Individual Or Collective Liability For Corporate Directors?, Darian M. Ibrahim
Individual Or Collective Liability For Corporate Directors?, Darian M. Ibrahim
ExpressO
Fiduciary duty is one of the most litigated areas in corporate law, and the subject of much academic attention, yet one important question has been ignored. Should fiduciary liability be assessed individually, where directors are examined one-by-one for compliance, or collectively, where the board's compliance as a whole is all that matters? The choice between individual and collective assessment can be the difference between a director's liability and her exoneration, affects how boards function, and informs the broader fiduciary duty literature in important ways. This article is the first to explore the individual/collective question and suggest a systematic way of …
Power As A Factor In Lawyers' Ethical Deliberations, Susan D. Carle
Power As A Factor In Lawyers' Ethical Deliberations, Susan D. Carle
ExpressO
A fundamental disagreement among legal ethics scholars concerns the difference between client-centered and justice-centered approaches to lawyers’ ethical obligations. Advocates of client-centered approaches put lawyers’ duty to the client first. Justice-centered theorists critique the elevation of the client’s interests over other important concerns lawyers affect through the work they do on behalf of clients. Scholars who adopt justice-centered approaches argue that lawyers’ ethical obligations should be analyzed with a paramount focus on achieving justice.
Legal ethicists often view these two approaches as inconsistent with each other, but I argue in this Article that they are not necessarily so. Building on …
The Right To Self-Determination And Statehood: The Case Of Kosovo, Besfort Rrecaj
The Right To Self-Determination And Statehood: The Case Of Kosovo, Besfort Rrecaj
ExpressO
Introduction To explore self-determination is, in the words of Antonio Cassese”, a way of opening a veritable Pandora’s Box.” Indeed, the historical evolution of the concept reveals that it has been subjected to ambiguity, misconception and contradictory application. Over the years, it was redefined and re-applied on the basis of the interests of particular states. More recent events, namely the dissolution of the USSR and Yugoslavia, have given a new perspective to the meaning of self-determination. In this post Cold War era, greater attention is being paid to the enforcement of human rights and with it, a broader understanding of …

Attrition In A Multi-Component Smoking Cessation Study For Females, Robert F. Leeman, Zandra N. Quiles, Laurence A. Molinelli, Donna Medaglia Terwal, Beth L. Nordstrom, Arthur J. Garvey, Taru Kinnunen
Publications and Research
Limiting attrition (i.e., participant dropout before the conclusion of a study) is a major challenge faced by researchers when implementing clinical trials. Data from a smoking cessation trial for females (N = 246) were analyzed in order to identify baseline smoking-related, demographic and psychological characteristics affecting likelihood of early (i.e., before the quit attempt) and late (i.e., after the quit attempt) dropout. There were a number of significant demographic predictors of attrition. Participants with at least one child living at home were at increased risk of both early and late dropout. Non-Whites were at increased risk of early dropout, while …
The Life And Public Career Of Robert F. Kennedy., Daryl Anthony Carter
The Life And Public Career Of Robert F. Kennedy., Daryl Anthony Carter
Electronic Theses and Dissertations
There have been many notable politicians in the United States during the twentieth century. Some, like Teddy Roosevelt and Ronald Reagan, were known for their swagger and appeal to the common man. Others, like Bill Clinton and Franklin Roosevelt, were known for their charisma and intelligence. However, one in particular was known for caring, compassion, strength, and determination. Robert Francis Kennedy lived in interesting times, surrounded by large egos and near mythical figures. But Kennedy was arguably one of the most important figures of the last fifty years. The ideas and ideals that he espoused still resonate nearly forty years …

Shedding Light Upon The Shadows: An Examination Of The Use Of Voice As Resistance And Reclamation Of The Black Woman From Enslavement To Freedom., Courtney Erin Brooks
Electronic Theses and Dissertations
My research examines the enslaved black woman's reclamation of self through the use of voice and resistance from enslavement into freedom. I argue that the enslaved black woman's voice was one that grew stronger and louder, in an effort to have her story heard, through her attempts of reclamation of self and transition from slave to a free woman. I begin with an introduction to the purpose of my research. Chapter one describes my approach to my research. Chapter two describes the conditions of slavery for black women. Chapter three describes enslaved black women's mechanisms of resistance. Chapter four examinations …

