the United States still holds the highest rate of teenage pregnancy in the industrialized world. It has been estimated that by the year 2010 there will be a 10% increase in the number of teenage girls between the ages of 15-19(Coren, 2005). Therefore, it was found imperative to increase the awareness and promotion of healthy sexual behaviors to reduce further teenage pregnancy. The purpose of …

The Ethics Of Referral, Bernard Rollin Jul 2006

The Ethics Of Referral, Bernard Rollin

Professional Veterinary Ethics Collection

The rapid growth of veterinary specialty practices has created a number of vexatious ethical issues relevant to veterinary medicine. The preeminent question pertains to “the duty to refer.” Do primary care practitioners have such a moral duty? If so, when does this duty arise? Does it pertain in all cases where specialized knowledge is relevant to a disease?

This raises the fundamental question of “Veterinary Ethics” — namely, does the veterinarian ideally have primary obligation to the client/owner or the animal? (1) There are 2 possible ideal types that a veterinarian can aim for — the Garage Mechanic Model or …
