Taking Offense And Individual Differences: Who We Are Determines What Offends Us, Sarah J. Mcdougal Sep 2006

Taking Offense And Individual Differences: Who We Are Determines What Offends Us, Sarah J. Mcdougal

USF St. Petersburg campus Honors Program Theses (Undergraduate)

Scarce literature regarding the mechanisms of offense-taking exists. However, a broad survey of literature in social psychology points to several possible mechanisms such as: breaking cultural norms, sensemaking and the correspondence bias (Gilbert, 2000), intent, and individual differences. In this paper two individual differences are examined: need for cognition and narcissism. A survey presenting four scenarios, two generally offensive situations and two personal affronts, showed that those high in need for cognition were less likely to make a negative character judgment about the "offender" in several scenarios, while there was no distinguishable difference between those high or low in narcissism.

Toward A Feminist Theory Of The Rural, Lisa R. Pruitt Sep 2006

Toward A Feminist Theory Of The Rural, Lisa R. Pruitt

ExpressO

Feminists have often criticized law’s ignorance of women’s practical, lived experiences, even as they have also sought to reveal the variety among those experiences. This article builds on both critiques to argue for greater attentiveness to a neglected aspect of women’s situation: place. Specifically, Professor Pruitt asserts that the hardships and vulnerability that mark the lives of rural women and constrain their moral agency are overlooked or discounted by a contemporary cultural presumption of urbanism.

Professor Pruitt considers judicial responses to the realities of rural women’s lives in relation to three different legal issues: domestic violence, termination of parental rights, …

When Should Judges Appoint Experts?: A Law And Economics Perspective, Jonathan T. Tomlin, David Cooper Sep 2006

When Should Judges Appoint Experts?: A Law And Economics Perspective, Jonathan T. Tomlin, David Cooper

ExpressO

The Supreme Court’s decision in Daubert v. Merrell Dow Pharmaceuticals placed federal judges in the role of “gatekeepers” empowered to evaluate the reliability of often complex expert testimony. Many judges, commentators, and legal scholars have argued that court-appointed experts can assist judges in appropriately carrying out their gatekeeping role. However, previous literature has not evaluated the role of court-appointed experts in a rigorous framework that considers the complex interaction of the incentives of expert witnesses, the impact of expert witnesses on the decision-making of the fact finder, and the knowledge of the judge. In this article, we provide such a …

The International Protean Career: Considerations For Human Resource Management, Marian Crowley-Henry Sep 2006

The International Protean Career: Considerations For Human Resource Management, Marian Crowley-Henry

Conference papers

This paper presents some career patterns from a research undertaking which qualitatively sampled highly educated Western foreign residents in the South of France. In the data collection, their individual career stories were relayed to the researcher from in-depth exploratory interviews. The very personal and individual nature of these careers is underlined in the research findings. The aim of this paper is to share some of the broader findings from the study, which invoke discussion on the wider concerns for career management within the HRM discipline in the future.

The Group Dynamics Theory Of Executive Compensation, Michael B. Dorff Sep 2006

The Group Dynamics Theory Of Executive Compensation, Michael B. Dorff

ExpressO

The corporate governance debate has focused recently on executive compensation. While defenders of the status quo assert that CEO compensation – and corporate governance generally -- is efficient, critics contend that boards have been captured by powerful CEOs who demand excessive pay unconditioned on their performance. Both sides argue that the evidence garnered from CEO compensation justifies their positions on legal reform of corporate governance as a whole. Defenders of the status quo argue that the system works well as is, as demonstrated by the enormous success of U.S. corporations. Critics concerned about managerial power propose reforms that will increase …