Perceived Job Satisfaction Factors Impacting The Retention Of Middle School Teachers In Northwest North Carolina., Karen Ward Farthing
Electronic Theses and Dissertations
The body of research related to teacher retention continues to grow but is limited concerning middle school teachers. The focus of this study was to examine the factors of job satisfaction for middle school teachers. A portion of the study compares teacher responses with Herzberg, Mausner, and Snyderman's 1959 study of motivation. Additional components of the study provide middle school teachers' feedback on their dispositions and recommendations to administrators and others for attracting and retaining quality middle school teachers.
This qualitative study includes a review of related literature and includes a historical perspective of job satisfaction and a discussion of …

Creating Communities Of Mathematical Thinkers In The Pre-Kindergarten Classroom., Robin Penley Herndon
Electronic Theses and Dissertations
This thesis describes a standards-based pre-kindergarten mathematics curriculum. The purpose of this thesis was to create a series of original lesson plans for the pre-kindergarten classroom that would address defined standards with instructional and other materials appropriate for teaching and assessing student understanding of the concepts. The curriculum is based on standards set forth by the National Council of Teachers of Mathematics and the Virginia Department of Education's Foundation Blocks for Early Learning. The body of the work introduces the foundation for the thesis with theoretical underpinning, defines the content strands and learning objectives, establishes a pacing schedule for meeting …
American Reeducation Of German Pows, 1943-1946., Pamela Croley
American Reeducation Of German Pows, 1943-1946., Pamela Croley
Electronic Theses and Dissertations
The United States held almost 500,000 enemy combatants within her borders during World War II. Out of those 500,000 men, 380,000 were from Nazi Germany. Nazi POWs were confined to camps built near small rural towns in almost every state. It was not something that was well known to the American public. Even less known was the American Military's effort, through reeducation, to introduce Hitler's soldiers to a new political ideology-democracy. This thesis will explore how the reeducation program was formed; examine the people, both German and American, who participated in it, and make a determination on whether or not …
The Internal Odyssey Of Identity: James Baldwin, Go Tell It On The Mountain, And History., Brent Nelson Lamons
The Internal Odyssey Of Identity: James Baldwin, Go Tell It On The Mountain, And History., Brent Nelson Lamons
Electronic Theses and Dissertations
This study investigates how James Baldwin thought about history and treats his first novel as an important document in extricating his construct of the past. A close reading of the work reveals that it is an examination rather than a symptom of two powerful forces that dominate Baldwin's psychology, his father and his history.
James Baldwin felt the individual interpretation of one's experience is just as important as the experience itself. The novel is an informative exposition of how people interpret their experience and how that interpretation affects their psychology. Through Go Tell It on the Mountain Baldwin recreates the …

Two Types Of Consequentialism, Two Types Of Formalism: Reconsidering Bordenkircher In Light Of Apprendi, Michael M. O'Hear
ExpressO
While the Supreme Court approved of the use of charging threats nearly thirty years ago in Bordenkircher v. Hayes, a more recent line of cases has subtly undermined key premises of that landmark decision. In order to induce guilty pleas, prosecutors might use any of a number of different tactics. A prosecutor might, for instance, charge aggressively in the first instance and then promise to drop the most serious charges in return for a guilty plea to a lesser offense. Bordenkircher addressed the mirror-image of this tactic: the prosecutor filed relatively minor charges at first, but then threatened to pursue …
Mediating Animal Law Matters, Kathy M. Hessler
Mediating Animal Law Matters, Kathy M. Hessler
ExpressO
Animal law matters are slowly making their way through our court system, resulting in some changes in the way we, as a society, view our relationships with non-human animals. Courts are increasingly struggling to reconcile two opposing constructs: the idea that non-human animals are property under the law, and the reality that non-human animals are different from other forms of property. Progress in resolving this tension within the courts is, and will continue to be, slow. The question then arises, what alternative exists?
Mediation is a method increasingly turned to in this country as an alternative to traditional litigation. It …
